HomeMy WebLinkAbout2007-01-09 - AGENDA REPORTS - FED ADVOCACY CEMEX (2)CONSENT CALENDAR DATE: SUBJECT: DEPARTMENT: Agenda Item: CITY OF SANTA CLARITA AGENDA REPORT City Manager Approval: Item to be presented by: January 9, 2007 FEDERAL ADVOCACY SERVICES: CEMEX City Manager's Office RECOMMENDED ACTION City Council authorize the City Manager or designee to execute, subject to City Attorney approval, a contract for continuation of professional services with Jamison and Sullivan, Inc. for the period of January 1, 2007 through June 30, 2007. Since February 2001, the City has retained the professional services of Jamison and Sullivan, Inc. for federal advocacy services specifically relating to the CEMEX mining proposal. Jamison and Sullivan, Inc's most recent contract expired on December 31, 2006. The City Council is requested to authorize continuation of professional services with Jamison and Sullivan, Inc. for the period January 1, 2007 through June 30,2007. Jamison and Sullivan's monthly retainer is $7,500, plus reimbursement for reasonable out-of-pocket expenses. The expense portion is anticipated to be a maximum of $2,000. The total maximum for this proposed contract extension is anticipated not to exceed $47,000. Funding is already included in the adopted 2006/07 City budget. The CEMEX mega -mine proposal opposition effort continues to contain a legislative component. During the 109th Congress, Representative Howard P. "Buck" McKeon introduced H.R. 5471. While that measure, having not been acted upon by Congress, died concurrent with the adjournment of the 109th Congress, it has served as the base point for continuing direct negotiations between the City of Santa Clarita and CEMEX. It is currently anticipated that the City and CEMEX may be able to reach agreement on legislative language that could be introduced as a bill during the 110th Congress, which began on January 3, 2007. APPROVED Mr. Cy Jamison, a principal in the firm, has been instrumental in working with representatives of CEMEX as well as making contacts with Members of Congress and appropriate committee staff in working toward development of new legislation. Jamison and Sullivan, Inc. provides federal advocacy services for the City of Santa Clarita exclusively for the proposed CEMEX mining project. ALTERNATIVE ACTIONS 1. Award contract for a period of time other than six months in duration. 2. Not award a contract to Jamison and Sullivan, Inc. and issue a request for proposals for federal advocacy services related to the proposed CEMEX mining project. 3. Other direction as determined by the City Council. FISCAL IMPACT Approval of the recommended action will result in a total maximum expenditure of $47,000, which is already included in the adopted 2006/2007 budget.
