BACKGROUND On April 10, 2007, City Council adopted a resolution of intent to form an Open Space Preservation District. The intent of the proposed Open Space Preservation District funding is to accelerate vacant land acquisition in and around the City. Council also adopted a resolution on May 22, 2007, establishing the makeup and responsibilities of a Financial Accountability and Audit Panel for the proposed District. The Resolution of Intention set the public hearing for the July 10, 2007 Council meeting. Assessment ballots were mailed on May 25, 2007, and provided property owners at least 45 days' notice of the public hearing and directions to return their assessment ballots to the City Clerk by this date. Two public information meetings have been held, and two newsletters were mailed to inform the property owners about the Open Space Preservation District. Tonight's recommended action is to hold the public hearing and direct the start of the tally of the ballots. It is anticipated that the counting of the ballots will begin on July 11, 2007 and end on July 13, 2007. Staff expects to have a final vote count certified by Monday, July 16, 2007. To pass, the Open Space Preservation District would need to have 50 percent or more of the returned weighted ballots in favor of the proposed District's formation. Additionally, if the District passes, the Council would need to hold a special meeting to approve the formation of the Open APPROVED -IL(t, Space Preservation District, as the levy for FY 2007-08 must be submitted to the County Assessor prior to Council's return from hiatus. ALTERNATIVE ACTIONS Other action as determined by the City Council. FISCAL IMPACT The formation of the Open Space Preservation District will provide funding for the acquisition of open space. The formation of the Preservation District's boundaries will be co -terminus with the boundaries of the City of Santa Clarita. No significant costs are associated with this public hearing. The total estimated annual Assessment for the entire Preservation District for IY 2007-08: $1,556,098 4. Your proposed annual Assessment: The proposed maximum annual Assessment on your parcel for FY 2007-08 is shown on the assessment ballot (this is based on a single family home having an assessment of $25.00). 5. Duration of the Proposed Assessment The proposed assessment will be levied annually for thirty (30) years. The maximum annual assessment rate will be increased by $1.00 each year. The actual assessments levied in any fiscal year will be as approved by the City Council following a public hearing and may not exceed the maximum assessment rate. If approved, this assessment will be levied beginning in FY 2007-08 and will continue to be levied annually through FY 2036-07. 6. Reason for the Assessment To expand the City's existing Open Space, Park and Parkland Program. These funds can be used to pay for a portion of the costs of acquisition, preservation, improvement, servicing, financing and maintenance of open space lands, parks and parkland, including related debt service costs. It is the City Council's intent to utilize the additional funding to accelerate vacant land acquisition in and around the City. The Proposed Open Space Acquisition Implementation Work Program for the City of Santa Cladta may be found on the City's website at www.santacladtaopenspace.com 7. Calculation of the Assessment: All parcels within the City of Santa Ciarita receive special benefit from the City's Open Space, Park and Parkland Program and will be assessed in proportion to the special benefit they receive. The Open Space Preservation District is proposed to help the City preserve undeveloped land and create a greenbelt and natural parkland buffer of open space in and around the City of Santa C<larita. The Open Space Preservation District funds would be comprised of "restricted furnds95 ---- funds designated by the City Council for the acquisition of open space and parklands and not on other City needs. Lands purchased through the creation of this District will rerrnain in public ownership as preserved open space, trails or parkland, in perpetuity. As a safeguard, the City Council will name a live -member Financial Accountability and Audit panel who will perform an annual audit to assure the funds are directed where they were intended:. Additionally, the City Council will be making all decisions regarding the expenditures of the fends in public meetings, which are televised locally on Channel 20. These public meetings also provide a forum for the public to comment and be heard. SUMMARY OF ASSESSMENT BALLOT PROCEDURES If you are the owner of the property described on the enclosed ballot, or the authorized representative of the record owner, you may submit the enclosed ballot to the City to support or oppose the proposed Open Space Preservation District (the "Preservation District"). Please follow the instructions below to complete and return your ballot. 1. Register your vote on the enclosed ballot in favor of or against the proposed Preservation District by placing an "X" in the appropriate box. 2. Mark, sign and date your ballot in pen.
