HomeMy WebLinkAbout2007-06-12 - AGENDA REPORTS - BOUQUET VACATE RIGHT OF WAY (2)CONSENT CALENDAR Agenda Item: CITY OF SANTA CLARITA AGENDA REPORT City Manager Approval: Item to be presented by: 13 A WA I / DATE: June 12, 2007 SUBJECT: SUMMARY VACATION OF AN UNUSED 40 -FOOT WIDE ROAD RIGHT-OF-WAY ADJACENT TO BOUQUET CANYON ROAD DEPARTMENT: Public Works RECOMMENDED ACTION City Council adopt a resolution summarily vacating the unused 40 -foot wide right-of-way located in Book 1256 of Official Records, Page 308, within Assessor Parcel No. 2812-008-021 and adjacent to Bouquet Canyon Road; and direct the City Clerk to record the certified original resolution in the office of the Registrar -Recorder of the County of Los Angeles. BACKGROUND Ruth Camargo, the current property owner of Assessor Parcel No. 2812-008-021, is making a second request to vacate the unused 40 -foot wide right-of-way that exists on her property. This right-of-way was originally dedicated by deed to the County of Los Angeles for road purposes on October 23, 1922, in Book 1256 of Official Records, Page 308, within Ms. Camargo's property (Assessor Parcel No. 2812-008-021) and adjacent to Bouquet Canyon Road. Ms. Camargo's original request to vacate the unused 40 -foot wide right-of-way was denied by City Council on June 27, 2006. Staff was directed to make a determination if this vacation would negatively impact future trail alignment in the area. Staff has researched this issue, and has determined that this summary vacation will not affect the proposed future widening and realignment of Bouquet Canyon Road, nor will this action affect the associated future Class II bike trail which will be contained completely within the proposed widening. Per Section 8331 of the Streets and Highways Code, the legislative body of a local agency may summarily vacate a street or highway if both of the following conditions exist: a) For a period of five consecutive years, the street or highway has been impassable for vehicular travel; and b) No public money was expended for maintenance on the street or highway during such period. Both of these conditions exist; therefore City Council may summarily vacate the unused 40 -foot wide right-of-way. Adopted.
