HomeMy WebLinkAbout2007-03-13 - AGENDA REPORTS - MUNICODE AMEND PURCHASING (2)CONSENT CALENDAR DATE: SUBJECT: DEPARTMENT: Agenda Item: 0107 CITY OF SANTA CLARITA AGENDA REPORT City Manager Approval: Item to be presented by: March 13, 2007 Jon Bischetsrieder AMEND MUNICIPAL CODE SECTION REGARDING PURCHASING Administrative Services RECOMMENDED ACTION City Council adopt an ordinance entitled, "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, AMENDING CHAPTER 3.12 OF THE SANTA CLARITA MUNICIPAL CODE CONCERNING PURCHASING." BACKGROUND Staff periodically reviews the Municipal Code regarding Purchasing to ensure the Code reflects effective policy and best practices. As a result, two changes are proposed. The first change consists of minor rewording of two paragraphs. The second change deals with the processes for handling unsuccessful or defective bid issues. A review of two Municipal Code paragraphs dealing with the award of bids revealed the need to amend the wording to reflect the standard practice of ensuring low bid awards met minimum standards to protect the public agency. Those two standards are that the bid is responsive and the bidder responsible. This code amendment will ensure responsiveness is included in bid response reviews. There have been recent occasions where, for one reason or another, staff has been unable to select a successful bidder. Under the current Municipal Code provisions, the process must be suspended pending a City Council rejection of the bids. The proposed change identifies specific situations, such as when incomplete bids are received, to authorize the City Manager to reject all bids and rebid or cancel the purchase when deemed to be in the best interest of the City. This change would result in reduced procurement delays for time -sensitive projects. Adopted:o►zt�a✓ ALTERNATIVE ACTIONS Other action as determined by Council. FISCAL IMPACT None.
