HomeMy WebLinkAbout2007-04-24 - ORDINANCES - MC 06 107 TOURNEY PLACE (2)AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, APPROVING ZONE CHANGE 06-002 (MASTER CASE 06-107) TO AMEND THE CITY'S ZONING MAP AND CHANGE THE ZONING OF PARCEL 2861-001-105 FROM OPEN SPACE (OS) TO BUSINESS PARK (BP) AND THE ZONING OF PARCEL 2861-061-035 FROM BP AND VISITOR SERVING/RESORT (VSR) TO BP, VSR, AND OS ON THE PROJECT SITE LOCATED ON THE WEST SIDE OF TOURNEY ROAD, 114 MILE SOUTH OF MAGIC MOUNTAIN PARKWAY IN THE CITY OF SANTA CLARITA THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. FINDINGS OF FACT. The City Council does hereby make the following findings of fact: a. On May 17, 2006, an entitlement application was filed by Sapra I, LLC (the "applicanif') with the Community Development Department for Master Case 06-107 on the subject property for the Tourney Place project. The entitlement requests (collectively "Entitlements") included General Plan Amendment 06-002, Zone Change 06-002, Conditional Use Permit 06-008, and Tentative Parcel Map 62297 to develop a 50,814 square -foot, 44'-9" tall office building on the west side of Tourney Road, 1/4mile south of Magic Mountain Parkway in the City of Santa Clarita (the "subject site"). b. Zone Change 06-002 will change the zoning designation of APN 2861-061-035 from Open Space (OS) to Business Park (BP) and of APN 2861-061-035 from BP and VSR to BP, VSR, and OS. The zoning will be consistent with the proposed General Plan classification (see Exhibit A, zone change exhibit). C. A Mitigated Negative Declaration for the Tourney Place project, State Clearinghouse No. 2007011085, has been prepared and circulated in compliance with the California Environmental Quality Act (CEQA). d. On February 20, 2007, the Planning Commission held a duly noticed public hearing on the Tourney Place project entitlements. The Planning Commission voted 4-0 recommending that the City Council adopt the Mitigated Negative Declaration and that the City Council approve the Entitlements, per Resolution No. P07-06. e. At the April 10, 2007 the City Council held a duly noticed public hearing on this issue, commencing at 6:00 p.m. at City Hall, located at 23920 Valencia Boulevard, City of Santa Clarita. f. On April 10, 2007, the City Council adopted a Mitigated Negative Declaration and approved Master Case 06-107 with the associated entitlements for the development of a 3 -story, 44'-9" tall, 50,814 square -foot office building on project site. The Council voted unanimously and passed the ordinance to a second reading on April 24, 2007. g. All public hearings and meetings on the Tourney Road project held by the Planning Commission were at 7:00 p.m. in the City Council Chambers, located at 23920 Valencia Boulevard, City of Santa Clarita. All public hearings and meetings held by the City Council were at 6:00 p.m. in the City Council Chambers, located at 23920 Valencia Boulevard, City of Santa Clarita. All public hearings were advertised in The Signal newspaper and by direct first-class mail to property owners within 1,000 feet of the subject property. In addition, the date and time of the public hearings were posted on the subject site. h. The documents and other materials, which constitute the record of proceedings upon which the decision of the City Council is based, are on file within the Community Development Department and are in the custody of the Director of Community Development. SECTION 2. FINDINGS FOR A ZONE CHANGE. Based on the above findings of fact and recitals and the entire record, including, without limitation, the Mitigated Negative Declaration prepared for the Tourney Road project, oral and written testimony and other evidence received at the public hearings held on the project, reports and other transmittals from City staff to the City Council, and upon studies and investigations made by the Planning Commission and on its behalf, the City Council finds, as follows: a. The proposed change is consistent with the objectives of the City's Unified Development Code, the City's General Plan, and the development policies of the City of Santa Clarita. Following approval of Zone Change 06-002 to the City's Zoning Map, the Tourney Road project is consistent with the zoning designations of Business Park (BP), Visitor Serving/Resort (VSR) and Open Space (OS). Furthermore, Section IX (Land Use) of the Tourney Place Initial Study contains a detailed analysis documenting the project's consistency with the City's Unified Development Code (UDC), the goals and policies of the City's General Plan and the development policies of the City of Santa Clarita. SECTION 3. The City Council approves the request to re -designate the project site and specifically APN 2861-061-035 from Open Space (OS) to Business Park (BP) and APN 2861-061-035 from BP and VSR to BP, VSR, and OS. The zoning will be consistent with the proposed General Plan classification (see Exhibit A, zone change exhibit). SECTION 4. This Ordinance shall be in full force and effect thirty (30) days from its passage and adoption. 2 SECTION 5. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law. PASSED, APPROVED AND ADOPTED this 24th day of April, 2007.
