City Council direct staff to continue working with Burrtec Waste Industries Inc. (Burrtec) to continue implementing programs that will increase the City's commercial waste diversion rate. 2. Adopt a resolution for the Sixth Amendment to the Agreement between the City of Santa Clarita and Burrtec Waste Industries, Inc. for Commercial Solid Waste Management Services (Franchise Agreement). This amendment requires Burrtec to begin construction on the Materials Recovery Facility (MRF) no later than January 1, 2009, and have the MRF constructed and operational by November 1, 2009. 3. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval. BACKGROUND Burrtec provides exclusive commercial waste collection services for over 2,500 customers in the City. They provide a variety of containers ranging in size from 90 gallons to six cubic yards and offer free commingled recycling services. Burrtec has a full-time employee trained to visit local businesses and to assist them in establishing recycling programs. Pursuant to Article 7 of the "Agreement between the City of Santa Clarita and Burrtec Waste Industries, Inc. for Commercial Solid Waste Management Services" (Franchise Agreement), the City may hold an annual Solid Waste Services and Performance Review to give the City an opportunity to review collection services. Topics suggested for review include services provided, feasibility of providing new services, application of new technologies, customer complaints, amendments to the agreement, development in the law, new initiatives for meeting or exceeding AB 939's goals, regulatory constraints, and company performance. Staff has compiled information (list attached) for the above categories in order to provide the City Council with detailed information to gauge Burrtec's performance. Aaopiea: L. .07-7i Burrtec has been an effective service provider for solid waste and recycling collection in the City. During 2007, Burrtec provided the following: • They implemented recycling programs to divert food and carpet from landfills • Operated a fleet of nine alternative fueled vehicles • Maintained a website tailored specifically for residents • Provided over 100 hours of litter abatement throughout the community In addition, Burrtec continues to encourage businesses to divert more waste by taking advantage of free recycling services. Since August 2004, Burrtec has increased the number of commercial recycling customers by 93 percent (375 in August of 2004 to 740 in September 2007), and during that same time increased their diversion rate from 19.40 percent to 21.40 percent. Although Burrtec continues to increase diversion, they still fall short of meeting the minimum diversion requirements set forth in the Franchise Agreement. Burrtec has formally requested (letter dated September 27, 2007 attached) that the City waive the $20,000 in current penalties and future quarterly penalties of $10,000 for not meeting the minimum diversion requirements of 25 percent and 50 percent until the MRF is completed Staff recommends not waiving the penalties. The penalties are the main tool used to maintain focus on meeting the minimum diversion requirements for Burrtec and the other solid waste haulers. Staff will continue to work with Burrtec to implement programs that will increase the diversion rate of the City's commercial waste stream. Pursuant to the Franchise Agreement, Burrtec is allowed to prepare and submit a report to the City in preparation of its performance review. The report has been attached for City Council's review. FOR COMMERCIAL SOLID WASTE MANAGEMENT SERVICES WHEREAS, the City of Santa Clarita ("City") is empowered under Section 7 of Article 11 of the California Constitution to make and enforce, within its limits, all police and sanitary ordinances and regulations not in conflict with general laws; and WHEREAS, in partial implementation of Section 7 of Article 11 of the California Constitution, California Public Resources Code Section 40059 authorizes the City to determine all aspects of handling solid waste that is of local concern, including the frequency of collection, means of collection and transportation, level of services and nature, location and extent of waste handling services; and WHEREAS, on November 20, 2003, the City and Burrtec Waste Industries, Inc. entered into that certain "AGREEMENT BETWEEN THE CITY OF SANTA CLARITA AND BURRTEC WASTE INDUSTRIES, INC. FOR COMMERCIAL SOLID WASTE MANAGEMENT SERVICES" (the Agreement); and WHEREAS, On June 10, 2005, the City amended the second sentence of Section 4.2.7 of the Agreement by changing "April 15, 2005" and "February 15, 2006" to read "six months following the date of the hearing set by the Court of Appeal in Santa Clarita Oak Conservancy. et al. v. City of Santa Clarita" and "ten months following the first date," respectively; and WHEREAS, On April 25, 2006, the City amended the second sentence of Section 4.2.7 of the Agreement by changing "six months following the date of the hearing set by the Court of Appeal in Santa Clarita Oak Conservancy. et al. v. City of Santa Clarita" and "ten months following the first date," respectively to read, "Construction of the MRF shall begin no later than January 11, 2007, and it shall be constructed and operational no later than November 11, 2007." WHEREAS, the City and Burrtec desire to amend that certain "AGREEMENT BETWEEN THE CITY OF SANTA CLARITA AND BURRTEC WASTE INDUSTRIES, INC. FOR COMMERCIAL SOLID WASTE MANAGEMENT SERVICES" by changing certain dates and terms relative to the construction of the Materials Recovery Facility (MRF) and give the City Council the authority to change certain dates and terns relative to the construction of the MRF. NOW, THEREFORE, the City Council of the City of Santa Clarita, California, does hereby resolve as follows: SECTION 1. Pursuant to California Public Resources Code Section 40059(a)(1) and Section 7 of Article 11 of the California Constitution that the public health, safety, and well-being require approval of that certain "SIXTH AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF SANTA CLARITA AND BURRTEC WASTE INDUSTRIES, INC. Dawson, CMC City Clerk By Susan Caputo Deputy City Clerk 3 Services Provided by Burrtec Commercial Collection Evaluation Criteria Summary of Actions Per Section 4.2.2 of the Franchise Agreement, Burrtec must provide select load mixed waste processing for at least 50 to 65 percent of all Services - Select the loads they collect. At businesses where there is no recycling, Load Mixed Burrtec selects half of the loads and routes the material for mixed -waste Waste Processing processing. To make this possible, they create separate routes to collect the `cleanest" waste, which is rich in paper and cardboard. This waste is routed to a Materials Recovery Facility (MRF). Between September 2006 and August 2007, Buntec reported that over 50 percent of their loads were segregated as Select Loads, with an average diversion rate of 10.21 percent. In the future, when the City's MRF is in service, Burrtec will have more control over the recovery rate for this program. Services - Street Per Section 4.1.10, Burrtec must provide one collection vehicle and 8 Litter Abatement man-hours per month (96 hours per year) for assistance with litter Program abatement. Since September 2006, Burrtec has conducted 116 hours of litter abatement. Services - Burrtec Per Section 5.3.3, Buntec continues to dedicate a website outlining Website services specifically for their Santa Clarita operations. The website is up-to-date. Per the First Amendment to the Franchise Agreement (Section 4.4.2.13), Services - Burrtec is required to provide collection services with a fleet of Alternative alternative fueled vehicles. All 9 of their trucks use Compressed Fueled Vehicles Natural Gas (CNG). In the next 6 weeks, Burrtec will be adding a tenth CNG collection vehicle to handle the increased demand for recycling. Burrtec voluntarily began a food waste recycling program, although it comes at a greater cost when compared to regular trash disposal. Services - Food Burrtec recruited 65 restaurants and provided them with containers to Waste Recycling source separate their food waste. Burrtec provides technical assistance Program to ensure the restaurants' employees are educated as to how the program works and to limit contamination. If food waste were to be mixed with glass, an entire load could be deemed unacceptable for diversion. The food waste is taken to a transfer station before it is hauled to a composting facility. This program is responsible for diverting an average of 98 tons of food waste per week, which equals approximately 1.4 percent of the City's yearly diversion. Page 1 of 3 Evaluation Criteria Summary of Actions Burrtec voluntarily began a carpet recycling program to address large Services - Carpet quantities of carpet that were being landfilled. Local carpet installers Recycling are invited to drop off their used carpet at Burrtec's yard. When the Program container is full, Burrtec hauls the textiles to be shredded and reused to make new carpet padding. On average, carpet vendors collectively bring an average of ten tons of carpet scrap to Burrtec each week, which totals half of a percent of the City's yearly diversion. Pursuant to the Second Amendment of the Franchise Agreement that updated implementation deadlines for the MRF as outlined in Section Services - Siting 4.2.7, "Construction of the MRF shall begin no later than January 11, and Construction 2007, and the MRF shall be constructed and operational by November of a Materials 11, 2007." Staff is requesting that the City Council approve the Recovery Facility amendment to the Franchise Agreement, requiring Burrtec to begin construction of the MRF no later than January 1, 2009, and have the MRF constructed and operational by November 1, 2009. A new site has been purchased by Burrtec. An application has been submitted to the Planning Division for approval. Staff has been working with Burrtec in the implementation of outreach programs to increase the number of local businesses that recycle. Feasibility of Burrtec regularly attends a variety of outreach functions at the Santa Providing New Clarita Chamber of Commerce. They also distribute service flyers at Services the City's River Rally and Marathon. This past year they began implementing recycling programs based on a comprehensive study of local businesses conducted by the consulting firm HDR & Associates. Burrtec has proposed to implement new innovative technologies in its Application of proposed MRF. The construction has not started, but Burrtec has New identified equipment that will be used to separate commodities. Staff Technologies recommends that the City Council direct Burrtec to continue with their efforts to construct a state-of-the-art MRF. During Burrtec's third year of service, a total of 14 complaints were Customer received by the City. Due to the low amount and type of complaints, Complaints no liquidated damages will be assessed. Burrtec addressed all of the complaints in a timely fashion. During Burrtec's third year of service, the City Council approved and adopted 2 amendments that became the Fourth and Fifth Amendments Amendments to to the Franchise Agreement. The Fourth Amendment extended the Franchise Burrtec's deadline to meet minimum diversion requirements to 25 Agreement percent by January 1, 2007, and 50 percent by September 30, 2007. The Fifth Amendment allowed Burrtec to increase the maximum rate they charge customers by 2.29 percent for their third rate year. Staff will be following the progress of both bills and will determine their impacts to the Franchise Agreement. Overall, Burrtec has been effective in providing services to businesses in the City and has been able to increase the City's diversion. Burrtec has made significant efforts to divert commercial waste, but continues to fall short of the mandated goals. Pursuant to the Franchise Agreement, Burrtec shall pay a penalty of $10,000 for each quarter the minimum diversion requirements have not been met. Burrtec has been fined a total of $20,000 for the first two quarters of 2007. "We'll Take Care Of It" September 27, 2007 Mr. Travis Lange Environmental Services Manager City of Santa Ciarlta 23920 Valencia Blvd Santa Cladta, CA 91355 Dear Travis: Burrtec Waste Industries has worked with City staff and Council on the selection and acquisition of land for the construction of a Materials Recovery Facility (MRF) for the purpose of processing and transferring solid waste generated by Santa Cladta residential and commercial customers. Bunter has faced a number of challenges with the selection of a site. We have subsequently purchased a parcel for the project and have submitted an application to the City as of Tuesday, September 25, 2007 to begin the permitting/review process. Unfortunately, due to site selection delays, the milestone dates that were called out in the contract, and subsequent amendment, regarding construction of the MRF and the operational start-up need to be updated. We respectfully request that the City amend our contract to extend until January 2009 the deadline to permit the MRF and until November 2009 to construct the MRF. We believe that working with the City we can meet these objectives. As you know, the delay in the MRF development has had a ripple effect on the City's solid waste program. Burrtec has been diligent In the implementation of recycling programs aimed at Increasing the City's overall diversion. These programs include commercial recycling at no additional charge, commercial select load processing and food waste programs. These programs have helped increase the City's waste diversion, however, we are averaging approximately 22% diversion, short of achieving the 25% required in our agreement at this time. Our diversion commitment to the City has always been based in part on the design and construction of the Santa Clarita Material Recovery Facility. The challenges previously mentioned have created several setbacks, including our diversion shortfalls. We believe these issues are behind us and we hope to have a facility open for processing by November 2009. While our efforts will not diminish, Burrtec respectfully requests the division penalties in the agreements (commercial bins and roll -off) be waived pending completion of the MRF. Many businesses are taking advantage of the recycling bins offered at no charge giving them equal or greater disposal capacity and the opportunity to reduce costs. Businesses that are not able to recycle at their location may be qualified to participate in the select load program. This program identifies refuse bins filled with dry waste that may be recyclable. These bins are collected separately and sent to a Materials Recovery Facility for processing. These services are geared toward achieving the goals of AB939. At this time our recommendation is to maximize the current programs offered while we continue to await the completion of the Santa Ciarita Materials Recovery Facility. With this facility in operation, new and improved diversion programs will be available that will improve Waste Diversion and Recycling in all areas. SPECIFIC PLAN FOR CHANGED OR NEW SERVICES Annually, throughout the term of this agreement, the City and Burrtec will be reviewing service changes and/or new service programs. This process will assist in evaluating, program efficiencies, industry improvements or discoveries, increased diversion and cost saving procedures. Our plan for this corning year is to achieve the highest level of diversion possible from the current service programs and materials processing. New opportunities will present themselves with the opening of the Material Recovery Facility. Page 6 of 6
