HomeMy WebLinkAbout2006-12-12 - RESOLUTIONS - COUNTY LIGHTING DIST WITHDRAW (2)RESOLUTION NO. 06-113 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, APPROVING THE WITHDRAWAL OF TERRITORIES KNOWN AS ANNEXATION NO. 2005-07 (NORTHPARK), ANNEXATION NO. 2002-08 (CALIFORNIA CANYONS), AND ANNEXATION NO. 2002-09A (STONECREST) WHEREAS, on December 20, 2005, the County of Los Angeles Board of Supervisors approved Joint Resolutions with the City of Santa Clarita ("City") for the negotiated exchange of property tax revenue resulting from the annexation of territories known as Annexation No. 2005-07 (NorthPark), Annexation No. 2002-08 (California Canyons), and Annexation No. 2002-09A (Stonecrest) to the City of Santa Clarita, and the detachment of said territories from County Lighting Maintenance District 1687 and County Lighting District LLA -1 ("Districts"), for fiscal years commencing on or after July 1, 2006, or the July 1 after the effective date of this jurisdictional change, whichever is later; and WHEREAS, the Local Agency Formation Commission for Los Angeles County subsequently approved the annexations and issued Certificates of Completion for Boundary Changes of City of Santa Clarita for the annexation projects known as Annexation No. 2005-07 -- (NorthPark), Annexation No. 2002-08 (California Canyons), and Annexation No. 2002-09A (Stonecrest); and WHEREAS, Section 5853 of the California Streets and Highways Code provides that if any portion of a maintenance district formed pursuant to the Improvement Act of 1911, Division 7, of the California Streets and Highways Code, is included within a City by reason of incorporation, annexation, or otherwise such portion shall continue to remain a part of the district until a copy of a resolution adopted by the City is received by the Board of Supervisors; and WHEREAS, Section 22613 of the California Streets and Highways Code provides that whenever any territory of an assessment district is included within a city by annexation or incorporation, that territory is thereby excluded from the assessment district; and WHEREAS, portions of County Lighting Maintenance District 1687 and County Lighting District LLA -1 lie within the territories known as Annexation No. 2C05-07 (NorthPark), Annexation No. 2002-08 (California Canyons), and Annexation No. 2002-09A (Stonecrest) located within the incorporated boundaries of the City of Santa Clanta. NOW, THEREFORE, the City Council of the City of Santa Ciarita does hereby resolve as follows: SECTION 1. The City Council of the City of Santa Clarita requests and consents to the withdrawal of territory known as Annexation No. 2005-07 (NorthPark), Annexation No. 2002-08 (California Canyons), and Annexation No. 2002-09A (Stonecrest) from County Lighting Maintenance District 1687 effective July 1, 2007. SECTION 2. The City Council of the City of Santa Clarita authorizes the Mayor and City Manager to accept the withdrawal on behalf of the City of Santa Clarita and authorize the City Manager to execute all documents necessary to complete the withdrawal of the Districts and execute all documents necessary to include the newly withdrawn territories in the City's annual levy for Streetlight Maintenance District #1, beginning Fiscal Year 2007-2008. SECTION 3. Upon the effective date of the withdrawal of the territories known as Annexation No. 2005-07 (NorthPark), Annexation No. 2002-08 (California Canyons), and Annexation No. 2002-09A (Stonecrest) from County Lighting Maintenance District 1687, such territories shall be added to the City's Streetlight Maintenance District #1. SECTION 4. All street lighting maintenance costs incurred within those portions of County Lighting Maintenance District 1687 located within the boundaries of Annexation No. 2005-07 (NorthPark), Annexation No. 2002-08 (California Canyons), and Annexation No. 2002-09A (Stonecrest) shall be borne by County Lighting Maintenance District 1687 until June 30, 2007, and thereafter by the City of Santa Clarita. SECTION 5. No additional transfer of Special District revenue shall be made to or from any other taxing agency(ies) as a result of this jurisdictional change. SECTION 6. The City Clerk shall certify to the adoption of this Resolution and file copies of this transaction with the State Board of Equalization, the Board of Supervisors of the County of Los Angeles, the Chief Administrative Office, the County Auditor -Controller, and County Assessor.
