HomeMy WebLinkAbout2007-04-10 - AGENDA REPORTS - EMPLOYEE RETIREMENT SYSTEM (2)Agenda Item: —A CITY OF SANTA CLARITA AGENDA REPORT CONSENT CALENDAR City Manager Approval: 6%", Item to be presented by: Jennifer Curtis DATE: April 10, 2007 SUBJECT: CONTRACT AMENDMENT BETWEEN THE BOARD OF ADMINISTRATION CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM AND THE CITY OF SANTA CLARITA CITY COUNCIL DEPARTMENT: City Manager's Office RECOMMENDED ACTION Adopt a resolution of intention to amend contract between the Board of Administration California Public Employees' Retirement System and the City of Santa Clarita City Council; introduce and pass to second reading an ordinance entitled: "AN ORDINANCE OF THE CITY COUNCIL OF SANTA CLARITA TO APPROVE THE AMENDMENT TO CONTRACT BETWEEN THE BOARD OF ADMINISTRATION CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM AND THE CITY OF SANTA CLARITA." BACKGROUND The Public Employees' Retirement Law permits the participation of public agencies and their employees in the Public Employees' Retirement System (PERS) by the execution of a contract, and sets forth the procedure by which said public agencies may elect to subject themselves and their employees to amendments to said law. One of the steps in the procedures to amend the City's contract with PERS is the adoption by the governing body of the public agency of a resolution giving notice of its intention to approve an amendment to said contract. Following the 1997 PERS Board -approved guidelines, the City submitted a request to PERS in June 14, 2006, to exclude two part-time/temporary/seasonal (PTS) non -career employee groups: Crossing Guards and Interns. The exclusion request was made following PERS clearly defined adopted: » o 1.:r Ordinance passed to Second reading criteria regarding excluded class. The request included an explanation of the groups of employees the City of Santa Clarita sought to exclude, a description of the type of employees who normally fall within the groups, copies of job descriptions, and an explanation as to why the employees in the groups are considered non -career employees. The City also posted a notice of its intent to exclude the Crossing Guards and Interns in break rooms. PERS approved the City's exclusion request on January 29, 2007, , This PERS exclusion only applies to future employees hired as Crossing Guards and Management Interns after the effective date of the contract amendment, July 1, 2007. Any currently employed PTS Crossing Guards or Management Interns will continue to be subject to membership in PERS should the number of hours worked in a fiscal year exceed 1,000. Subsequent to the approval of the resolution of intention, an ordinance must also be adopted at least 20 days after the approval of the resolution in order for the contract amendment to be complete. Therefore, included in this item is the introduction of the necessary ordinance, which is scheduled to be brought to City Council for second reading at the May 8, 2007, regular City Council meeting.
