HomeMy WebLinkAbout2007-10-23 - AGENDA REPORTS - RATIFYING LOCAL EMERGENCY (2)Agenda Item: CITY OF SANTA CLARITA AGENDA REPORT SUBSEQUENT NEED ITEM City Manager Approval Item to be presented by: Ken Striplin /L DATE: October 23, 2007 SUBJECT: RESOLUTION RATIFYING THE EXISTENCE OF A LOCAL EMERGENCY DEPARTMENT: City Manager's Office RECOMMENDED ACTION City Council adopt a resolution ratifying the existence of a local emergency. BACKGROUND Ordinance No. 89-6 of the City of Santa Clarita empowers the Director of Emergency Services to proclaim the existence, or threatened existence, of a local emergency when said City is affected or likely to be affected by a public calamity. Conditions of extreme peril to the safety of persons and property have arisen within the City caused by severe winds and fire commencing on or about 10:00 a.m. on October 21, 2007. These conditions of extreme peril warranted and necessitated the proclamation of the existence of a local emergency throughout the City. The Director of Emergency Services of the City did proclaim the existence of a local emergency within the City on October 22, 2007. This local emergency shall be deemed to continue to exist until its termination is proclaimed by the City Council. With this declaration, it has now been found that local resources are unable to cope with the effects of said emergency. ALTERNATIVE ACTIONS 1. Decline adoption of Resolution. 2. ATTACHMENTS Resolution Exhibit 2 RESOLUTION PROCLAIMING EXISTENCE OF A LOCAL EMERGENCY* (by Director of Emergency Services)** WHEREAS, Ordinance No. 89-6 of the City of Santa Clarita empowers the Director of Emergency Services** to proclaim the existence or threatened existence of a local emergency when said city is affected or likely to be affected by a public calamity and the City Council is not in session; and WHEREAS, the Director of Emergency Services** of the City of Santa Clarita does hereby find; • That conditions of extreme peril to the safety of persons and property have arisen within said city, caused by; and; (fire, flood, storm, epidemic ot, earthquake, drought, energy shortage, or other causes) • That the City Council of the City of Santa Clarita is not in session (and cannot immediately be called into session); NOW, THEREFORE, IT IS HEREBY PROCLAIMED that a local emergency now exists throughout said city; and IT IS FURTHER PROCLAIMED AND ORDERED that during the existence of said local emergency the powers, functions, and duties of the emergency organization of this city shall be those prescribed by state law, by ordinances, and resolutions of this city, and by the City of Santa Clarita SEMS Multihazard Functional Plan, as approved by the City Council on t G\•` Dated: 1^ �Z/7n By. Section 8630 of the Government Code provides: "...Whenever a local emergency is proclaimed by an official designated by ordinance, the local emergency shall not remain in effect for a period in excess of seven days unless it has been ratified by the governing body..." ** Use appropriate title, as established by ordinance. RESOLUTION NO. 07 - RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, RATIFYING THE EXISTENCE OF A LOCAL EMERGENCY WHEREAS, Ordinance No. 89-6 of the City of Santa Clarita empowers the Director of Emergency Services to proclaim the existence or threatened existence of a local emergency when said City is affected or likely to be affected by a public calamity and the City Council is not in session, subject to ratification by the City Council within seven days; and WHEREAS, conditions of extreme peril to the safety of persons and property have arisen within this city, caused by severe winds and fire on or about 10 a.m. on the 21 st day of October, 2007, at which time the City Council of the City of Santa Clarita was not in session; and WHEREAS, said City Council does hereby find that the aforesaid conditions of extreme peril did warrant and necessitate the proclamation of the existence of a local emergency; and WHEREAS, the Director of Emergency Services of the City of Santa Clarita did proclaim the existence of a local emergency within said City on the 22nd day of October, 2007. NOW, THEREFORE, IT IS HEREBY PROCLAIMED AND ORDERED that a local emergency shall be deemed to continue to exist until its termination is proclaimed by the City Council of the City of Santa Clarita, California. The City Clerk shall certify to the adoption of this Resolution. PASSED, APPROVED, AND ADOPTED this 23rd day of October, 2007.
