City Council adopt a resolution rescinding the City Council action of December 10, 2002, which rejected the public use of Carl Court, and accept and open the street for public use and road purposes in compliance with the State of California Government Code, Subdivision Map Act, Section 66477.2 (a). 2. Adopt a resolution rescinding the County of Los Angeles Board of Supervisors action of October 16, 1984, which rejected the public use of a portion of Valle Del Oro, and accept and open the street for public use and road purposes in compliance with the State of California Government Code, Subdivision Map Act, Section 66477.2 (a). BACKGROUND Carl Court was previously offered to the City of Santa Clarita for public use as a private and future street on Tract 53114 as per the map filed in Book 1275, pages 82 through 98, inclusive of maps, Los Angeles County records. This offer was rejected by the City Council at the regular City Council meeting on December 10, 2002. Subsequent to the December 10, 2002, rejection, all street improvements have been completed on Carl Court to public street standards and a traffic signal has been installed at the intersection of Carl Court and Newhall Avenue. Staff recommends Carl Court be accepted as a public street. A portion of Valle Del Oro was previously offered to the County of Los Angeles for public use as a private and future street on Tract 43174 as per the map filed in Book 1041, pages 68 through Adopted: ecso. o , q 72, inclusive of maps, Los Angeles County records. This offer was rejected by the Board of Supervisors of the County of Los Angeles at their regular meeting held on October 16, 1984. This action was taken prior to the incorporation of the City of Santa Clarita on December 15, 1987. Subsequent to the December 15, 1987, rejection, Valle Del Oro has now been extended and fully improved to public street standards from Newhall Avenue to Dockweiler Drive. Valle Del Oro from the flood control channel to Dockweiler Drive was previously offered for public use as a public street on Tract 32365 as per the map file in Book 1122, pages 30 through 38, inclusive of maps, Los Angeles County records. This offer was accepted by the City Council at the regular City Council meeting on January 10, 1989. Staff recommends Valle Del Oro from Newhall Avenue to the flood control channel be accepted as a public street. The State of California Government Code, Subdivision Map Act, Section 66477.2 (a) states, "If at the time the final map is approved, any streets, paths, alleys, public utility easements, rights-of-way for local transit facilities such as bus turnouts, benches, shelters, landing pads, and similar items, which directly benefit the residents of a subdivision, or storm drainage easements are rejected, subject to Section 771.010 of the Code of Civil Procedure, the offer of dedication shall remain open and the legislative body may by resolution at any later date, and without further action by the subdivider, rescind its action and accept and open the streets, paths, alleys, rights-of-way for local transit facilities such as bus turnouts, benches, shelters, landing pads, and similar items, which directly benefit the residents of a subdivision, or storm drainage easements for public use, which acceptance shall be recorded in the office of the county recorder." The City Engineer has determined that it will benefit the residents of surrounding subdivisions to open Carl Court and a portion of Valle Del Oro from Newhall Avenue to the flood control channel, both currently private and future streets, for use by the public. ALTERNATIVE ACTIONS Other action as determined by the City Council. FISCAL IMPACT The maintenance of these new public streets will have minimal impact on the City's street maintenance budget. NOW, THEREFORE, pursuant to the State of California Government Code, Subdivision Map Act, Section 66477.2 (a), the City Council of the City of Santa Clarita does hereby resolve as follows: SECTION 1. It is hereby found and determined that the action to reject Carl Court, previously offered to the City of Santa Clarita for public use as a private and future street on Tract 53114 as per the map filed in Book 1275, pages 82 through 98, inclusive of maps, Los Angeles County records, as shown on Exhibit "A" attached hereto and incorporated herein by this reference, and rejected by the City Council of the City of Santa Clarita at a regular meeting thereof, held on December 10, 2002, which real property is located in the City of Santa Clarita, County of Los Angeles, State of California, is rescinded and said Carl Court is accepted and open for public use and road purposes in compliance with the State of California Government Code, Subdivision Map Act, Section 66477.2 (a). SECTION 2. The City Clerk of the City of Santa Clarita shall certify to the adoption of this Resolution. SECTION 3. The City Clerk of the City of Santa Clarita is instructed to record the certified original Resolution in the Office of the Registrar -Recorder of the County of Los Angeles, at which time Carl Court is accepted and open for public use and road purposes.
