HomeMy WebLinkAbout2006-01-24 - AGENDA REPORTS - TITLE TRSFR SAN FERNANDO RD (4)Agenda Item: JOINT MEETING BETWEEN THE SANTA CLARITA CITY COUNCIL/ REDEVELOPMENT AGENCY AGENDA REPORT C City Manager Approval: CONSENT CALENDAR Item to be presented by: Paul Brotzman DATE: January 24, 2006 SUBJECT: TRANSFER TITLE OF 24158 SAN FERNANDO ROAD, SANTA CLARITA, CA 91321 APN 2831-019-030 FROM THE CITY OF SANTA CLARITA TO THE SANTA CLARITA REDEVELOPMENT AGENCY DEPARTMENT: Community Development RECOMMENDED ACTION City Council direct staff to execute a grant deed to transfer title of property from the City of Santa Clarita to the Redevelopment Agency. BACKGROUND On August 26, 2005 the City of Santa Clarita purchased the property at 24158 San Fernando Road in Newhall formerly known as Moore's Sandwich Shop. A copy of the fully executed Grant Deed transferring the property to the City of Santa Clarita is attached as Exhibit A. This acquisition is in compliance with the City of Santa Clarita General Plan. Upon further investigation, it has been determined that it would be beneficial to transfer the property to the Redevelopment Agency for the following reasons: 1. An advantage of acquisition of real property by the Agency stems from its broad discretion to aquire real property in furtherance of the goal of mitigating blight in the redevelopment area, per California Health and Safety Code 33035-33037. 2. The Agency has the power to transfer private property to another private person for the purpose of redevelopment and the elimination of blight, per Kelo v. City of New London (2005) 125 S. Ct. 2655, 2661. APPROVED 3. The agency has broad discretion to sell or lease property for purposes of redevelopment that conform with the redevelopment plan, per California Health and Safety Code 33430 ALTERNATIVE ACTIONS City Council may choose to retain the property as currently held.
