HomeMy WebLinkAbout2006-08-22 - RESOLUTIONS - ENTERPRISE ZONE APPLICATION (2)RESOLUTION NO. 06-87 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLAR]TA, CALIFORNIA, FINDING AND DETERMINING THAT A DESIGNATED PORTION OF THE CITY IS A DEPRESSED AREA AND THAT DESIGNATION OF THE AREA AS AN ENTERPRISE ZONE IS NECESSARY TO ATTRACT PRIVATE SECTOR INVESTMENT WHEREAS, on March 20, 1984, the Governor of the State of California signed into law, AB 40, which provided for the creation of State Enterprise Zone; and WHEREAS, in March 2006, the California Housing and Community Development Agency issued guidelines and criteria to all interested parties pertaining to the submission of preliminary applications for consideration and designation of 23 new Enterprise Zones; and WHEREAS, the City of Santa Clarita has made a finding that the application area is a depressed area, a requirement of the Enterprise Zone designation process, which has been confirmed by the State Housing and Community Development Agency; and WHEREAS, the enterprise zone eligible area of the City of Santa Clarita meets the criteria for application by having a population of at least 2,500, and the net increase in per capita income between 1990 and 2004 was 80 percent or less of the statewide average, and the percentage of persons below the poverty level in 2000 was 15.2 percent or more, and the area is within a jurisdiction declared a natural disaster area by the President of the United States within the last seven years; and WHEREAS, it is necessary and essential that the City of Santa Clarita pursue the proposed designation of the above -referenced area as an Enterprise Zone to attract private sector investment to the application area; and WHEREAS, the City of Santa Clarita authorizes and supports job development, job creation, and economic development; and WHEREAS, the City of Santa Clarita authorizes that staffing shall be made available to maintain record-keeping, monthly updates on Zone activities, and to discuss activities with program auditors; and WHEREAS, the City of Santa Clarita shall develop a self-evaluation process to measure its progress in meeting its goals and objectives; and, said process shall be submitted to the Department for review, approval and inclusion in the Memorandum of Understandings (MOU) prior to Final Designation; and WHEREAS, the City of Santa Clarita agrees to complete all actions stated within the application that apply to its jurisdiction should the proposed Enterprise Zone be awarded designation; and WHEREAS, the City Manager is authorized to sign the application, the MOU and other documents necessary for the implementation of the Santa Clarita Enterprise Zone. WHEREAS, it is in the mutual interest of all parties to utilize the Santa Clarita Enterprise Zone incentives to attract new jobs and new wealth to our region. The City of Santa Clarita will support and cooperate in the formation of linkages and agreements that will bring all of the agencies and individuals together in the spirit of operating a successful and progressive Enterprise Zone as authorized by the laws of the State of California; and WHEREAS, the accompanying documents evidence commitment to the successful operation of the Santa Clarita Enterprise Zone and it is reasonable to believe that Santa Clarita will be one of the best administered and successful Enterprise Zone operations in the State of California; and WHEREAS, the City of Santa Clarita hereby authorizes the Enterprise Zone application. NOW, THEREFORE, the City Council of the City of Santa Clarita does hereby resolve as follows: SECTION 1. A finding that the application area is a depressed area, and that designation of the area as an Enterprise Zone is necessary in order to attract private sector investment to the application area; and SECTION 2. The staff allocations and budget for Santa Clarita Enterprise Zone management shall not be reduced from the levels indicated in the application during the period of Zone designation as included in the required Line Item Budget as part of the application and approved herein; and SECTION 3. The Santa Clarita Enterprise Zone Manager will be an employee appointed from the City's Economic Development Division and will be responsible for those duties as outlined in the job description as part of the application and approved herein; and SECTION 4. The Santa Clarita Enterprise Zone management will be budgeted and staffed at a level that will permit compliance with the voucher program requirements of the State and the adopted Vouchering Plan and Vouchering Fee Remittance Plan as part of the application and approved herein; and SECTION 5. The Santa Clarita Enterprise Zone Vouchering Agent will be an employee of the City and will be responsible for ensuring that the vouchering policies and procedures are administered consistent with State Enterprise Zone regulations, and that the Vouchering Agent (Enterprise Zone and non -Enterprise Zone) is free of any conflict of interest with businesses in the Zone in accordance with State regulations; and SECTION 6. Approve the Santa Clarita Enterprise Zone Economic Development Plan, including the Marketing Plan and levels of commitment, as outlined in the application and approved herein; and 2 SECTION T Authorize the submission of the Santa Clarita Enterprise Zone Application to the State of California Department of Housing and Community Development by the required date, as approved herein. SECTION 8 CALIFORNIA ENVIRONMENTAL OUALITY ACT FINDINGS. Based upon the foregoing facts and findings, the City Council hereby finds as follows: a. An Initial Study and a Negative Declaration for this project have been prepared in compliance with the California Environmental Quality Act (CEQA); and b. The Initial Study has been circulated for review and comment by affected governmental agencies and the public, and all comments received, if any, have been considered. The Negative Declaration was posted and advertised on July 19, 2006, in accordance with CEQA. The public review period was open from July 19, 2006 through August 22, 2006; and C. There is no substantial evidence that the project will have a significant effect on the environment. The Negative Declaration reflects the independent judgment of the City of Santa Clarita; and d. The location of the documents and other material which constitutes the record of proceedings upon which the decision of the City Council is the project file within the Community Development Department and is in the custody of the Director of Community Development; and e. The City Council, based upon the findings set forth above, hereby finds that the Negative Declaration for this project has been prepared in compliance with CEQA. SECTION 9 This Resolution shall take effect immediately upon its adoption. SECTION 10. The City Clerk shall certify to the adoption of this Resolution.
