Home My WebLink About2007-06-12 - RESOLUTIONS - SC ENTERPRISE ZONE EIR (2)RESOLUTION NO. 07-46 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, CERTIFYING THE ENTERPRISE ZONE FINAL ENVIRONMENTAL IMPACT REPORT (SCH NO. 2006071050) THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. FINDINGS OF FACT: The City Council does hereby make the following findings of fact: a. On April 14, 2006, the City Council approved the submittal of a Letter of Eligibility to the State of California Housing and Community Development Department identifying three (3) areas in which the City would qualify in seeking a designation of Enterprise Zone. b. On May 2, 2006, the State of California Housing and Community Development Department confirmed that the City of Santa Clarita met the qualifying criteria to apply for Enterprise Zone designation. c. On August 22, 2006, the City Council approved the submittal of the Enterprise Zone application to the State of California Housing and Community Development Department. d. On September 6, 2006, the City submitted a completed Enterprise Zone application to the State of California Housing and Community Development Department. e. On November 3, 2006, the State of California Housing and Community Development Department bestowed a "Conditional' Enterprise Zone designation to the City. f. On December 15, 2006, the City received direction from the State of California Housing and Community Development Department to conduct and complete the Environmental Impact Report (EIR) as a condition to receive final designation of the Enterprise Zone. g. In January 2007, staff prepared an Initial Study, which determined there may be potentially significant environmental impacts with Land Use Planning, thus requiring an Environmental Impact Report (EIR) which would provide the analysis needed to determine those potential impacts. An environmental consultant was subsequently hired to prepare the report. h. On January 18, 2007, staff circulated the Notice of Preparation for the Draft Environmental Impact Report (DEIR). i. On March 28, 2007, the City posted the Notice of Availability and Notice of Completion of the Draft Environmental Impact Report with the Los Angeles County, County Clerk. j. On March 29, 2007, the City circulated the Draft Environmental Impact Report and provided notice of a 45 -day public comment period, which ended on May 12, 2007. The review period was noticed in The Signal Newspaper on March 28, 2007. The Draft Environmental Impact Report was distributed to approximately 50 applicable agencies. k. On May 25, 2007, the City sent the Enterprise Zone Final Environmental Impact Report which included response to comments to all of the applicable agencies. 1. The City Council certified the Enterprise Zone Final Environmental Impact Report on June 12, 2007. SECTION 2. CEOA FINDINGS. The City Council of the City of Santa Clarita does hereby make the following findings of fact: a. CEQA Guidelines 15003(c) and (i) (California Code of Regulations Title 17, Sections 15003(c) and (i)) note that state courts have identified that the purpose of an EIR is to inform other governmental agencies and the public generally of the environmental impacts of a proposed project. CEQA does not require technical perfection or exhaustive treatment of issues in an EIR, but rather adequacy, completeness, and a good -faith effort at full disclosure. A court does not pass upon the correctness of an EIR's environmental conclusions, but only determines if the EIR is sufficient as an informational document. SECTION 3. ENVIRONMENTAL IMPACT FINDINGS REQUIRED BY CEOA: The City Council of the City of Santa Clarita does hereby find that the Enterprise Zone Final Environmental Impact Report discloses that there will be no significant environmental impacts associated with Enterprise Zone and no mitigation is required as a result of the Enterprise Zone. SECTION 4. CERTIFICATION OF THE FINAL EIR: The City Council of the City of Santa Clarita does hereby certify: a. That the Enterprise Zone Final Environmental Impact Report is adequate, complete, and has been prepared in compliance with the California Environmental Quality Act (CEQA). b. That the Enterprise Zone Final Environmental Impact Report was presented to the City Council and the City Council reviewed and considered the information in the Enterprise Zone Final Environmental Impact Report. 2 c. That the Enterprise Zone Final Environmental Impact Report reflects the independent judgment and analysis of the City of Santa Clarita. d. That the documents and other materials which constitute the record of proceedings on which this decision is based are in the custody of the City Clerk and are located at the City of Santa Clarita, 23920 Valencia Blvd., Suite 300, Santa Clarita, California, 91355. SECTION 5. The City Council shall certify to the adoption of this Resolution and certify this record to be a full, complete, and correct copy of the action taken. SECTION 6.
