HomeMy WebLinkAbout2007-05-22 - RESOLUTIONS - OPEN SPACE AUDIT PANEL (2)RESOLUTION NO. 07-31 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, APPROVING THE ESTABLISHMENT OF A CITIZENS' FINANCIAL AND AUDIT COMMITTEE PANEL ON THE PROPOSED OPEN SPACE PRESERVATION DISTRICT WHEREAS, the City Council of the City of Santa Clarita (the "City") is undertaking proceedings pursuant to the provisions of the "Landscaping and Lighting Act of 1972," being Part 2 of Division 15 of the California Streets and Highways Code (commencing with Section 22500) (the "Act") and in accordance with Article 7MID of the California Constitution and the Proposition 218 Omnibus Implementation Act (commencing with Section 53750 of the California Government Code) to form an assessment district (the "District") to be titled the "City of Santa Clarita Open Space Preservation District"; and WHEREAS, it is the desire of the City Council for the proposed District to have a Citizen's Financial Accountability and Audit Panel that will make recommendations to the City Council. NOW, THEREFORE, the City Council of the City of Santa Clarita does hereby resolve as ._ follows: SECTION 1. The membership of the Citizens' Financial Accountability and Audit Panel will be comprised of five (5) members. Each City Councilmember will nominate one (1) member and the panel will be supported by one (1) City staff person as well. SECTION 2. No Panel Member shall have a conflict of interest as provided by the Political Reform Act and regulations of the Fair Political Practices Commission. All Panel members must reside in the City of Santa Clarita. SECTION 3. The Open Space Preservation District Citizens' Financial Accountability and Audit Panel will: a. Review and approve the annual work program to ensure land acquisition priorities are being adhered to. b. Review the accounting of the funds generated by the Preservation District. c. Work in conjunction with the City's independent auditor to ensure that the Preservation District funds were spent properly, and that good fiscal management of the funds is occurring. —.. d. Make determinations as to whether the proposed expenditures are consistent with the criteria and requirements established in the Engineer's report. e. Prepare an annual written report for the public, summarizing Items a—d above. SECTION 4. The Panel will make recommendations to the City of Santa Clarita City Council. SECTION 5. The Financial Accountability and Audit Panel meetings will be open, public, and noticed subject to the Ralph M. Brown Act. SECTION 6. The City Clerk shall certify to the adoption of this Resolution.
