HomeMy WebLinkAbout2006-11-14 - AGENDA REPORTS - NON CONFORMING SIGNS ABATE (2)UNFINISHED BUSINESS Agenda Item: _ //�7— CITY OF SANTA CLARITA AGENDA REPORT City Manager Approval Item to be presented by: DATE: November 14, 2006 SUBJECT: ORDER ABATEMENT OF NON -CONFORMING SIGNS, DECLARED AS PUBLIC NUISANCES DEPARTMENT: Community Development RECOMMENDED ACTION City Council receive update on the Sign Compliance Program regarding the status of the eight (8) non -conforming signs, declared public nuisances by the City Council on August 22, 2006, and order abatement of the remaining three (3) public nuisances. BACKGROUND A. Declaration ofEieht Non -Conforming Suns As Public Nuisances and Order to Abate On August 22, 2006, the City Council considered and adopted Resolution No. 06-90, declaring eight non -conforming signs as public nuisances and declaring its intention to abate the non -conforming signs. On September 26, 2006, the City Council conducted a public hearing and considered objections to the proposed removal of eight non -conforming signs, closed the record to any new objections, and continued the item to November 14, 2006. Since the September 26th hearing, five of the eight non -conforming signs have been voluntarily removed. The City, by motion or resolution of the City Council, may abate the three remaining non -conforming signs as set forth in Santa Clarita Municipal Code § 17.19.250(D)(5). B. The Subiect Non-Conforminz Signs 1. 18003 Soledad Canyon Road – Gas Mini -Mart On August 22, 2006, the City Council declared the non -conforming sign located at 18003 Soledad Canyon Road to be a public nuisance and further declared its intent to abate. On ,Pe>0 . 0(0_)014 Reso. O(o- 10-5 Adopted: e, - 10 September 26, 2006, the City Council considered objections to the proposed removal of the non -conforming sign. No objections to the proposed abatement have been received by staff. As of the preparation of this staff report, the non -conforming sign is still present at this location. 2. 18255-18295 Soledad Canyon Road — La Pico Plaza On September 25, 2006, the non -conforming sign located at 18255-18295 Soledad Canyon Road (APNs: 2844-004-014, 2844-004-078 & 2844-004-077) was removed from the property and is no longer considered a public nuisance. No further action is necessary. 3. 18514-18520 Soledad Canyon Road — Sierra Plaza On October 2, 2006, the non -conforming sign located at 18514-18520 Soledad Canyon Road (APN: 2803-028-014) was removed from the property and is no longer considered a public nuisance. No further action is necessary. 4. 18902-18932 Soledad Canyon Road — The Knoll On September 22, 2006, the non -conforming sign located at 18902-18932 Soledad Canyon Road (APN: 2803-029-023) was removed from the property and is no longer considered a'public nuisance. No further action is necessary. 5. 18950 Soledad Canyon Road — Carl's Jr. On August 22, 2006, the City Council declared the non -conforming sign located at 18950 Soledad Canyon Road to be a public nuisance and further declared its intent to abate. A representative of the property owner appeared at the August 22nd hearing to express objections to the proposed abatement. An analysis of those objections is contained in the staff report prepared for the September 26, 2006 City Council hearing (see attachment). On September 26, 2006, the City Council heard and considered objections from a property representative and closed the record to any new objections. As of the preparation of this staff report, the non -conforming sign is still present at this location. 6. 20723 Soledad Canyon Road — Country Auto On September 25, 2006, the non -conforming sign located at 20723 Soledad Canyon Road (APN: 2805-018-028) was removed from the property and is no longer considered a public nuisance. No further action is necessary. 7. 20733 Soledad Canyon Road — Santa Clarita Valley Auto Specialists On August 22, 2006, the City Council declared the non -conforming sign located at 20733 Soledad Canyon Road to be a public nuisance and further declared its intent to abate. On September 26, 2006, the City Council conducted a public hearing and considered objections to the proposed removal of the non -conforming sign. No objections to the proposed abatement have been received by staff. As of the preparation of this staff report, the non -conforming sign is still present at this location. 8. 21441121445 Soledad Canyon Road — Santa Clarita Valley Rental Center On September 25, 2006, the non -conforming sign located at 21441/21445 Soledad Canyon Road Soledad Canyon Road (APN: 2849-021-020) was removed from the property and is no longer considered a public nuisance. No further action is necessary, ANALYSIS To date, staff has received objections to the removal of one (1) non -conforming sign: the Carl's Jr. sign located at 18950 Soledad Canyon Road. A. Objections to Removal of Non Conforming Sign at 18950 Soledad Canyon Road (Carl's Jr.) A thorough analysis of the objections raised by the property representative for Carl's Jr. was provided in the staff report prepared for and considered at the September 26, 2006 City Council hearing. Attached hereto is the September 26th staff report and analysis of the objections raised by the representative of Carl's Jr. B. Obiections to Removal of the two (2) Remaining Non -Conforming Signs Staff has not received any objections to the removal of the two (2) remaining non -conforming signs that were declared as public nuisances by the City Council on August 22nd. As of the preparation of this staff report, the non -conforming signs are still present at their respective locations. The City, by motion or resolution of the City Council, may abate the two (2) remaining non -conforming signs, as set forth in Santa Clarita Municipal Code § 17.19.250(D)(5). As before, the property owners involved may either complete the abatement themselves or the City will do the work and recover the cost of the abatement through a special assessment and lien against the individual property. ALTERNATIVE ACTIONS Other actions as determined by the City Council. FISCAL IMPACT Expenses incurred by the City in enforcing abatement upon the property, including investigation, boundary determination, measurement, clerical, legal and other related costs, may be recovered as a special assessment and lien under Santa Clarita Municipal Code § 17.19.250(D)(10).
