HomeMy WebLinkAbout2007-10-09 - AGENDA REPORTS - LACO SOLID WASTE ENFORCEMENT (2)CONSENT CALENDAR DATE: SUBJECT: DEPARTMENT: Agenda Item: — CITY OF SANTA CLARITA AGENDA REPORT City Manager Approval: Item to be presented by: October 9, 2007 Travis Lange RESOLUTION DESIGNATING THE COUNTY OF LOS ANGELES DEPARTMENT OF PUBLIC HEALTH AS THE LOCAL ENFORCEMENT AGENCY FOR SOLID WASTE MANAGEMENT Public Works RECOMMENDED ACTION City Council adopt a resolution designating the Los Angeles County Department of Public Health as the City's Local Enforcement Agency (LEA) for solid waste management. BACKGROUND In 1989, the California Integrated Solid Waste Management Act was created by the State legislature. This act requires that all local governing bodies, including cities, designate a Local Enforcement Agency (LEA) for solid waste issues. At that time, the City designated Los Angeles County Department of Health Services (DHS) as our LEA. On April 7, 1992, the Board of Supervisors for the County of Los Angeles designated the Department of Health Services (DHS) as the LEA for solid waste management in the unincorporated areas of the County, and the majority of the incorporated jurisdictions of the County, including the City of Santa Clarita. The cities of Los Angeles, Vernon, and West Covina each created their own LEA by establishing a hearing panel for solid waste permits and appeal purposes. In July 2006, the DHS reorganized and formed the Department of Public Health (DPH). With the reorganization, the responsibilities of the DHS were transferred to the DPH, making it necessary for the City to designate the DPH as the City's Local Enforcement Agency. This item is before the City Council because the name of Los Angeles County's Local Enforcement Agency has changed from the DHS to the DHP, and they have requested that our records be updated to reflect this change. ATTACHMENTS Resolution RESOLUTION NO. 07 - RESOLUTION OF THE SANTA CLARITA CITY COUNCIL TO DESIGNATE THE DEPARTMENT OF PUBLIC HEALTH OF THE COUNTY OF LOS ANGELES AS THE LOCAL ENFORCEMENT AGENCY PURSUANT TO THE CALIFORNIA INTEGRATED WASTE MANAGEMENT ACT OF 1989 WHEREAS, California Public Resources Code Section 43202 provides that there may be designated in each city an enforcement agency to carry out the provisions of the California Integrated Waste Management Act of 1989 (Act), commencing with Section 40000 of the Public Resources Code, Division 30, as it may be amended from time to time; and WHEREAS, pursuant to the Public Resources Code Section 43202(c), the City Council of the City of Santa Clarita may designate a local enforcement agency (LEA) to carry out provisions of the Act in the City of Santa Clarita; and WHEREAS, the County of Los Angeles Department of Public Health possesses the required technical expertise, staff resources, budget resources, and training to carry out the enforcement program mandated by the Act. NOW, THEREFORE, the City Council of the City of Santa Clarita does hereby resolve that pursuant to Public Resources Code 43203(a), the County of Los Angeles Department of Public Health is designated as the Local Enforcement Agency to carry out the provisions of the Act in the City of Santa Clarita.
