Direct the City Clerk to record the certified original resolution in the office of the Registrar -Recorder of the County of Los Angeles. BACKGROUND Greg and Elizabeth Smith, the current owners of Lot 6, Tract 45409, have requested to vacate Joseph Hooper Drive and the adjacent slope easements as shown on Tract 45409, Map Book 1098/25-27. This right-of-way was originally dedicated to the County of Los Angeles for road purposes on November 18, 1987. Staff has determined this summary vacation will not negatively affect any existing or future trail alignments in the area. Per Section 8331 of the Streets and Highways Code, the legislative body of a local agency may summarily vacate a street or highway if both of the following conditions exist: (a) For a period of five consecutive years, the street or highway has been impassable for vehicular travel. (b) No public money was expended for maintenance on the street or highway during such period. Adopted: Vo. '0(�-R3 Both of these conditions exist on this portion of Joseph Hooper Drive; therefore, the City Council may summarily vacate this property. ALTERNATIVE ACTIONS Other action as determined by the City Council. SCAL IMPACT None ATTACHMENTS Resolution Exhibit "A" - Legal Description Exhibit "B" - Vicinity Map RESOLUTION 08- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, SUMMARILY VACATING JOSEPH HOOPER DRIVE AND ADJACENT SLOPE EASEMENTS, ORIGINALLY DEDICATED TO THE COUNTY OF LOS ANGELES ON . TRACT 45409, MAP BOOK 1098/25-27 RECORDED NOVEMBER 18, 1987, IN THE CITY OF SANTA CLARITA WHEREAS, the portion being summarily vacated fully meets the requirements of Section 8331 of the Streets and Highway Code, which states, "The legislative body of a local agency may summarily vacate a street or highway if both of the following conditions exist: (a) For a period of five consecutive years, the street or highway has been impassable for vehicular travel. (b) No public money was expended for maintenance on the street or highway during such period." The current owner requests that Joseph Hooper Drive and the adjacent slope easements, originally dedicated to the County of Los Angeles on Tract 45409, Map Book 1098/25-27 recorded November 18, 1987, be vacated; and WHEREAS, under Chapter 4, Summary Vacation of Part 3 of Division 9 of the Streets and Highways Code of the State of California, no public hearing is required and no public hearing was held. NOW, THEREFORE, pursuant to the provisions of Section 8333 of Part 3 of Division 9 of the Streets and Highways Code of the State of California, the City Council of the City of Santa Clarita, California, does resolve, declare, determine, and order as follows: SECTION 1. That it is hereby found and determined that Joseph Hooper Drive and the adjacent slope easements, originally dedicated to the County of Los Angeles on Tract 45409, Map Book 1098/25-27 recorded November 18, 1987, as described on Exhibit "A" and,shown on Exhibit "B" attached hereto and incorporated herein by this reference, which real property located in the City of Santa Clarita, County of Los Angeles, State of California, fully meets the requirements of Section 8331 of the Streets and Highway Code, which states, "The legislative body of a local agency may summarily vacate a street or highway if both of the following conditions exist: (a) For a period of five consecutive years, the street or highway has been impassable for vehicular travel. (b) No public money was expended for maintenance on the street or highway during such period." SECTION 2. That the City Clerk of the City of Santa Clarita is instructed to record the certified original resolution in the office of the Registrar -Recorder of the County of Los Angeles, at which time the street summarily vacated will no longer be a public street. SECTION 3. The City Clerk shall certify to the adoption of this Resolution. PASSED, APPROVED, AND ADOPTED this day of , 2008.
