City Council approve Tract Map No. 51931 (River Court); 2. Accept on behalf of the public the offers of dedication for public use, the easements for public use and road purposes; the easements for sanitary sewers and sanitary sewer ingress and egress purposes; all sanitary sewers and appurtenant structures; the easements for flood control purposes; the easements for covered storm drain, appurtenant structures, ingress and egress purposes; the right to restrict direct vehicular ingress and egress to Avenue Tibbitts and Avenue Hopkins; all of Lots 14 and 15 in fee simple; the right to restrict or prohibit the erection or construction of any buildings or structures within Lots 8 and 13; the right to restrict or prohibit the erection or construction of any buildings or structures within the flood hazard areas so designated on the map; 3. Make findings as follows: (a) that this project is consistent with the provisions of Sections 66474 and 66474.1 of the Subdivision Map Act and should be approved, and (b) that this proposed subdivision, together with the provisions for this design and improvement, is consistent with the General Plan required by Article 5 (commencing with Section 65300) of Chapter 3 of Division 1 of the Government Code, or any specific plan adopted pursuant to Article 8 (commencing with Section 65450) of Chapter 3 of Division 1 of the Government Code; 4. Instruct the Director of Administrative Services to endorse the Special Assessment Certificate on the face of Tract.Map No. 51.931, which indicates that all special assessments levied by the City have been paid; 5. Instruct the City Clerk to endorse the Certificate on the face of Tract Map No. 51931, which embodies the approval of said map and the acceptance of the dedications shown thereon; and P'OVED] 6. Instruct the City Engineer to endorse the Agreement for Subdivision Improvements, which provides for the manner in which various improvements described on Tract Map No. 51931, and pursuant to the conditions for the final approval of said map for which security has been posted, shall be constructed and completed; and to endorse the Statement on the face of Tract Map No. 51931, which provides for verification of substantial conformance with the Tentative Map and all provisions of local ordinances and state laws applicable at the time of approval. BACKGROUND Tract Map No. 51931 is the seventh and final phase of Vesting Tentative Tract Map No. 51931, which was deemed to be in substantial conformance with the principles and standards required by the Unified Development Code and approved by the City Council on December 18, 1997. The map consisting of approximately 18.3 acres is located along Avenue Tibbitts, southwesterly of Avenue Hopkins. The property is owned by Rivercourt, LLC, a California Limited Liability Company. This map is creating 15 lots (11 commercial/industrial use lots, 2 shared parking use lots, 1 City open space lot, and 1 City river trail lot). Water rights have been secured for all lots. Trail requirements are being met by the construction of a 16 -foot wide public pedestrian/bike path, running the northwesterly edge of the Santa Clara River, within the phase boundaries. The Bridge and Thoroughfare Fee (B&T) totaling $353,395.00 (per Valencia B&T District Fee) has been fully satisfied, as stipulated in the Conditions of Approval. The site is for commercial purposes only and has no Quimby Fee or Transit Mitigation Fee. The conditions set by the City Council have been met and fees have been paid as indicated on the attached Fact Sheet. The map has been checked to the satisfaction of the City Engineer and is ready for City Council approval and acceptance of the dedications. ALTERNATIVE ACTIONS Staff has not identified any alternative actions that would conform to requirements set forth in the Subdivision Map Act. FISCAL IMPACT The one public street shown on the map will be dedicated to the City. The maintenance of this street will have minimal impact on the City's street maintenance budget. The developer is contributing the following amounts for the purposes described (refer to the attached Fact Sheet for details): Bridge and Thoroughfare Fee $353,395.00 (Valencia B&T District Account No. 303-4542.004): Quimby Fee: N/A Transit Mitigation Fee: N/A ATTACHMENTS Fact Sheet Exhibit Map FACTSHEET TRACT MAP NO. 51931 Location: On Avenue Tibbitts, southwesterly of Avenue Hopkins. The B&T Fee totaling $353,395.00 has been fully satisfied, as stipulated in the Conditions of Approval. Transit Fee:. No Transit Mitigation Fee is required for this commercial/industrial development.
