SUBJECT: PURCHASE AND INSTALLATION OF EMISSIONS RETROFIT
KITS FOR TRANSIT BUSES BID #TR -06-07-29 — REJECTION OF
ALL BIDS, AND AUTHORIZE STAFF TO RE -ADVERTISE FOR
BIDS

RECOMMENDED ACTION
City Council reject all bids, and direct staff to re -advertise bids for the purchase and installation
of retrofit kits for 36 transit buses, bid No. TR -06-07-29.
BACKGROUND
The California Air Resources Board (CARB) has amended sections of the California Public
Transit Bus Fleet Regulation ARB 1956 to mandate the accelerated reduction of diesel emissions
in public transit bus fleets. As a result, the City is required to reduce toxic air contaminants
known as "diesel particulate matter" or PM by 85%. As a result of a negotiated settlement
agreement with CARB, the deadline for the City to achieve this reduction has been extended to
June 30, 2007.
The retrofit of 36 diesel -powered local and commuter transit buses would bring the City into
compliance with 2009 CARB standards for particulate matter.
On February 1, 2007, the City's Purchasing Division received the following bids for the project:

Staff recommends that all bids be rejected and the City Council authorize the re -advertisement of
the project. This recommendation is based on all bids containing major irregularities, thus
non-responsive.
The major issues identified in the bids received were contingencies, the proposal of technology
not certified by the Air Resources Board at the time of bid submittal, incomplete/or unclear
pricing based on the current fleet mix, and not specifying or providing certification data for the
technology being proposed.
