F3015 - AWARD CONSTRUCTION CONTRACT Public Works RECOMMENDED ACTION 1. City Council approve the plans and specifications and award the construction contract for the Activities Center Improvement, Project No. F3015, to C.J. Tech Construction, Inc. in the amount of $596,000, and authorize a 20 percent contingency in the amount of $119,200: 2. Award various construction support contracts totaling $303,000 for the following: Award the labor compliance consulting services contract to Padilla and Associates in the amount of $8,000; Award consulting service contract to Ron Speed Construction for oversight and overall support for the construction, including management and inspection services in the amount of $60,000; Award the furniture and fixtures to BKM Office Environments for providing and installing all furniture and fixtures for the improved area in the amount of $170,000; Award design support to RTK Architects, Inc. for providing technical design support throughout the construction period in the amount of $65,000; 3. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval. BACKGROUND There is a need to address existing and future space requirements at City Hall. In 2002, the City constructed the Santa Clarita Activities Center located at the southeast corner of Golden Valley Road and Centre Pointe Parkway. The property is located in the central section of the City within the community of Canyon Country. When the Activities Center was constructed, the City's QPP'� ED vision was that the building could also provide for the future recreational and staff needs. This move is a step towards addressing growing space needs by relocating the City's Community Services and Recreation Divisions staff from the first floor of City Hall to the Santa Clarita Activities Center. The improvement at the Santa Clarita Activities Center will buildout the mezzanine,, add 26 additional cubicles, 2 offices, 3 conference rooms, a new ballet room, 4 storage closets, a break room, copy center, and women's and men's restrooms. The City issued a Notice Inviting Bids on November 28, 2007. The project plan holders list consisted of a,total of 36 plan holders. On January 8, 2008, the City's Purchasing Division received 12 bids for the project. The lowest responsive bid was submitted by C'.J. Tech Construction, Inc. in the amount of $596,000. C.J Tech Construction, Inc. possesses a State Contractor's License and is in good standing with the State Contractor's, License Board. While the City maintains a "Support of Local Businesses" policy that can be utilized by the City Council when warranted, the City is governed by the State Public Contract Code with regard to public works project procurement. In these types of procurement, the Public Contract Code does not permit a City to utilize a "Support of Local Businesses" policy and instead requires the contract be awarded to the "lowest responsible bidder." As confirmed by the City Attorney's Office, this direction precludes the City from applying any superseding criteria for award except in -the case of a tie. Thus, in the awarding of Public Works contracts, the City is not permitted to award to the second low bidder just because they are local as the State Public Contract Code does not allow the City to recognize them as the "lowest" responsible bidder. FISCAL IMPACT Sufficient funds to complete the project are appropriated in Expenditure Account No. F3015601-5161.001.
