RECOMMENDED ACTION
1. City Council conduct a public hearing and accept public comment.
2. Adopt a resolution amending the City of Santa Clarita Nondisposal Facility Element.
Direct staff to submit all required documents to the County of Los Angeles and the California
Integrated Waste Management Board.
BACKGROUND
California Public Resources Code Sections 41730-41736 require each city and county to prepare,
adopt, and submit to the California Integrated Waste Management Board (CIWMB) a
Nondisposal Facility Element (NDFE). The NDFE serves as a description of diversion facilities
used by the local jurisdiction to support the diversion programs, implemented or proposed to be
implemented, to reach the diversion mandates of the State of California.
The City of Santa Clarita's (City) NDFE was first adopted by the City Council in April 1994, and
approved by the CIWMB in September 1994. At that time, the City identified the following three
facilities:

As the solid waste industry continues to evolve and new diversion opportunities and challenges
present themselves, it becomes necessary to identify additional diversion facilities that will assist
the City in attaining the diversion requirements set by the state, including the addition of
construction and demolition materials processing centers, greenwaste composting operations, and
curbside recycling facilities.
To that end, staff is proposing that the following facilities be included in the City's NDFE
through Amendment Number One:

The NDFE Amendment Number One also contains updated information regarding the Chiquita
Canyon Greenwaste Composting Facility and adds additional services that are provided by
Community Recycling/Resource Recovery, Inc., beyond their composting operation as identified
in the City's current NDFE.
State law requires the amendment be presented to the Local Task Force for comment. The
Rent -A -Bin facility was presented and approved by the Los Angeles County Solid Waste Task
Force (Task Force) on October 16, 2008. The additional facilities listed on the amendment were
presented to the Task Force for their approval on November 20, 2008. Staff will amend the
NDFE to include those facilities approved by the Task Force. The Task Force's comments on the
approved facilities will be added to Appendix A of the proposed NDFE amendment when they
are made available to the City.
Should the City Council adopt this resolution, staff will submit the NDFE Amendment Number
One to the County of Los Angeles for incorporation into the Countywide Integrated Waste
Management Plan (CIWMP). Additionally, the NDFE Amendment Number One will be
submitted to the CIWMB for their consideration and approval.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA CLARITA, CALIFORNIA,
ADOPTING AMENDMENT NUMBER ONE DATED NOVEMBER 2008 TO THE CITY OF
SANTA CLARITA NONDISPOSAL FACILITY ELEMENT.
WHEREAS, the California Integrated Waste Management Act of 1989, as amended,
requires that each county in California adopt a Nondisposal Facility Element which will become
a part of the Countywide Integrated Waste Management Plan; and
WHEREAS, a draft amendment to the Nondisposal Facility Element has been prepared in
accordance with regulatory requirements; and
WHEREAS, said draft amendment to the Nondisposal Facility Element was submitted to
the Los Angeles County Solid Waste Management Committee/Integrated Waste Management
Task Force for review and comment; and
WHEREAS, on November 25, 2008, the City Council of the City of Santa Clarita held a
duly advertised Public Hearing on Amendment Number One dated November 2008 to the
Nondisposal Facility Element, and the opportunity was given to all persons present to speak; and
WHEREAS, pursuant to Section 41735(a) of the California Public Resources Code, the
adoption of the City's Nondisposal Facility Element is not subject to environmental review under
the California Environmental Quality Act.
NOW, THEREFORE, the City Council of the City of Santa Clarita does hereby resolve as
follows:
SECTION 1. That the City of Santa Clarita City Council has reviewed Amendment
Number One dated November 2008 to the Nondisposal Facility Element.
SECTION 2. That the City of Santa Clarita City Council hereby adopts Amendment
Number One dated November 2008 to the Nondisposal Facility Element.
SECTION 3. The City Clerk shall certify to the adoption of this Resolution..

Nondisposal Facility Plement
California Public Resources Code (PRC), Sections 41730 et seq, require every -California city
and county to prepare and adopt a Nondisposal Facility Element (NDFE) for all new
nondisposal facilities, and any expansions of existing nondisposal facilities,' which will be
needed to implement local Source Reduction and Recycling Elements (SRREs). CaJ.iforaia
Code of Regulations (CC)R), Sections 18752 through 18754.5, require that the NDFE identify
all nondisposal facilities, including existing, expansions of existing, and proposed nondisposal
facilities, which will be used to assist in reaching the diversion mandates of PRC Section
41780. A. Nondisposal facility is defined as any solid waste facility required .to obtain a state
solid waste facility permit except a disposal facility or a transformation facility (PRC Section
40151).
The City of Santa Clarity has prTarod, adopted, and hereby transmits to Los Angeles
County the City',s NDFE, as required by PRC Section 41730. The City as also submitting a
copy of its NDFE to the California Integrated Waste Management Board for review and
approval. The City's NDFE will be appended to the City's SRRE at the -time of the five year
revision.
This NDFE identifies the utilization of a yard waste composting facility, and also identifies
two proposed facilities, a composting facility and a materials recovery facility, as
Nondisposal facilities necessary to implement the City's waste diversion goals. Tables ua
and III, attached, identify the Nondisposal facilities the City may utilize to implement its
SRRE and meet the solid waste diversion requirements of FRC Section 41780.
A draft of this NDFE was submitted to the Los Angeles County Local 'Task Force (L.T'F) in
February 1994 for review and comment regarding the regional impacts fo the nondisposal
facilities indentfled in this Element, in accordance with the requirements of PRC Sections
41734(a) and (b). As indicated by PRC Section 41735(a), the adoption or amendment of this
element is not subject to environmental review under the California Environmental Quality
Act (CEQA).

TYPE OF FACILTT'Y The Community Recycling and Resource Recovery (CRRR)
Composting Facility is a now composting facility which
receives and processes- loads of Fnixed waste, including yard
waste, wood waste and produce waste. The yard waste is
preprocessed in grinding operations that occur at CRRR's
N kms' in Sun Valley. The material will be transferred to the
Composting Facility to be cured in windrows. The facility is
currently operating with a Conditional Use, Permit which
permits acceptance of 250 tpd. The facility does not have a
Solid Waste Facility Permit since it is currently is the
permitting process.
AMOUNT OF WASTE The City has initiated a pilot yard tzimmi.ngs recycling
SENT TO FACILITY Pro,== which began in October 1993 and includes 2,250
'
households in the first of three planned phases. The amount
of green waste being sent to the CRRR Composting Facility
from the City of Santa Cladta in this pilot program is
utavailable at this time. The final. phase of the pilot program
will end in June 1994. At that time, the City will review the
program to better establish a permanent yard trimmings
program.
=ECTED The expected diversion rate for the City is unlmown at this
DIVERSION time. The City is expecting to eventually divert
RATE approximately 17 percent of the wastes generated yearly in
the City of Santa Claxita, based ou information obtained from
the waste generation study performed for the City in 1990. If
a City-wide program is established, the eventual diversion
rate could reach 17 %. The total diversion for the facility will
be at least five percent of the total volume of material
received, as defined for facilities needing a Solid Waste
Facility Permit.

Chiquita Canyon Composting Facility

TYPE OF FACILITY The Chiquita Canyon- Composting Facilty is a proposed new
composting facility at the Chiquita Canyon Landfill which
will receive and process loads of yard waste. The materials
will be shredded and cured in windrows along with
municipal sewage sludge after which it will be run through a
screen to remove oversize fraction. The compost wW then be
stored until it can be distributed to markets. The facitlity will
accept 560 tpd of compostable materials. The facility does
not have a Solid Waste Facility Permit since it is currently in
the permitting process.
AMOUNT OF WASTE
At this time, the amount of yard waste to be sent to the

Clarita is not known. The pilot residential yard trimmings

Resource Recovery Composting Facility. The pilot yard

proposed now materials recovery facility -at the Chiquita
Canyon Landfill which will receive and process loads of

faciUty will accept 500 tpd of source separated zrcyclable
rxraterials. Ile facility does not have a Solid Waste Facility
Permit since it is currently in'the permitting process.
AMOUNT OF WASTE
At this time, the amount of waste to be sent to the Cb iquita

Canyon NMF from the City of Santa Clarita is not known.
The City currently diverts 161 of its residential waste
through its curbside recycling program. The City's
franchised haulers are responsible for the processing and
marketing of the recyclables, using the best economic
resources available. If the Facility is petted., the haulers
will have the option to send material there.

The Faculty is currently in the permitting process, with the

]PUBLIC NOTICE IS HEREBY -GIVEN;
A Public .Bearing will be held before the City Council of the City of Santa Clarita
regarding the adoption of the Nondisposal Facility Element (NDFE).
In 1992, the -California legislature enacted Assembly Bill 3001 (Cortese) which requires
California cities and counties to prepare a Nondisposal Facility Element. A Nondisposal
facility is defined as any solid waste facility required to obtain a state solid waste facility
permit other than a disposal facility or a transformation facility (PRC Section 40151).
The contents of the NDFE are regulated in the California Code of Regulations, Sections
1.8752 through 18754.5, which require that the NDFE identify all existing, expansion of
existing, and proposed solid waste facilities which will be needed to implement local
Source Reduction and Recycling Elements.
The hearing will be held by the City Council of the City of Santa Clarita on the 26th day
of April, 1994, at or after 6:30 p.m., in the City Council Chambers at 23920 Valencia
Blvd., 1st Floor, Santa Clarita, CA 91.355.

WHEREAS, the ' City of Santa Clarita is mandated by the California Integrated Waste
Management Act, AB 439, to reduce its disposal of municipal solid waste into lariditlls 25 % by
the year 1995 and 50% by the year 2000; and .
WHEREAS, the City of Santa Clarita adopted, by Council Action on September 24, 1991, the
Source Reduction and Recycling Element; and
VA-MREAS, the Los Angeles County Local Task Force accepted the Source Reduction and
Recycling Element on Januazy 28,,1991; and
'WUEREAS, the City of Santa Clarita has submitted a copy of the final draft Nondisposal
Facility Element to the Los Angeles County Local Task Force, as mandated by law;

1. Introduction

Upon the receipt of the comments from the Los Angeles County Local Task Force (LTF), the
City Council of the City of Santa Clarita (City) will be presented the facility amendment for
adoption by Resolution.
The City will then transmit the adopted NDFE amendment to Los Angeles County, as required
by PRC, Section 41730. The City will also submit a copy of its NDFE to the California
Integrated Waste Management Board for review and approval.
The adoption or amendment of this element is not subject to environmental review under the
California Environmental Quality Act (CEQA).
II. Summary
The City's NDFE was approved in 1994 and included three facilities, a yard waste composting
facility, and two proposed facilities, a composting facility and a materials recovery facility.
The Chiquita Canyon Composting Facility was constructed and subsequently permitted. Updated
information is included in this amendment. The Chiquita Canyon Materials Recovery Facility
was entitled, but has not been constructed to date. Ergo, the City wishes to keep this facility on
the NDFE. The City also desires to keep the Community Recycling and Resource Recovery
Composting Facility on its NDFE.
Between 1994 and 2008 the waste stream profile of the City has changed significantly and thus
the nature of facilities utilized has changed. In order to continue to implement the City's waste
