City Council approve the plans and specifications for the 2007-08 Annual Overlay and Slurry Seal Program, Project M0055, and award the construction contract to Sylvia Construction in an amount not to exceed $6,860,244. 2. Award the construction management and material testing services contract to Pavement Engineering Incorporated in an amount not to exceed $300,000. 3. Authorize a one-time increase not to exceed $20,000 to the Labor Compliance Services existing professional services contract. 4. Authorize the use of Proposition 113 (Transportation Bond) Local Streets and Roads account funds in the amount of $2,849,466 upon allocation by the State of California Department of Finance. 5. Decrease Expenditure Account M0055260-5161.001 (Prop C) by $1,800,000 and increase Expenditure Account M0055233-5161.001 (TDA Article 8) by $1,800,000. 6. Decrease Expenditure Account M0055601-5161.001 (General Fund Capital) by $2,950,056 and decrease Expenditure Account M0052601-5161.001 (General Fund Capital) by $49,466. Increase Expenditure Account M0055230-5161.001 (Prop 1 B) by $1,325,804 and increase Expenditure Account M0055233-5161.001 (TDA Article 8) by $1,673,718. 7. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval. APPROVEN BACKGROUND The Annual Overlay and Slurry Seal project is an integral part of the City's pavement management program. Each year, streets are evaluated and identified for the need for asphalt overlay and slurry seal maintenance treatments. The overlay portion of the project will resurface streets in various areas of the City (see attached list of streets). This will provide a smoother ride for traffic, enhance the appearance of the roadway and surrounding area, and extend the life of the roadway a minimum of 15 years. Slurry seal involves the surface preparation and application of emulsion slurry seal to seal cracks, enhance skid -resistance properties, and increase pavement life by a minimum of 7 years. The streets to be included in this program are located throughout the City. This year's project is expected to begin construction mid-June 2008, and the completion date is projected for the end of September 2008. Construction is estimated to be complete in 75 working days from the start of the project. To ensure efficient and proper procedures in construction and material testing, additional inspectors may from time to time need to be assigned to the project. Costs for construction inspection services and material testing were anticipated and identified in the original budget. Staff recommends adding construction inspection and material testing services for this project to the contract with Pavement Engineering in an amount not to exceed $300,000. Pavement Engineering has extensive experience in construction management and inspection and will be responsible for the material testing and inspection of the project. Funds to address the City's overlay and slurry program were previously identified as indicated in the Fiscal Impact section below. The recommended changes in funding sources are intended to make better use of funding sources that have become available and offer greater program flexibility. On May 12, 2008, the City's Purchasing Division received the following bids for the project: Company Silvia Construction Security Paving Co., Inc. Nye & Nelson, Inc. Palp Inc., Excel Paving Co. The lowest bid was submitted by Sylvia Construction in the amount of $5,373,726.49. After reviewing the bid summary, staff verified the apparent low bidder's contractor's license, surety companies, and project references. As part of the annual street maintenance project, the City also updates the Pavement Management System with any additional streets that need to be added to show the increase in maintained lane miles within the City. Streets accepted by the City in 2008 have added 17 -lane miles to the system. The City is now responsible for the maintenance of a total of 950 -lane miles. Staff plans to use Proposition 1 B (Transportation Bond) Local Streets and Roads account funds for the overlay project only after hinds are allocated by the State of California Department of Finance.
