HomeMy WebLinkAbout2006-05-23 - AGENDA REPORTS - MRCA MOA (2)Agenda Item: _ %,3 CITY OF SANTA CLARITA AGENDA REPORT CONSENT CALENDAR City Manager Approval: Item to be presented by: Curtis Nay DATE: May 23, 2006 SUBJECT: ENTER INTO A MEMORANDUM OF AGREEMENT WITH THE MOUNTAINS RECREATION AND CONSERVATION AUTHORITY TO ALLOW FOR THE MITIGATION OF IMPACTS FROM FUTURE PROJECTS DEPARTMENT: Public Works RECOMMENDED ACTION City Council enter into a Memorandum of Agreement with the Mountains Recreation and Conservation Authority to offset the City's future obligations to replace, restore, or acquire property for habitat conservation and mitigation as required by the California Department of Fish and Game; transfer $200,000.00 from Account No. 54013301-8001 to Account No. S4013301-8620; and authorize the City Manager or designee to execute all documents, subject to City Attorney approval. BACKGROUND The City has an opportunity to enter into a Memorandum of Agreement (MOA) with the Mountains Recreation and Conservation Authority (MRCA) to participate in the purchase of 1,012 acres of vacant property. This property is located south of the Antelope Valley freeway and east of Agua Dulce Canyon Road in the unincorporated area of Los Angeles County. The property is being sold pursuant to the Bankruptcy Court. On May 26, 2006, an auction will be held with a minimum bid of $1,850,000.00. MRCA approached the City to partner in this acquisition, and the subsequent creation of a conservation area. The City's participation will ensure MRCA can bid competitively at the auction. MRCA will pay the balance of the purchase price. MRCA is a local government public entity established in 1985 pursuant to the Joint Powers Act. MRCA is a partnership between the Santa Monica Mountains Conservancy, which is a state agency established by the Legislature, the Conejo Recreation and Park District, and the Rancho Simi Recreation and Park District, both of which are local park agencies established by the vote APPROVED of the people in those communities. This MOA would allow the City to contribute $200,000.00 toward the purchase of the property in exchange for credit in the form of habitat mitigation for future City projects. The number of credits will be proportionate to the City's contribution. Bridge and Thoroughfare funds will be used for this transaction. Environmental agencies such as the California Department of Fish and Game have been requiring agencies to set aside habitat areas to mitigate the impacts of projects as a condition of their permits. This purchase will add to the City's bank of land that will be available for this use. This MOA will cost the City $200,000.00. This agreement will provide a timesaving benefit, as the City may not have to identify or acquire additional parcels to meet a future mitigation requirement. Staff believes that the cost of the agreement will be offset by the time savings and future cost of the City directly acquiring property for a mitigation requirement, and that the location and size of the property is beneficial to the overall establishment of a habitat corridor in the vicinity. ALTERNATIVE ACTIONS Other action as determined by the City Council. FISCAL IMPACT Adequate funds are budgeted in Account No. S4013301-8001 for the requested transfer to S4013301-8620. Execution of the transfer and subsequent payment to the MRCA will satisfy the City's obligation under the MOA. The City will then be entitled to use a portion of the acquired property for mitigation requirements for a future City project.
