SUBJECT: COMMISSION/PANEL VACANCIES
DEPARTMENT: Administrative Services
RECOMMENDED ACTION
City Council declare vacancies on the Planning Commission, Parks, Recreation and Community
Services Commission, and Open Space Preservation District Financial Accountability and Audit
Panel (FAAP), and approve the appointment process.

Terms of various Planning Commissioners, Parks, Recreation & Community Services
Commissioners, and Open Space Preservation District Financial Accountability and Audit
Panelmembers (FAAP) will expire on July 31, 2008. In addition, as a result of the election of
Laurie Ender to the City Council, her unexpired term on the Parks, Recreation & Community
Services Commission needs to be filled. A resignation letter has also been received from Calvin
Hedman for his position on the FAAP.
These various commissioners/panelmembers are listed below, along with the nominating
Councilmember's name:
Planning Commissioners:
Bill Kennedy nominated by Mayor Kellar
Michael D. Berger nominated by Councilmember Smyth
Parks, Recreation & Community Services Commissioners:
Laura Hauser nominated by Mayor Kellar
Duane Harte nominated by Councilmember Boydston
Laurie Ender nominated by Councilmember Ferry (term expires July 31, 2010)

Pursuant to procedures adopted by the City Council, below is a preliminary schedule to complete
the appointment process:
May 27
Council declares vacancies (regular Council meeting).
May 30
City Clerk publishes and posts Notice of Vacancies per Government
Code Section 54974. Prospective candidates may obtain an application
from the City Clerk's Office or from the City's website. (Publish notice
twice and post in Clerk's Office, Libraries, and Sheriffs Office.)
May 28 - June 20
City Clerk receives applications.
June 20 - July 8
Mayor Kellar and Councilmembers Ender and Ferry review
applications.
July 8
Mayor Kellar and Councilmembers Ender, Ferry and Weste submit
nominations for ratification by the City Council and appoint
commissioners and panelmembers (regular Council meeting).
The City Clerk will administer the oath of office to the newly appointed Commissioners and
panelmembers at the next regular meeting of their respective Commission after July 31, 2008.
ALTERNATIVE ACTIONS
Other action as determined by the City Council.
FISCAL IMPACT
Costs of publishing the Notice of Vacancies are budgeted in the City Clerk's Office legal,
advertising account No. 12300.5161.004.

Duties: The Planning Commission shall have the power and duty, except as otherwise provide by law, to: investigate
and make recommendations to the City Council regarding review of proposals for major public works projects; review
proposals for acquisition of property for street, park or other public purposes; make recommendations to the City
Council with respect to a specific plan or regulation or amendment; hold public hearings on proposed zoning; hear and
decide applications for conditional uses or other permits; hear and decide applications for exceptions or variances;
consider tentative maps of proposed subdivisions; have and exercise all of the powers, duties, rights, privileges and
authorities of a City Planning Commission, as provided for by the State of California.
Qualifications: Each of the five (5) Commissioners shall be a resident of the City and shall be appointed by and serve at
the pleasure of the City Council.

otherwise provide by law, to: advise the City Council in all matters pertaining to parks, public recreation, and
community services and to cooperate with other governmental agencies and civic groups in the advancement of sound
park, recreation and community services planning and programming, and have and exercise all of the powers, duties,
rights, privileges and authorities of a City Parks, Recreation and Community Services Commission, as provided for by
the State of California.
Qualifications: Each of the five (5) Commissioners shall be a resident of the City and shall be appointed by and serve at
the pleasure of the City Council.
