HomeMy WebLinkAbout2007-01-23 - AGENDA REPORTS - FIRE DEVELOPER FEE INCREASE (2)PUBLIC HEARING DATE: SUBJECT: 1110'7:11041351Q16 Agenda Item: / CITY OF SANTA CLARITA AGENDA REPORT City Manager Approval: Item to be presented by: January 23, 2007 DEVELOPER FEE INCREASE FOR FIRE PROTECTION FACILITIES IN ACCORDANCE WITH THE LATEST ADOPTED LOS ANGELES COUNTY DEVELOPER FEE PROGRAM Public Works RECOMMENDED ACTION City Council conduct a public hearing and adopt a resolution to increase Fire District fees from $.3877 per square foot to $.7946 per square foot in accordance with the Developer Fee Agreement between the City of Santa Clarita and the Consolidated Fire Protection District of Los Angeles County. BACKGROUND Fire District development fees pay for the costs associated with land acquisition and construction of fire stations and related fire protection improvements identified in the detailed Fire Station Plan that was approved and adopted by Los Angeles County. In accordance with the City's agreement with the County to be part of the Consolidated Fire Protection District, the City is required to adopt the updated Developer Fee and Fire Station Plan within a reasonable period of time. The proposed fee increase from $.3877 to $.7946 per square foot is consistent with the fee increase adopted by the Los Angeles County Board of Supervisors in November 2006, under their Developer Fee Program. The increased fee amount will ensure the City's Fire District development fees are consistent with the fees collected by Los Angeles County in the unincorporated areas of the Santa Clarita Valley, and will satisfy the requirement to adopt the County's latest fee schedule. Staff has contacted the regional representative from the Building Industry Association (BIA) in reference to the proposed increase. The BIA was involved during the hearings held by the Adopted: RF -so o7-6 County of Los Angeles and understands the need for the fee increase. The BIA is supportive of the Citys position for adopting a fee that is consistent with the rate used in the unincorporated areas of Los Angeles County. ALTERNATIVE ACTIONS There is no alternative action identified by staff. FISCAL IMPACT There is no anticipated fiscal impact to the City as a result of this resolution. Currently there are minor administrative costs for collecting and transmitting fire protection developer fees to the County. These costs should not be affected by the fee increase. ATTACHMENTS Resolution Letter from County of Los Angeles Fire Department CITY OF SANTA CLARITA NOTICE OF PUBLIC HEARING PUBLIC NOTICE IS HEREBY GIVEN: A public hearing will be held before the City Council of the City of Santa Clarita to consider an increase to Developer Fees from $.3877 to $.7946 per square foot of new floor area of buildings for the benefit of the Consolidated Fire Protection District. The proposed fee increase reflects current average costs associated with land acquisition for a fire station site, fire station construction, equipment, and administrative costs associated with fee collection and project and facilities management. In accordance with the City's agreement with the County to be part of the Consolidated Fire Protection District, the City is required to adopt the updated Developer Fee and Fire Station Plan within a reasonable period of time. The proposed fee increase is consistent with the fee increase recently adopted by the Los Angeles County Board of Supervisors. The public hearing will be held by the City Council in the City Hall Council Chambers, 23920 Valencia Blvd., first floor, the 23rd day of January, 2007 at or after 6:00 p.m. Proponents, opponents, and any interested persons may be heard on this matter at this time. This includes the updated Fire Station Plan and Developer Fee amount of $.7946 per square foot of new development in the Santa Clarita Valley Developer Fee Area of Benefit (Area of Benefit 2). The updated Developer Fee amount will become effective February 1, 2007, in the unincorporated areas within Area of Benefit 2. Enclosed is a copy of the approved Resolution adopting the updated fee amount and Fire Station Plan. Pursuant to the Developer Fee Agreement between the District and the City of Santa Clarita (City), subsequent to the Board's adoption of the updated Developer Fee and Fire Station Plan, the City shall adopt the updated Developer Fee and Fire Station Plan "within a reasonable period of time". WHEREAS, without additional fire stations and equipment, there will be insufficient resources to maintain an adequate level of fire protection services in areas of emerging urban expansion in Los Angeles County; and WHEREAS, the Areas of Benefit of the Malibu/Santa Monica Mountains, the Santa Clarita Valley, and the Antelope Valley are emerging urban expansion areas; and WHEREAS, funding of fire protection services to accommodate emerging urban expansion in the Areas of Benefit of the Malibu/Santa Monica Mountains, the Santa Clarita Valley, and the Antelope Valley is Inadequate and will continue to be inadequate without additional funding Sources; and -1- WHEREAS, property tax revenues are not available when needed, as they are generated after development occurs, and are insufficient to fund the development and operation of fire protection facilities to address fire protection service demands in emerging urban expansion areas; and WHEREAS, the Consolidated Fire Protection District of Los Angeles County has prepared the updated Developer Fee Detailed Fire Station Plan dated October 2006, the 2006 Developer Fee Update Fee Calculation Summary, and the Developer Fee Funds 2005-06 Fiscal Year -End Report. that: NOW, THEREFORE, the Board of Supervisors resolves, finds, and determinps 1. The foregoing recitals are true and correct. 2. The Developer Fee Program is for the purpose of generating funds for capital projects necessary to maintain fire protection services within the existing service areas of the Consolidated Fire Protection District of Los Angeles County, and is statutorily exempt per Section 15273 (a)(4) of the California Environmental Quality Act Guidelines developed by the State Office of Planning and Research. 3. On Nvvc--1,;A e4 .2,e , 2006, a public hearing was held to update the Pr Developer Fee ogram and to consider: 1) the updated Developer Fee Detailed Fire Station Plan dated October 2006 (Attachment A) attached hereto and incorporated herein, which serves as the capital Improvement plan and describes the acquisition, construction, installation, and equipping of fire stations; 2) the 2006 Developer Fee Update Fee Calculation Summary (Attachment B) attached hereto and incorporated herein, which imposes a separate fee calculation for each Area of Benefit based upon actual fire station development costs experienced In each of the three areas; and 3) the Developer Fee Funds 2005-06 Fiscal Year -End Report (Attachment C). 4. Based upon the foregoing recitals, the updated Developer Fee Detailed Fire Station Plan dated October 2006, and the 2006 Developer Fee Update Fee Calculation Summary, there are reasonable relationships between: 1) the Developer Fee's use and the type of development projects on which the Developer Fee is imposed; 2) the need for fire station facilities and the type of development project on which the Developer Fee is imposed; and 3) the amount of the Developer Fee and the cost of all or a portion of the fire station facilities attributable to the development on which the Developer Fee is imposed. 5. The Board of Supervisors approves and adopts the updated Developer Fee Program in the Areas of Benefit for the benefit of the Consolidated Fire Protection District of Los Angeles County as follows: a) the updated Developer Fee Detailed Fire -2- Station Plan dated October 2006 Is approved and adopted; b) the 2006 Developer Fee Update Fee Calculation Summary is approved and adopted; c) the Developer Fee Funds 2005-06 Fiscal Year -End Report is approved and adopted; d) the updated Developer Fee amounts per square foot of the new floor areas of buildings of $.7876 in Area of Benefit 1, $.7946 in Area of Benefit 2, and $.7151 in Area of Benefit 3 are approved and shall become effective in the unincorporated areas within the Areas of Benefit on February 1, 2007; and e) all other terms and provisions of the Developer Fee Program as previously adopted by the Board of Supervisors of the County of Los Angeles shall remain unchanged and in full force and effect.
