HomeMy WebLinkAbout2007-09-25 - AGENDA REPORTS - TM 62252 FM APPROVAL (2)Agenda Item: CITY OF SANTA CLARITA AGENDA REPORT CONSENT CALENDAR City Manager Approval: Item to be presented by: DATE: September 25, 2007 SUBJECT: TRACT MAP NO. 62252 (RESIDENTIAL CONDOMINIUMS - BENEDA LANE) - APPROVAL OF FINAL MAP AND ACCEPTANCE OF OFFERS OF DEDICATION DEPARTMENT: Public Works RECOMMENDED ACTION 1. City Council approve Tract Map No. 62252 (Residential Condominiums - Beneda Lane); 2. Accept on behalf of the public, the offers of dedication and grant for public use, the right to restrict direct vehicular ingress and egress to Beneda Lane; the easements for public use and road purposes; the easements for sanitary sewers and sanitary sewer ingress and egress purposes; all sanitary sewers and appurtenant structures; the right to restrict or prohibit the erection or construction of any buildings or structures within the flood hazard areas so designated on the map; the right to restrict or prohibit any and all allowable uses, including but not limited to any and/or all development, improvements, grading, plantings or removals, irrigation or construction within those areas designated as open space on the map; Make findings as follows: (a) that this project is consistent with the provisions of Sections 66474 and 66474.1 of the Subdivision Map Act and should be approved, and (b) that this proposed subdivision, together with the provisions for this design and improvement, is consistent with the General Plan required by Article 5 (commencing with Section 65300) of Chapter 3 of Division 1 of the Government Code, or any specific plan adopted pursuant to Article 8 (commencing with Section 65450) of Chapter 3 of Division 1 of the Government Code; 4. Instruct the Director of Administrative Services to endorse the Special Assessment Certificate on the face of Tract Map No. 62252, which indicates that all special assessments levied by the City have been paid; 5. Instruct the City Clerk to endorse the Certificate on the face of Tract Map No. 62252, which embodies the approval of said map and the acceptance of the dedications shown thereon; and APPROVED 6. Instruct the City Engineer to endorse the Agreement for Subdivision Improvements, which provides for the manner in which various improvements described on Tract Map No. 62252, and pursuant to the conditions for the final approval of said map for which security has been posted, shall be constructed and completed; and to endorse the Statement on the face of Tract Map No. 62252, which provides for verification of substantial conformance with the Tentative Map and all provisions of local ordinances and state laws applicable at the time of approval. BACKGROUND Tract Map No. 62252 (Residential Condominiums - Beneda Lane) is the only phase of Tentative Tract Map No. 62252, which was deemed to be in substantial conformance with the principles and standards required by the Unified Development Code and approved by the City Council on June 28, 2005. The map consists of approximately 11.6 acres, is located on the northwesterly side of Beneda Lane at the intersection with Mirror Way, and is owned by WK Beneda 89, LLC, a California Limited Liability Company. This map is a subdivision of Parcels 1 through 4 of Parcel Map No. 13521, and is creating one lot with 34 attached residential condominium units. Water rights have been secured for the lot. Transit Fees were received in the amount of $6,800.00. The Quimby requirement has been satisfied for this lot by the payment of $224,820.00. Bridge and Thoroughfare (B&T) fees totaling $440,640.00 (per Eastside B&T District fees) have been fully satisfied, as stipulated in the Conditions of Approval. The conditions set by the City Council have been met and fees have been paid as indicated on the attached Fact Sheet. The map has been checked to the satisfaction of the City Engineer and is ready for City Council approval and acceptance of the dedications. ALTERNATIVE ACTIONS Staff has not identified any alternative actions that would conform to requirements set forth in the Subdivision Map Act. FISCAL IMPACT The developer is contributing the following amounts for the purposes described (refer to the attached Fact Sheet for details): Bridge and Thoroughfare Fees: $440,640.00 (Eastside District, Account No. 301-4542.001) Transit Mitigation Fee: $6,800.00 Quimby Fee: $224,820.00 ATTACHMENTS Fact Sheet Exhibit Map FACT SHEET TRACT MAP NO. 62252 Location: On the northwesterly side of Beneda Lane at the intersection with Mirror Way.
