TO PREPARE AN EIR FOR THE BURRTEC MATERIALS RECOVERY FACILITYAND TRANSFER STATION PROJECT DEPARTMENT: Community Development RECOMMENDED ACTION City Council authorize the City Manager or designee to enter into a professional services agreement between the City and Land Design Consultants, Inc. to prepare an Environmental Impact Report (EIR) for the Burrtec Materials Recovery Facility project, for a total contract amount not to exceed $385,000, subject to City Attorney approval. EIR preparation costs will be borne by the applicant. BACKGROUND City staff is recommending Land Design Consultants, Inc. to prepare an EIR for the proposed Burrtec Materials Recovery Facility (MRF) and Transfer Station project located west of SR14, east of Sierra Highway between Placenta Canyon Road and Golden Valley Road (APN 2842-004-020 & 027, 2842-002-028). The northern portion of the project site has a General Plan and Zoning designation of RL (Residential Low). The southern portion of the project site has a General Plan and Zoning designation of BP (Business Park). The applicant is requesting to change the General Plan and Zoning designation of the entire project site to IC (Industrial Commercial). The project site consists of three parcels totaling 75.11 acres. The project would be developed in two phases. Phase I of the project facility would be developed with an 80,000 square foot MRF building and a 40,000 square foot Waste Transfer Station, a 6,000 square foot administration building attached to the north side of the MRF and a 6,000 square foot maintenance facility immediately north of the main facility. Phase II of the project would allow for the addition of up to 40,000 square feet of floor area to the Transfer Station. Section 4.2.8 of the current franchise agreement between the City and the commercial waste hauler requires that Burrtec construct a MRF. The franchise agreement also requires that a Transfer Station, including a tipping and load -out area, be included as part of the MRF. The tipping and load -out area is an integral component of a Materials Recovery Facility and allows waste collectors to maximize their diversion and minimize their disposal and transportation costs. Land Design Consultants was the highest rated firm of the two firms interviewed by City staff for the preparation of the EIR. The cost for preparing the document is $385,000. This includes a 20% contingency fee, which will provide a buffer in the event of unexpected costs. The money will be deposited into an account and this amount will cover all costs associated with the Environmental Impact Report (EIR). ALTERNATIVE ACTIONS 1. Not approve the contract with Land Design Consultants and direct staff to send out a second RFP to select an alternate consulting firm for the preparation of the EIR. 2. Other action as determined by the Council. FISCAL IMPACT The cost of EIR preparation will be borne solely by the applicant (Burrtec Waste Industries, Inc.). The money received by Burrtec will be deposited into a Fund 102 Trust Account and this amount will cover all costs associated with the Environmental Impact Report (EIR). Authorization to proceed with the EIR does not create a fiscal impact to the City's budget. Contract # 07-00464 This AGREEMENT is entered into this 8th day of January, 2008, by and between the CITY OF SANTA CLARITA, a municipal corporation and general law city ("CITY") and Land Design Consultants, Inc., ("CONSULTANT"). 1. CONSIDERATION. A. As partial consideration, CONSULTANT agrees to perform the work listed in the SCOPE OF SERVICES, below; B. As additional consideration, CONSULTANT and CITY agree to abide by the terms and conditions contained in this Agreement; C. As additional consideration, CITY agrees to pay CONSULTANT a sum not to exceed three hundred eighty-five thousand dollars ($385,000.00) for CONSULTANT's services. CITY may modify this amount as set forth below. Unless otherwise specified by written amendment to this Agreement, CITY will pay this sum as specified in the attached Exhibit "A," which is incorporated by reference. 2. SCOPE OF SERVICES. A.. CONSULTANT will perform services listed in the attached Exhibit "A," which is incorporated by reference. B. CONSULTANT will, in a professional manner, furnish all of the labor, technical, administrative, professional and other personnel, all supplies and materials, equipment, printing, vehicles, transportation, office space and facilities, and all tests, testing and analyses, calculation, and all other means whatsoever, except as herein otherwise expressly specified to be furnished by CITY, necessary or proper to perform and complete the work and provide the professional services required of CONSULTANT by this Agreement. 3. .PERFORMANCE STANDARDS. While performing this Agreement, CONSULTANT will use the appropriate generally accepted professional standards of practice existing at the time of performance utilized by persons engaged in providing similar services. CITY will continuously monitor CONSULTANT's services. CITY will notify CONSULTANT of any deficiencies and CONSULTANT will have fifteen (15) days after such notification to cure any shortcomings to CITY's satisfaction. Costs associated with curing the deficiencies will be borne by CONSULTANT. 4. PAYMENTS. For CITY to pay CONSULTANT as specified by this Agreement, CONSULTANT must submit a detailed invoice to CITY which lists the hours worked and 7/2006 -1- hourly rates for each personnel category and reimbursable costs (all as set forth in Exhibit "A") the tasks performed, the percentage of the task completed during the billing period, the cumulative percentage completed for each task, the total cost of that work during the preceding billing month and a cumulative cash flow curve showing projected and actual expenditures versus time to date. 5. NON -APPROPRIATION OF FUNDS. Payments due and payable to CONSULTANT for current services are within the current budget and within an available, unexhausted and unencumbered appropriation of the CITY. In the event the CITY has not appropriated sufficient funds for payment of CONSULTANT services beyond the current fiscal year, this Agreement will cover only those costs incurred up to the conclusion of the current fiscal year. 6. ADDITIONAL WORK. A. If CONSULTANT believes Additional Work is needed to complete the Scope of Work, CONSULTANT will provide the CITY with written notification that contains a specific description of the proposed Additional Work, reasons for such Additional Work, and a detailed proposal regarding cost. 7. FAMILIARITY WITH WORK. A. By executing this Agreement, CONSULTANT agrees that it has: Carefully investigated and considered the scope of services to be performed; ii. Carefully considered how the services should be performed; and iii. Understands the facilities, difficulties, and restrictions attending performance of the services under this Agreement. B. If services involve work upon any site, CONSULTANT agrees that CONSULTANT has or will investigate the site and is or will be fully acquainted with the conditions there existing, before commencing the services hereunder. Should CONSULTANT discover any latent or unknown conditions that may materially affect the performance of the services, CONSULTANT will immediately inform CITY of such fact and will not proceed except at CONSULTANT's own risk until written instructions are received from CITY. 8. TERM. The term of this Agreement will be from January 8, 2008 to December 31, 2012. Unless otherwise determined by written amendment between the parties, this Agreement will terminate in the following instances: A. Completion of the work specified in Exhibit "A"; B. Termination as stated in Section 15. 9. TIME FOR PERFORMANCE. 7/2006 -2- A. CONSULTANT will not perform any work under this Agreement until: CONSULTANT furnishes proof of insurance as required under Section 22 of this Agreement; and ii. CITY gives CONSULTANT a written notice to proceed. B. Should CONSULTANT begin work on any phase in advance of receiving written authorization to proceed, any such professional services are at CONSULTANT's own risk. 10. TIME EXTENSIONS. Should CONSULTANT be delayed by causes beyond CONSULTANT's control, CITY may grant a time extension for the completion of the contracted services. If delay occurs, CONSULTANT must notify the Manager within forty-eight hours (48 hours), in writing, of the cause and the extent of the delay and how such delay interferes with the Agreement's schedule. The Manager will extend the completion time, when appropriate, for the completion of the contracted services. 11. CHANGES. CITY may order changes in the services within the general scope of this Agreement, consisting of additions, deletions, or other revisions, and the contract sum and the contract time will be adjusted accordingly. All such changes must be authorized in writing, executed by CONSULTANT and CITY. The cost or credit to CITY resulting from changes in the services will be determined in accordance with written agreement between the parties. 12. TAXPAYER IDENTIFICATION NUMBER. CONSULTANT will provide CITY with a Taxpayer Identification Number. 13. PERMITS AND LICENSES. CONSULTANT, at its sole expense, will obtain and maintain during the term of this Agreement, all necessary permits, licenses, and certificates that may be required in connection with the performance of services under this Agreement. 14. WAIVER. CITY's review or acceptance of, or payment for, work product prepared by CONSULTANT under this Agreement will not be construed to operate as a waiver of any rights CITY may have under this Agreement or of any cause of action arising from CONSULTANT's performance. A waiver by CITY of any breach of any term, covenant, or condition contained in this Agreement will not be deemed to be a waiver of any subsequent breach of the same or any other term, covenant, or condition contained in this Agreement, whether of the same or different character. 15. TERMINATION. A. Except as otherwise provided, CITY may terminate this Agreement at any time with or without cause. B. CONSULTANT may terminate this Agreement at any time with CITY's mutual consent. Notice will be in writing at least thirty (30) days before the effective termination date. 7/2006 -3- C. Upon receiving a termination notice, CONSULTANT will immediately cease performance under this Agreement unless otherwise provided in the termination notice. Except as otherwise provided in the termination notice, any additional work performed by CONSULTANT after receiving a termination notice will be performed at CONSULTANT'S own cost; CITY will not be obligated to compensate CONSULTANT for such work. D. Should termination occur, all finished or unfinished documents, data, studies, surveys, drawings, maps, reports and other materials prepared by CONSULTANT will, at CITY's option, become CITY's property, and CONSULTANT will receive just and equitable compensation for any work satisfactorily completed up to the effective date of notice of termination, not to exceed the total costs under Section 1(C). E. Should the Agreement be terminated pursuant to this Section, CITY may,procure on its own terms services similar to those terminated. F. By executing this document, CONSULTANT waives any and all claims for damages that might otherwise arise from CITY's termination under this Section. 16. OWNERSHIP OF DOCUMENTS. All documents, data, studies, drawings, maps, models, photographs and reports prepared by CONSULTANT under this Agreement are CITY's property. CONSULTANT may retain copies of said documents and materials as desired, but will deliver all original materials to CITY upon CITY's written notice. CITY agrees that use of CONSULTANT's completed work product, for purposes other than identified in this Agreement, or use of incomplete work product, is at CITY's own risk. 17. PUBLICATION OF DOCUMENTS. Except as necessary for performance of service under this Agreement, no copies, sketches, or graphs of materials, including graphic art work, prepared pursuant to this Agreement, will be released by CONSULTANT to any other person or public CITY without CITY's prior written approval. All press releases, including graphic display information to be published in newspapers or magazines, will be approved and distributed solely by CITY, unless otherwise provided by written agreement between the parties. 18. INDEMNIFICATION. CONSULTANT agrees to indemnify and hold CITY harmless from and against any claim, action, damages, costs (including, without limitation, attorney's fees), injuries, or liability, arising out of the performance of this agreement by CONSULTANT. Should CITY be named in any suit, or should any claim be brought against it by suit or otherwise, arising out of performance by CONSULTANT of services rendered pursuant to this Agreement, CONSULTANT will defend CITY (at CITY's request and with counsel satisfactory to CITY) and will indemnify CITY for any judgment rendered against it or any sums paid out in settlement or costs incurred in defense otherwise. 19. ASSIGNABILITY. This Agreement is for CONSULTANT's professional services. CONSULTANT's attempts to assign the benefits or burdens of this Agreement without CITY's written approval are prohibited and will be null and void. 20. INDEPENDENT CONTRACTOR. CITY and CONSULTANT agree that CONSULTANT will act as an independent contractor and will have control of all work and the 7/2006 -4- i manner in which is it performed. CONSULTANT will be free to contract for similar service to be performed for other employers while under contract with CITY. CONSULTANT is not an agent or employee of CITY and is not entitled to participate in any pension plan, insurance, bonus or similar benefits CITY provides for its employees. Any provision in this Agreement that may appear to give CITY the right to direct CONSULTANT as to the details of doing the work or to exercise a measure of control over the work means that CONSULTANT will follow the direction of the CITY as to end results of the work only. 21. AUDIT OF RECORDS. CONSULTANT will maintain full and accurate records with respect to all services and matters covered under this Agreement. CITY will have free access at all reasonable times to such records, and the right to examine and audit the same and to make transcript therefrom, and to inspect all program data, documents, proceedings and activities. CONSULTANT will retain such financial and program service records for at least three (3) years after termination or final payment under this Agreement. 22. INSURANCE. A. Before commencing performance under this Agreement, and at all other times this Agreement is effective, CONSULTANT will procure and maintain the following types of insurance with coverage limits complying, at a minimum, with the limits set forth below: Type of Insurance Limits Commercial general liability: $1,000,000 Professional Liability $1,000,000 Business automobile liability $1,000,000 Workers compensation Statutory requirement B. Commercial general liability insurance will meet or exceed the requirements of ISO -CGL Form No. CG 00 01 11 85 or 88. The amount of insurance set forth above will be a combined single limit per occurrence for bodily injury, personal injury, and property damage for the policy coverage. Liability policies will be endorsed to name CITY, its officials, and employees as "additional insureds" under said insurance coverage and to state that such insurance will be deemed "primary" such that any other insurance that may be carried by CITY will be excess thereto. Such endorsement must be reflected on ISO Form No. CG 20 10 .11 85 or 88, or equivalent. Such insurance will be on an "occurrence," not a "claims made," basis and will not be cancelable or subject to reduction except upon thirty (30) days prior written notice to CITY. C. Professional liability coverage will be on an "occurrence basis" if such coverage is available, or on a "claims made" basis if not available. When coverage is provided on a "claims made basis," CONSULTANT will continue to renew the insurance for a period of three (3) years after this Agreement expires or is terminated. Such insurance will have the same coverage and limits as the policy 7/2006 -5- that was in effect during the term of this Agreement, and will cover CONSULTANT for all claims made by CITY arising out of any errors or omissions of CONSULTANT, or its officers, employees or agents during the time this Agreement was in effect. D. Automobile coverage will be written on ISO Business Auto Coverage Form CA 00 0106 92, including symbol 1 (Any Auto). E. .CONSULTANT will furnish to CITY duly authenticated Certificates of Insurance evidencing maintenance of the insurance required under this Agreement and such other evidence of insurance or copies of policies as may be reasonably required by CITY from time to time. Insurance must be placed with insurers with a current A.M. Best Company Rating equivalent to at least a Rating of "A:VII." F. Should CONSULTANTJor any reason, fail to obtain and maintain the insurance required by , this Agreement, CITY may obtain such coverage at CONSULTANT's expense and deduct the cost of such insurance from payments due to CONSULTANT under this Agreement or terminate pursuant to Section 15. 23, USE OF SUBCONTRACTORS. CONSULTANT must obtain CITY's prior written approval to use any consultants while performing any portion of this Agreement. Such approval must approve of the proposed consultant and the terms of compensation. 24. INCIDENTAL TASKS. CONSULTANT will meet with CITY monthly to provide the status on the project, which will include a schedule update and a short narrative description of progress during the past month for each major task, a description of the work remaining and a description of the work to be done before the next schedule update. 25. NOTICES. In all other instances, notices will be deemed given at the time of actual delivery. Changes may be made in the names or addresses of persons to whom notices are to be given by giving notice in the manner prescribed in this paragraph. 26. CONFLICT OF INTEREST. CONSULTANT will comply with all conflict of interest laws and regulations including, without limitation, CITY's Conflict of Interest Code (on file in the City Clerk's Office). It is incumbent upon the CONSULTANT or CONSULTING FIRM to notify the CITY pursuant to section 25. NOTICES of any staff changes relating to this Agreement. 7/2006 -6- A. In accomplishing the scope of services of this Agreement, all officers, employees and/or agents of CONSULTANT(S), unless as indicated in Subsection B., will be performing a very limited and closely supervised function, and, therefore, unlikely to have a conflict of interest arise. No disclosures are required for any officers, employees, and/or agents of CONSULTANT, except as indicated in Subsection B. Initials of Consultant B. In accomplishing the scope of services of this Agreement, CONSULTANT(S) will be performing a specialized or general service for the CITY, and there is substantial likelihood that the CONSULTANT'S work product will be presented, either written or orally, for the purpose of influencing a governmental decision. As a result, the following CONSULTANT(S) shall be subject to the Disclosure Category "1" of the CITY's Conflict of Interest Code: Christy Cuba, Director of Environmental Services 27. SOLICITATION. CONSULTANT maintains and warrants that it has not employed nor retained any company or person, other than CONSULTANT's bona fide employee, to solicit or secure this Agreement. Further, CONSULTANT warrants that it has not paid nor has it agreed to pay any company or person, other than CONSULTANT's bona fide employee, any fee, commission, percentage, brokerage fee, gift or other consideration contingent upon or resulting from the award or making of this Agreement. Should CONSULTANT breach or violate this warranty, CITY may rescind this Agreement without liability. 28. THIRD PARTY BENEFICIARIES.. This Agreement and every provision herein is generally for the exclusive benefit of CONSULTANT and CITY and not for the benefit of any other party. There will be no incidental or other beneficiaries of any of CONSULTANT's or CITY's obligations under this Agreement. 29. INTERPRETATION. This Agreement was drafted in, and will be construed in accordance with the laws of the State of California, and exclusive venue for any action involving this agreement will be in Los Angeles County. 30. COMPLIANCE WITH LAW. CONSULTANT agrees to comply with all federal, state, and local laws applicable to this Agreement. 31. ENTIRE AGREEMENT. This Agreement, and its Attachments, sets forth the entire understanding of the parties. There are no other understandings, terms or other agreements expressed or implied, oral or written. There is one (Exhibit A ) Attachment(s) to this Agreement. This Agreement will bind and inure to the benefit of the parties to this Agreement and any subsequent successors and assigns. 32. RULES OF CONSTRUCTION. Each Party had the opportunity to independently review this Agreement with legal counsel. Accordingly, this Agreement will be construed simply, as a whole, and in accordance with its fair meaning; it will not be interpreted strictly for or against either Party. 7/2006 -7- 33. SEVERABILITY. If any portion of this Agreement is declared by a court of competent jurisdiction to be invalid or unenforceable, then such portion will be deemed modified to the extent necessary in the opinion of the court to render such portion enforceable and, as so modified, such portion and the balance of this Agreement will continue in full force and effect. 34. AUTHORITY/MODIFICATION. The Parties represent and warrant that all necessary action has been taken by the Parties to authorize the undersigned to execute this Agreement and to engage in the actions described herein. This Agreement may be modified by written amendment. CITY's executive manager, or designee, may execute any such amendment on behalf of CITY. 35. ACCEPTANCE OF FACSIMILE SIGNATURES. The Parties agree that this Agreement, agreements ancillary to this Agreement, and related documents to be entered into in connection with this Agreement will be considered signed when the signature of a party is delivered by facsimile transmission. Such facsimile signature will be treated in all respects as having the same effect as an original signature. 36. CAPTIONS. The captions of the paragraphs of this Agreement are for convenience of reference only and will not affect the interpretation of this Agreement. 37. TIME IS OF ESSENCE. Time is of the essence for each and every provision of this Agreement. 38. FORCE MAJEURE. Should performance of this Agreement be prevented due to fire, flood, explosion, acts of terrorism, war, embargo, government action, civil or military authority, the natural elements, or other similar causes beyond the Parties' reasonable control, then the Agreement will immediately terminate without obligation of either party to the other. 39. STATEMENT OF EXPERIENCE. By executing this Agreement, CONSULTANT represents that it has demonstrated trustworthiness and possesses the quality, fitness and capacity to perform the Agreement in a manner satisfactory to CITY. CONSULTANT represents that its financial resources, surety and insurance experience, service experience, completion ability, personnel, current workload, experience in dealing with private consultants, and experience in dealing with public agencies all suggest that CONSULTANT is capable of performing the proposed contract and has a demonstrated capacity to deal fairly and effectively with and to satisfy a public CITY. 40. PROTECTION OF RESIDENT WORKERS. The City of Santa Clarita actively supports the Immigration and Nationality Act (INA) which includes provisions addressing employment eligibility, employment verification, and nondiscrimination. Under the INA, employers may hire only persons who may legally work in the United States (i.e., citizens and nationals of the U.S.) and aliens authorized to work in the U.S. The employer must verify the identity and employment eligibility of anyone to be hired, which includes completing the Employment Eligibility Verification Form (I-9). The Contractor shall establish appropriate procedures and controls so no services or products under the Contract Documents will be performed or manufactured by any worker who is not legally eligible to perform such services or employment. Drams City of Santa Clanta Burrtec Materials Recovery Facility EIR Proposal 1.0 INTRODUCTION ' Land Design Consultants, Inc. is pleased to submit this proposal outlining our approach to prepare an Environmental Impact Report (EIR) for the Burrtec Materials Recovery Facility. 1 As indicated in the information you have provided for our review, the project site is located immediately east of Sierra Highway and west of Highway 14. The project site consists of ' three parcels totaling 62.23 acres and is currently vacant. The proposed project will consist of a 160,000 square -foot materials recovery facility (MRF) and transfer station to process and transfer up to 2,000 tons per day of municipal solid waste, recyclable materials, green ' waste, and construction/demolition waste. The MRF facility will be a fully enclosed structure with a total floor area of 80,000 square feet occupying the north half of the MRF/transfer ' building. The applicant proposes to develop the waste transfer station in two phases. Phase I will consist of a 40,000 square foot building attached to the south side of the MRF ' building. Phase II will consist of the construction of up to 40,000 square feet of additional floor area. A total of approximately 88 to 106 employees are anticipated to be employed at the facility. This proposal presents our understanding of the project and the proposed approach for 1 preparing a thorough and legally defensible EIR in a timely and cost efficient manner. A .detailed Scope of Work and Cost Estimate are provided for your review, along with a ' preliminary schedule. The staffing plan included with our proposal shows the level of effort we propose for the preparation of the EIR and associated documents. ' The proposal presented below has been organized into major tasks as defined by the City's RFP for this project. This scope of work provides for the preparation of an EIR that will be in full compliance with the State CEQA Guidelines, as amended, and the City of Santa Clarita Environmental Guidelines. 1 ' December 13, 2007 2 Land Design Consultants, Inc. City of Santa Clarita Burrtec Materials Recovery Facility EIR Proposal 2.0 SCOPE OF WORK This Scope of Work has been prepared based on Land Design Consultants' (LDC) staff's familiarity with the CEQA process and our firm's substantial collective experience on projects in the Santa Clarita Valley. As a team, our planners, biologists and graphics designers work together to analyze the direct and indirect impacts of development projects on various natural resources and existing public services, assess the level of impacts, and assign feasible and programmable mitigation measures where required. LDC has prepared a Scope of Work that reflects the direction and expectations outlined in the City's RFP. The Scope of Work presented below has been organized into major tasks, subtasks, and outputs. ' We understand that the applicant (Burrtec) will be supplying all of the technical reports required for the EIR. These reports include, but may not be limited to the following: Phase I ' Environmental Site Assessment; Biological Technical Report; ACOE/CDFG Jurisdictional Delineation Report; Geotechnical Report; Oak Tree Report; Visual Simulations; Hydrology/Drainage Study; Traffic Report; Air Quality Report; Noise Study, and; a Cultural & ' Paleontological Study. At the City's direction, Impact Sciences will prepare the Water �1 Supply Assessment and the Water Resources section (supply & quality) for the EIR. . Comprehensive documents for each of the aforementioned disciplines must be prepared to fully address the project applicant's proposal and to provide a technically sound and legally adequate EIR. Each of those technical documents should also include comprehensive alternatives analysis and cumulative projects analysis for inclusion in the EIR. LDC shall coordinate with the Subconsultants at the City's request to ensure that they all receive an outline of the minimum items required in their respective reports for CEQA compliance. LDC shall perform peer review of all outside consultant's reports for the EIR. If additional information is required, a request shall be made to the City Planner for relay to the Applicant, Burrtec Waste Management. TASK 1 — PROJECT INITIATION & ORIENTATION MEETING LDC's Director of Environmental Services and the lead Project Planner will attend one project orientation meeting with City staff. LDC's project team will then catalog and review all project material supplied by the City and the applicant. This will constitute the beginning of the administrative record for the EIR. The first EIR Status Report will be generated to reflect the status of the technical reports at the time of the kick-off meeting. ' December 13, 2007 3 Land Design Consultants, Inc. 1 C 1 11 City of Santa Clanta Burrtec Materials Recovery Facility EIR Proposal OUTPUT: Attendance at one (1) project initiation and orientation meeting; Production of the initial EIR Status Report. TASK 2 — NOTICE OF PREPARATION City staff shall prepare a draft of the Notice of Preparation (NOP). At the City's request, LDC shall review and comment on the content of the NOP. The City will finalize, produce and circulate the NOP for public review. OUTPUT: Public circulation of the NOP. TASK 3 - SCOPING MEETING LDC's lead Project Planner and an associate Planner will attend one EIR scoping meeting during the circulation of the project's Notice of Preparation. City staff will prepare materials and manage the scoping meeting. OUTPUT: Attendance at one (1) Scoping Meeting. TASK 4 — PREPARATION OF THE PRELIMINARY DRAFT EIR This section of the Scope of Work presents the subject areas to be addressed, the type of technical analysis to be used for each subject, and the known issues associated with each environmental subject. For each subject section we will fully document existing conditions and thresholds of significance, analyze individual and cumulative project impacts, and devise mitigation measures as needed to reduce any potentially significant impacts to less than significant levels. Those impacts that are not significant prior to mitigation will be clearly identified, along with the rationale for the finding. SUBTASK 4.1 — INTRODUCTION A brief introduction to the EIR will be prepared to describe to the reader the purpose of the EIR and its role in the City of Santa Clarita's planning process. This introduction will include a discussion of the intent of CEQA, the nature of the proposed project, the EIR preparation and review process, and the organization and content of the EIR. We propose to address cumulative impacts within sections on each environmental subject. OUTPUT: One (1) Introduction section. ' December 13, 2007 4 Land Design Consultants, Inc. IDc City of Santa Clarita Burrtec Materials Recovery Facility EIR Proposal SUBTASK 4.2 — EXECUTIVE SUMMARY The executive summary will provide the reader an opportunity to review a description of the ' proposed project details, the conclusions of the impact analyses, findings with regard to alternatives, and the mitigation measures recommended in the EIR. The summary will ' consist of introductory text and a summary table in .matrix format. The matrix table will include a summary of each environmental subject's impacts, significance prior to mitigation, ' list of applicable mitigation measures, implementation schedule, and significance after mitigation. The summary will also include a discussion of the impacts found to be less than significant prior to mitigation (if any), mitigation measures that were determined not to be ' applicable, and the unavoidable significant impacts anticipated from implementation of the project. A separate table will be compiled that will summarize the comparative impacts of ' the project alternatives that are examined in the EIR. The summary section will culminate with a description of issues to be resolved. OUTPUT: One (1) Executive Summary Section with Impact & Alternative Matrices ' SUBTASK 4.3 — PROJECT DESCRIPTION The Project Description forms the basis of the environmental analysis. Therefore, an accurate and detailed Project Description must be completed at the outset of any environmental review process to ensure the ultimate completeness and legality of the EIR. The same description should be used as the basis for all of the subject sections of the EIR and the supporting technical studies and reports. This project description will also be used ' in the NOP process. The basic project description will be supplied by the project Applicant. The Project Description will include details regarding the proposed Materials Recovery Facility/Transfer Station and it's placement on the 62.23 -acre site. The Project Description ' will be prepared in full accordance with Section 15124 of the State CEQA Guidelines, as amended, and will include an identification of the project's precise location and boundaries, as well as a general description of the project's technical, economic, and environmental characteristics. Both text and graphic illustrations will be employed to convey the project details. The proposed construction period will also be identified to allow for an accurate ' assessment of construction impacts and phasing of impacts, where relevant. ' Once the Project Description is finalized, the project objectives may be clarified and listed. A concise list of the project objectives is vital to the integrity of the EIR, as the alternatives will be analyzed for their ability to meet the basic objectives of the project, while reducing impacts in one or more environmental subject sections. E) City of Santa Clanta Burrtec Materials Recovery Facility EIR Proposal alternatives that are considered to be environmentally superior are to be rejected for their inability to meet the project objectives, these objectives must be properly identified ' and drafted at the outset. LDC will collaborate with the City planner to compile a draft and final list of project objectives. ' OUTPUT: One(1) Project tion section. 1 Description ' SUBTASK 4.4- ENVIRONMENTAL SETTING Section 15125 of the State CEQA Guidelines requires that an-EIR include a discussion ' of the environment in the vicinity of the project site as it exists prior to project implementation. The section will focus on the existing environs from both a local ' and regional perspective. This will facilitate a better understanding of the impacts of the project and the alternatives as the reader progresses through the impact sections. The Environmental Setting section of the EIR will also include a description of land uses that occur on and adjacent to the proposed project site. The physical setting of ' the site and surrounding area will be described. Where available, existing documentation regarding the environmental setting of the project area will be utilized. ' The CEQA Guidelines also require that an Environmental Setting section discuss the consistency of a proposed project with applicable regional plans and policies to ' provide a planning context for the project. Accordingly, this section will include a discussion of the relationship of the project to relevant plans. ' An analysis of the project's compatibility with surrounding uses as well an analysis of the project's consistency with the City's General Plan, Zoning, and Ridgeline ' Ordinance will be conducted as part of the EIR. The Land Use Section of the EIR will include a detailed description of existing land use plans, goals, policies, and objectives ' affecting the project site, as well as an analysis of the existing type and character of surrounding land uses. The proposed project's consistency with existing and proposed ' land uses will be analyzed, as will the project's compatibility with surrounding land uses, including existing oil fields, the DWP easement and the 14 Freeway. The proposed Zone Change and General Plan Amendment will be addressed in that specific section. The Environmental Setting section will contain a summary of the material presented in the full Land Use section. Both text and graphics will be used to convey the material required in this ' section. I OUTPUT: One (1) Environmental Setting section. ' December 13, 2007 6 Land Design Consultants, Inc. 11) 1 City of Santa Clarita Burrtec Materials Recovery Facility EIR Proposal SUBTASK 4.5 -AIR QUALITY Air Quality Technical Report to be prepared by Applicant's Subconsultant LDC Peer Review Construction of the proposed project would result in the generation of airborne ' emissions from construction equipment and vehicles as well as from grading operations. Post project construction would result in the generation of new vehicular trips ' associated with the daily operations of the 172,000 square foot Materials Recovery Facility. A Technical Air Quality Resources report will be prepared by the Applicant's subconsultant and submitted to LDC for use in the EIR. LDC staff will provide peer review of the Technical Report provided by the Applicant and will write a letter to the City Planner that documents '0 Describe the significance threshold criteria for evaluating air quality impacts ' December 13, 2007 7 Land Design Consultants, Inc. Iur the adequacy of the report for use in the DEIR. LDC staff will then review the response of ' the Subconsultant. It is assumed that only one round of review and comment will be required. If additional review and coordination is required to achieve a CEQA-adequate technical report, additional time and materials charges will be required that may be charged to the contingency amount reserved for such purpose. ' Based on the air quality report, this EIR section will evaluate the potential construction and ' operational impacts to air quality associated with the proposed project, cumulative projects and alternative projects. Through coordination with the sub -consultant, this section will: '0 Summarize baseline air quality information; '0 Describe the environmental setting by identifying existing major sources of air pollutants in the project vicinity, including sources of toxic air contaminants ' and odorous emissions. It will also identify existing and reasonably foreseeable sensitive receptors near the development site or near ' roadway/intersections that could be affected by project traffic and stationary source emissions; '0 Describe the regulatory setting in terms of local, state, and federal air quality requirements currently in effect within the SCAQMD. Any source -specific rules that may apply to air emissions sources to industrial/commercial development will be discussed. This section will also summarize key elements ' of the SCAQMD's air quality plans intended to bring the region into attainment with California and National AAQS; '0 Describe the significance threshold criteria for evaluating air quality impacts ' December 13, 2007 7 Land Design Consultants, Inc. Iur City of Santa Clanta Burrtec Materials Recovery Facility E/R Proposal from the SCAQMD's CEQA Air Quality Handbook (SCAQMD Handbook); ' Assess the air quality impacts due to the construction and operation of the proposed MRF project. The construction and operational emissions of ' volatile organic compounds (VOC), oxides of nitrogen (NOX), carbon monoxide (CO), respirable particulate matter (PM10), fine particulate matter (PM2.5), and sulfur oxides (SOX) should be compared to numerical ' (annual mass emissions) and/or qualitative significance thresholds established by the SCAQMD to determine the significant impacts resulting from the project. ' The emissions during the construction of the project should be estimated using the URBEMIS2007 (Urban Emissions) land use and transportation ' computer program, as well as other SCAQMD emission factors and tools. The construction emissions should be estimated using the construction ' schedule and equipment activity levels provided by the applicant, if available. Otherwise, the default assumptions in URBEMIS2007 should be used to estimate the construction emissions. The construction emissions should be ' compared to the SCAQMD mass emission thresholds of significance. ' Estimate the operational mobile and area source emissions VOC, NOX, CO, PM10, PM2.5, and SOX will be. estimated using URBEMIS2007. The trip ' generation rates provided in the traffic impact analysis for the project should be used in this analysis rather than the default values in URBEMIS2007. ' Area source emissions resulting from fuel combustion for building heating and other uses, use of consumer products and landscape equipment should ' be estimated using URBEMIS2007. Stationary sources associated with the industrial/commercial land uses and their emissions should be estimated using U.S. EPA, SCAQMD, or other standard emission factors for MRFs. The sum ' of the maximum daily trucks, employee motor vehicle, area source, and stationary source emissions should be compared to the SCAQMD thresholds of ' significance for operational emissions. • The potential for the cumulative emissions from the project and other local ' development project that could adversely affect air quality or impede attainment of the AAQS should be assessed in accordance with the ' SCAQMD Handbook and recommendations from the SCAQMD staff. • There should be an air quality impact analysis of the construction emissions to demonstrate conformity with the SCAQMD's "Localized December 13, 2007 8 Land Design Consultants, Inc. IJr City of Santa Clarita Burrtec Materials Recovery Facility EIR Proposal 1 Significance Threshold Methodology" (LST document). This methodology, and a ' subsequent document regarding PM2.5 thresholds, includes ambient air quality thresholds for nitrogen dioxide (NO2), CO, PM10, and PM2.5 to ensure that a project's emissions will not cause or contribute to violations of ' air quality standards for NO2 and CO and the applicable PM10 limit in SCAQMD Rule 403 (Fugitive Dust). This analysis will determine whether emissions from motor vehicles, mobile equipment, and earthmoving activities during construction would exceed the significance thresholds in ' the LST document. While the LST document allows the use of lookup tables to determine if the construction of a project is likely to cause significant localized impacts, the lookup tables are applicable only to projects with an overall site ' area of five acres or less. Because the overall project area is greater than five acres, performance of air quality dispersion modeling to assess the ' ambient air quality impacts is advised. The estimated maximum ambient 1 - hour NO2, 1 -hour and 8 -hour CO, and 24-hour PM10 and PM2.5 ' concentrations should be determined using the Industrial Source Complex — Short Term, Version 3 (ISCST3) dispersion model, local meteorological data obtained from the SCAQMD, and the estimated worst-case daily ' construction emissions. The maximum estimated ambient impacts for NO2 and CO should be compared with the relevant LST thresholds. The maximum estimated ambient impacts for PM10 and PM2.5 should be compared to the Rule 403 limit (expressed as a 24-hour average of 10.4 ' micrograms per cubic meter in the LST document). This analysis should be performed for representative scenarios of the proposed development. A ' report should be prepared to be included as an appendix to the Draft EIR • The air quality assessment should evaluate the project's impact on local CO ' concentrations near intersections and roadways. The intersections to be analyzed (from the traffic study) should be screened using the Institute of t Transportation Studies' Transportation Project -Level Carbon Monoxide Protocol. tDue to the size and nature of the proposed project, significant air quality impacts are likely to be identified for both construction and operational ' emissions. Accordingly, mitigation measures will be recommended to reduce or avoid potential project -specific or cumulative impacts on air quality based on I recommendations from the SCAQMD Handbook and other sources. City of Santa Clarita Burrtec Materials Recovery Facility EIR Proposal possible, the effectiveness of the mitigation measures will be quantified, and the significance of the project impacts with mitigation will be reevaluated and compared to the significance thresholds. 1 OUTPUT: One (1) Air Quality section ' SUBTASK 4.6 - BIOLOGICAL RESOURCES Technical Report to be prepared by Applicant's Subconsultant ' LDC Peer Review The Santa Clarita Valley region is rich in biological resources. The project site contains oaks woodlands, potentially jurisdictional streambeds, and native plant communities. A tcomprehensive biological technical report will be required to accurately and thoroughly address the impacts to biological resources on-site. Specific studies, such as Spring Surveys, Jurisdictional Determinations, and protocol surveys may be required. A technical Biological Resources report will be provided by the Applicant's Subconsultant and submitted to LDC for use in the EIR. Qualified LDC staff will provide peer review of the Technical Report provided by the Applicant and will write a letter to the City Planner that documents the adequacy of the report for use in the DEIR. LDC staff will then review the response of the Subconsultant. It is assumed that only one round of review and comment will be required. If additional review and coordination is required to achieve a CEQA-adequate ' technical report, additional time and materials charges will be required that may be charged to the contingency amount reserved for such purpose. Specific information and tasks ' required for this subject section will include, but may not be limited to, the following: • Review of existing documentation pertinent to the biological resources within, or in ' the vicinity of, the project site. This will include'a review of the following: (1) the most recent edition of the California Natural Diversity Data Base (CNDDB), listing historical and recent occurrences of special -status animal species in the project area; (2) the most recent edition of the California Native Plant Society (CNPS) database, listing historical and recent occurrences of special -status plant species in the project area; (3) local municipal codes; and (4) previous documentation (biological t assessment report, oak tree report, jurisdictional delineation report) describing the biological resources of the project site or immediate vicinity, as available. The project site will be visited by LDC biologists to familiarize themselves with the biological resources occurring or potentially occurring on the project site as identified in the provided Biological Technical Report to be prepared by others. It 1 ' December 13, 2007 to Land Design Consultants, Inc. City of Santa C/arita Burrtec Materials Recovery Facility E/R Proposal is assumed, and to be corroborated by the field visit and habitat evaluation, that updates to previously prepared surveys on the subject property are needed. These surveys are to be conducted by the Applicant's Subconsultant. ' Oak trees that are protected by local or regional ordinances, policies, or regulations will be identified. It is noted that on oak tree survey and report have ' already been prepared for the subject property. A revision to that report is anticipated to be prepared by the Applicant's Subconsultant due to grading design t changes. LDC's Certified Arborists and biologists/botanists will spot check the locations & DBH of a percentage of trees to be impacted by the project footprint. Should it be determined that the existing oak tree report requires additional updating for the purposes of the EIR impact analysis, this work will be conducted by the Applicant's Subconsultant at the City's discretion. • The biological impact maps to be prepared by the Applicant's subconsultant should include temporary and permanent impact designations related to limits of cut/fill grading daylights, back -cuts, remedial grading, and Fuel Modification ' Zones. Temporary haul routes and stock pile areas should be identified, if proposed, and impacts associated with those features should be discussed. ' Cumulative projects' and alternative projects' impacts should also be analyzed t (including Fuel Modification Zones, etc) in the Subconsultant's report and mitigation measures identified for all scenarios. • Temporary and permanent impacts to ACOE/CDFG & RWQCB jurisdictional areas (mapped to current ACOE Guidance standards) shall be mapped and ' quantified. Potential mitigation measures will be identified, as needed, to address the specific concerns of the jurisdictional agencies for the purposes of CEQA ' review. This service should be conducted by the Applicant's subconsultant at the City's discretion. Summaries of the above -referenced items shall be incorporated into the body of the DER. ' Thresholds of significance shall be established. Impacts to all affected resources shall be summarized and tied to the appropriate level of significance. Text and graphics shall be utilized from the Subconsultant's report to illustrate the existing and proposed conditions and impacts to biological resources. A color -coded impact summary and mitigation table shall be December 13, 2007 1 Land Design Consultants, Inc. City of Santa Clanta Burrtec Materials Recovery Facility EIR Proposal prepared to summarize the impacts, define at a glance the significance or each impact prior ' to- and post- mitigation implementation. It is assumed that the Applicant's Sub -consultant will generate the required existing habitat maps, impact maps for the project and at least three alternative projects, including the above -referenced temporary and permanent impact categories. The Applicant's Subconsultant(s) is/are also expected to generate a preliminary Fuel Modification Plan and a conceptual landscape plan that will be used in this section of the EIR. tOUTPUT: One (1) Biological Resources section SUBTASK 4.7 — GEOTECHNICAL HAZARDS Technical Report to be by Applicant's Subconsultant prepared LDC Review ' The applicant has proposed significant modification at the existing project site, including cut and fill operations that will move approximately 500,000-730,000 cubic yards of earth ' material. The project site is located in an area known for active seismic activity, and the potentially active Whitney Fault runs through the property. The site contains drainages and ' hillsides where liquefaction and landslide potential could occur. A Preliminary Geotechnical Plan Review and Geotechnical findings have been prepared for 1 the project. The Applicant's subconsultant will revise the evaluations to reflect the ultimate grading plan and will address the potential geologic, soil, and seismic impacts associated ' with the proposed project. A final Geotechnical report will be prepared by the Applicant's subconsultant and submitted to LDC for use in the EIR. Qualified LDC staff will provide peer review of the Technical Report provided by the Applicant and will write a letter to the ' City Planner that documents the adequacy of the report for use in the DEIR. LDC staff will then review the response of the Subconsultant. It is assumed that only one round of review ' and comment will be required. If additional review and coordination is required to achieve a CEQA-adequate technical report, additional time and materials charges will be required that may be charged to the contingency amount reserved for such purpose. The DEIR section will include existing conditions, discussion of methods of study, thresholds tof significance, and potential impacts caused by the proposed project will be discussed. The resultant level of significance for each of the impacts will be identified. Mitigation measures ' to lessen or avoid impacts will be assigned where appropriate and the level of significance after mitigations will be stated. The following subjects shall be discussed in the DEIR section: ' December 13, 2007 12 Land Design Consultants, Inc. City of Santa Clanta Burrtec Materials Recovery Facility EIR Proposal ' Landslide potential ' • Potential fault rupture • Seismic shaking related hazards, including liquefaction, cyclic settlements, lateral ' spreading, and slope stability • Global (static) slope stability of cut, fill and natural slopes ' • Surficial stability of cut, fill and natural slopes including debris flow hazard evaluation • Presence of soils subject to expansion, corrosion, hydro consolidation, or subsidence ' • Existing ground water conditions and potential impacts to and from development ' If exploratory trenching(s) or boring(s) are required in areas of potential CDFG or ACOE jurisdiction, LDC biological staff can be available to contact the appropriate agency staff, t coordinate on the plan of action, and monitor the exploratory operations as required by the agencies. This task is optional and may be charged to the contingency amount reserved for such purpose at the City's direction. I OUTPUT: One (1) Geotechnical Hazards Section ' SUBTASK 4.8 — LAND USE LDC ' The project as proposed would require a General Plan Amendment, a Zone Change, a Conditional Use Permit, Hillside Development Review, a Ridgeline Alteration Permit, and an ' Oak Tree Permit. The Land Use Section will: • Describe the existing land uses, intensities, and patterns in the vicinity of the project ' site based on aerial photographs and a site visit. • Describe the relevant designations for the project site from the City's General Plan, tand Zoning Map. • Evaluate project consistency with relevant plans, policies and regulations. In ' accordance with CEQA Guidelines Section 15125(b), the analysis will include applicable local plans and regional plans. Plans and policies that will be evaluated 'include: -City of Santa Clarita General Plan; - City of Santa Clarita Uniform Development Code; ' December 13, 2007 13 Land Design Consultants, Inc. 0Jr - City of Santa Clanta Burrtec Materials Recovery Facility EIR Proposal - Other existing relevant ordinances and regulations ' City staff will be consulted to determine other relevant plans, if any. Where appropriate, the evaluation will cross-reference the analysis in other sections, such ' as Air Quality, Biological Resources, Visual Resources and Transportation and Circulation. ' Discuss potential environmental impacts relating to policy inconsistency and land use compatibility. Typically, this discussion will cross-reference the analyses of other impacts in the EIR. ' The analysis of land use compatibility will be a primary focus of this EIR section, and will tie in with specific impact analyses included in this EIR. The compatibility analysis will address ' how the project's operational impacts, such as traffic, air quality and noise impacts could affect surrounding development and land uses. This section will also include a consistency ' analysis with the City's General Plan goals and policies. Cumulative, long-term land use impacts will also be analyzed, and any trends in land use and development will be ' described. I OUTPUT: One (1) Land Use section. ISUBTASK 4.9 — WATER RESOURCES ' IMPACT SCIENCES, INC. Impact Sciences, Inc. will prepare a Water Supply Assessment (WSA) and a Water ' Resources section for the EIR. Their EIR section information will include a discussion of the existing conditions, applicable plans, thresholds of significance, impact analysis, and ' mitigation measures. The current Urban Water Management Plan should be reviewed for consistency and appropriate technical information from the local and regional water districts will be incorporated into the section and the EIR Appendices. Impact Sciences has allocated '. six (6) hours for response to comments on water issues. If additional time is needed for response to comments, attendance at meetings or hearings, or other items, additional fees ' may be required that may be charged to the contingency amount reserved for such purpose. LDC shall coordinate with Impact Sciences and incorporate their reports into the EIR format and appendix. The Applicant shall supply details of the project's water usage for the MRF, including but not ' limited to, landscaping, employee usage, equipment and truck washing, if any, at the plant. ' December 13, 2007 14 Land Design Consultants, Inc. fjr 1 n J City of Santa Clanta Burrtec Materials Recovery Facility EIR Proposal OUTPUT: One (1) Water Services section SUBTASK 4.10 SOLID WASTE DISPOSAL LDC LDC will coordinate with local landfill operators to assess the potential impacts of the proposed project on Solid Waste Disposal. The landfill operators will be contacted by letter, email and phone to gather information on existing conditions, life -expectancy for each potential landfill that could accept material, the impact of the proposed project, and appropriate mitigation measures. The Applicant may also supply information to the City that will support this section. The County of Los Angeles' ISWMP shall be reviewed for consistency and appropriate information from the local and regional waste management plans will be incorporated into the section and the EIR Appendices. OUTPUT: One (1) Solid Waste Section SUBTASK 4.11 — HUMAN MADE HAZARDS LDC LDC review available reports and information regarding environmental conditions at the project site, including the Phase 1 Environmental Assessment Report, historic oil field information, DWP information regarding potential transmission line upgrades, and other related documents. LDC will analyze the potential for hazardous materials and other human made hazards to be present on or near the project site, as well as for the potential for the proposed project to utilize such materials in the construction or post -construction phases of the project. LDC will review the Santa Clarita Standardized Emergency Management System Multi -Hazards Functional Plan and determine if the proposed project would impair implementation or physically interfere with this plan or any other applicable emergency response plans for the area. We will consult with the Los Angeles County Fire Department with regard to Fuel Modification requirements and make a determine if the project implementation would expose people or structures to wild land fires. LDC will identify any applicable mitigation measures for identified significant hazards and hazardous materials impacts. The EIR section will include, at a minimum, a discussion of the existing conditions, applicable plans, thresholds of significance, impact analysis, and mitigation measures. The visual simulation report to be prepared by others must include simulations for the three (3) project Alternatives from the same vantages as the proposed project. Qualified LDC staff will provide peer review of the simulations provided by the Applicant and will write a letter to the City Planner that documents the adequacy of the simulations for use in the DEIR. LDC staff will then review the response of the Subconsultant. It is assumed that only one round of review and comment will be required. If additional review and coordination is required to achieve a CEQA-adequate visual report, additional time and materials charges will be required that may be charged to the contingency amount reserved for such purpose. LDC will prepare the visual analysis discussion for the proposed project and up to three (3) additional Alternative projects based on the pre- and post project visual simulations to be provided by others. LDC will prepare one cross-section for the project. Cross-sections provide a different spatial tool for a reader that compliments the photo simulations. The potential impacts from construction and operation of the proposed project on the visual character of the area will be assessed in terms of the visibility of the project, alteration of the existing visual setting, and the sensitivity of the viewpoints. The EIR section will describe the existing visual character of the project site, focusing on site features such as drainages, significant ridgelines, native vegetation, existing site character, and the relationship to nearby uses (including power lines and oil fields). The discussion will be based on a site visit and existing documents (e.g., General Plan, technical studies prepared for the project, etc.). Thresholds of Significance will be listed and the impacts will be discussed in light of those thresholds. Significance prior to mitigation will be established; mitigation measures to reduce or avoid significant visual impacts will be introduced, and; residual significance will be addressed. OUTPUT: One (1) Visual Resources section SUBTASK 4.13 — CULTURAL RESOURCES Cultural and Paleontological Report to be prepared by Applicant's Subconsultant LDC Peer Review The project site's relative vicinity to the Santa Clara River, the character of the underlying geologic units, the presence of natural drainages and oak woodlands, the fact that the site is relatively undeveloped, and the proposed extensive land form modification combine to suggest the potential for discovery of buried cultural or paleontological resources during project development. The Applicant's subconsultant will prepare a comprehensive Phase I Cultural and Paleontological Report for submittal to LDC for use in the EIR. The report should include separate analysis of cumulative projects' and the three (3) project alternatives. Qualified LDC staff will provide peer review of the Report provided by the Applicant and will write a letter to the City Planner that documents the adequacy of the report for use in the DEIR. LDC staff will then review the response of the Subconsultant. It is assumed that only one round of review and comment will be required. If additional review and coordination is required to achieve a CEQA-adequate technical report, additional time and materials charges will be required that may be charged to the contingency amount reserved for such purpose. It is assumed that the applicant's Subconsultant will contact the Native American Heritage Commission (NAHC) to request information it may have regarding sacred sites in the project area (PRC 5097.9) and to obtain the contact information for Native American Tribes who should be consulted under SB 18. The EIR section will summarize the existing cultural / paleontological resources on, or in the vicinity of, the project site. The discussion will be based on the technical studies prepared for the project. Thresholds of Significance will be listed and the impacts will be discussed in light of those thresholds. A summary of impacts will be provided based in the findings of the Subconsultant's report. Mitigation measures promulgated by the Applicant's Subconsultant shall be listed and any residual significant impacts will be identified. IOUTPUT: One (1) Cultural Resources section. ' SUBTASK 4.14 —WASTEWATER DISPOSAL LDC ' LDC will coordinate with City staff and affected public utility providers to assess the potential impacts of the proposed project on water services. The Applicant and or their project ' Engineer, shall supply details of the project's wastewater generation for the MRF, including but not limited to, employee usage, equipment and truck washing, and washing of materials ' in the plant. Information on wastewater treatment proposed by the Applicant shall be supplied to LDC for inclusion into the DEIR. The DEIR section will include a summary of the existing conditions and regulatory settings, methodologies employed in the technical study and a list of significance thresholds for traffic - related issues. It is assumed that the Traffic Report will include all required data relating to trip generation ' rates, study intersection information and graphics, current traffic counts, and related projects in the area which may contribute cumulative impacts to the adjacent street system and study ' locations in the vicinity of the proposed project. The compiled list of related projects will be utilized for cumulative analysis, as reasonable and applicable, in other section of the DEIR. ' In addition to related projects, consider utilization of an ambient traffic growth factor for purposes of assessing the trips generated by related projects that are currently unknown, and/or are located outside the study area. Based on this assessment, determine which intersections (if any) will require improvements to reduce potential traffic impacts associated with the proposed development to less than significant levels. The Applicant's Subconsultants should also provide recommended mitigation measures, which may include intersection and/or signalization improvements, striping modifications, the addition of auxiliary turn lanes, traffic control/limitations at site access points, etc. Please note that this proposal assumes the recommended mitigation measures can be adequately described within the text of the report. The report should include the preparation of an analysis of potential impacts at monitoring location(s) identified in the 2004 Congestion Management Program for Los Angeles County manual, Metropolitan Transportation Authority, July 2004. The CMP impact thresholds will be reviewed to determine if an analysis is required and, as needed, an evaluation will be prepared of the potential project impacts on the CMP system. It should also include research of freeway traffic volumes available from the California Department of Transportation for segments in the vicinity of the project site, as well as freeway segments identified for analysis/monitoring by the Los Angeles County CMP. The Subconsultant should assign the forecast AM and PM peak hour trips expected to be generated by the proposed project to the identified freeway segments (i.e., up to four segments) based on existing and anticipated traffic patterns to and from the project site. The report should include preparation of trip generation forecasts for up to three (3) project alternatives for a typical weekday over a 24-hour period, as well as for the commuter AM and PM peak hours based on data obtained for material recovery facilities and transfer stations in the area as well as other traffic study reports prepared for similar facilities. OUTPUT: One (1) Transportation and Access section. SUBTASK: 4.18 - UTILITIES LDC LDC will coordinate with City staff and affected public utility providers to assess the potential impacts of the proposed project on local public utility services. It is assumed the Applicant's Engineer or others will produce a Fuel Modification Plan for discussion our purposes in this section. LDC could provide this service if requested at an additional cost. SUBTASK 4.20 - PROJECT ALTERNATIVES ANALYSIS LDC intends to provide comparative analysis of up to three (3) alternatives to the proposed project, which could include (1) an Existing General Plan/Zoning -Designation alternative, (2) a Reduced Facility alternative, and (3) an Alternative Facility Placement alternative. The required No -Project Alternative will also be addressed in a qualitative fashion as a fourth alternative. These alternatives (except for No Project) will be defined or redefined in coordination with City staff upon completion of a majority of the Working Draft EIR, when significance impacts be known, will and alternatives can be devised that will reduce impacts. LDC will work with the City in the definition of the alternatives to ensure that the analysis meets the requirement of CEQA to focus on alternatives that could reduce the significant impacts of the proposed project. The CEQA Guidelines provide basic rules and procedural requirements for environmental document preparation and review. However, they are guidelines, and as such are open for some interpretation.
