PRESERVATION DISTRICT; AND AWARD A PROFESSIONAL SERVICE CONTRACT FOR ANNUAL ENGINEERING AND LEVY SERVICES Administrative Services RECOMMENDED ACTION City Council: 1) Approve the attached resolutions to order Assessment Engineer's reports, and initiate proceedings for the annual levy of assessments for the Landscape Maintenance Districts, Streetlight Maintenance District, Drainage Benefit Assessment Areas, Golden Valley Ranch Open Space Maintenance District, and Open Space Preservation District. 2) Award a contract to Harris & Associates for assessment, engineering, and annual levy services for Drainage Benefit Assessment Areas, Landscape Maintenance Districts, Streetlight Maintenance District, Golden Valley Ranch Open Space Maintenance District, Open Space Preservation District, and Stormwater Utility fee, in an annual amount not to exceed $95,000; authorize the City Manager or designee to execute up to two annual renewal options not to exceed $95,000 each, contingent upon the appropriation of funds by the City Council in the annual budget for such Fiscal Year; and authorize the City Manager or key. 09-N I ij , L"o , O k-L(q Adopted: designee to execute all contracts and associated documents, and execute renewals, in accordance with the terms provided herein, subject to City Attorney approval. BACKGROUND Consolidation of the City's five special districts into one office in 2006 created efficiencies, including the consolidation of the number of City Council actions needed to approve annual levies. This year, the requirement to levy properties for the Stormwater Utility fee moved to the Administrative Services Department. Stormwater operations will remain in the Public Works Department. Staff recommends entering into a new contract with Harris & Associates, the City's special districts assessment engineering contractor, to include Stormwater Utility fees levy services. The new contract will replace the existing Harris & Associates Contract Number 08-00050. Adopting the attached resolutions orders Harris & Associates to prepare the annual engineer's reports for the districts listed below and sets in motion actions necessary to levy properties that receive a special benefit. 1) City of Santa Clarita Drainage Benefit Assessment Areas Nos. 3, 6, 18, 19, 20, 22, and 2008-1 2) City of Santa Clarita Landscape Maintenance Assessment Districts Nos. 1, A-2, and T-1 3) City of Santa Clarita Streetlight Maintenance District No. 1 4) Golden Valley Ranch Open Space Maintenance District 5) Open Space Preservation District This action, and future sequence of actions, are required by the Landscaping and Lighting Acts of 1972, the Benefit Assessment Act of 1982, and Article XIID of the California Constitution (Proposition 218) and allows the City to levy assessments for FY 2008-2009. The requirements to levy properties for Stormwater Utility fees falls under Chapter 3.32 of the Santa Clarita Municipal Code and California Government Code Sections 6062(a) and 66016. The annual assessment engineer's reports for the above listed special districts will be presented to the Council at their May 27, 2008 meeting. If approved, a public hearing will be held on June 10, 2008 regarding the proposed levies on properties located within the boundaries of the five special districts and the Citywide Stormwater Utility and Site Specific fees. A brief description of the five special districts and Stormwater program is listed below. SPECIAL DISTRICTS Drainage Benefit Assessment Areas (DBAA) There are seven separate DBAAs administered by the City. Each has the primary purpose of preventing groundwater from rising to a point where property damage could occur, and/or channeling surface and sub -surface water to drainage areas. Combined, the DBAAs are equipped with 4 pump stations, 5 flow meters, 22 hydraugers, 38 observation wells, and various surfaces and sub -drainage systems. Landscape Maintenance Assessment District (LMD) The Landscape Maintenance Districts (LMD) are comprised of three districts, and within these districts are 35 zones. The City administrates the LMD, and through contracts, provides landscaping services that benefit properties within these zones. These zones consist of approximately 700 acres of landscape areas, including street medians, parkways, side panels, monuments, 3 parks, 20 miles of paseos, and 30,000 trees. Streetlight Maintenance District No. 1 (SMD) The City administers the Streetlight Maintenance District (SMD). Within the SMD, there are approximately 46,000 parcels and approximately 15,000 streetlights. Southern California Edison owns 96% of the streetlights, and the City owns the remaining 4%. City -owned streetlights are attached to traffic signals for the purpose of illuminating intersections while the Edison -owned streetlights stand alone to illuminate roadways. The SMD was established to collect funds to pay for streetlighting energy expenses and the maintenance of the City -owned streetlights. Golden Valley Ranch Open Space Maintenance District (GVROSMD) As a condition of developmental approval, open space within the Golden Valley Ranch development was set aside, and the Golden Valley Ranch Open Space Maintenance District (GVROSMD) was created. The district is comprised of 900 plus acres of natural, undeveloped land, which is administered by the City through contracts for park ranger services. Open Space Preservation District (OSPD) The creation of an Open Space Preservation District (OSPD) was approved by Santa Clarita property owners in July 2007. Its primary objective is to purchase land the City Council determines is valuable and/or strategic to preserving existing open spaces in the Santa Clarita Valley. Stormwater Utility Stormwater Utility reduces pollutants from stormwater and urban runoff water within the City limits in compliance with the National Pollutant Discharge Elimination System (NPDES) municipal permit. The objective of the permit is to protect the environment and improve overall water quality. The Stormwater Utility fee is charged to all properties in the City. In addition, six site-specific areas are levied an additional fee, because they receive an increased level of service. ALTERNATIVE ACTION Other direction as determined by City Council. FISCAL IMPACT Funds for these expenditures have been appropriated to the base budgets for Landscape Maintenance Districts, Drainage Benefit Assessment Areas, Streetlight Maintenance District, Golden Valley Ranch Open Space Maintenance District, Open Space Preservation District, and Stormwater Utility. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA INITIATING PROCEEDINGS FOR THE LEVY AND COLLECTION OF ASSESSMENTS FOR ALL ZONES WITHIN LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT NOS. 1, A-2, AND T-1 FOR FISCAL YEAR 2008/09 WHEREAS, the City Council of Santa Clarita, California, pursuant to the provisions of the Landscaping and Lighting Act of 1972, being Division 15 of the Streets and Highways Code of the State of California (the "Act"), desires to initiate proceedings for Santa Clarita Landscape Maintenance District Nos. 1, A-2, and T-1 and Zone Nos. 1, 2, 3, 4, 5, 6, 7, 8, 15, 16, 17, 18, 19, 20, 2008-1, Tl, T2, T3, T4, T5, T6, T7, T8, T17, T23, T23A, T23B, T29, T31, T42A, T4213, T42C, T46, T47 and T52 (the "Districts") and for the levy and collection of assessments within the proposed Districts for Fiscal Year 2008/09, for the purposes provided therefore in the Act; and, WHEREAS, the City Council has retained Harris & Associates, for the purpose of assisting with the Annual Levy of the Districts, and to prepare and file a report with the City Clerk in accordance with the Act. NOW, THEREFORE, the City Council of the City of Santa Clarita does hereby resolve as follows: SECTION 1; Annual Levy Report: The City Council hereby orders Harris & Associates acting as Assessment Engineer, to prepare and file with the City Clerk the Assessment Engineer's Annual Levy Report concerning the installation, construction, or maintenance, of any authorized improvements under the Act, and the levy and collection of assessments for the District as required by the provisions of the Assessment Law SECTION 2. District Improvements: The installation, construction or maintenance of any authorized improvements under the Act, including, but not limited to landscape and irrigation improvements and any facilities which are appurtenant to any of the aforementioned or which are necessary or convenient for the maintenance or servicing thereof.
