SANTA CLARITA SPORTS COMPLEX PHASE IV GRADING
AND DRAINAGE IMPROVEMENTS PROJECT P3012 - AWARD
THE CONSTRUCTION CONTRACT, ALL SUPPORTING
CONTRACTS, AND APPROPRIATE FUNDING

RECOMMENDED ACTION
City Council approve the plans and specifications and award the construction contract to
Sukut Construction, Inc. in the amount of $2,742,349, and authorize a contingency in the
amount of $411,352 and $150,000 for Storm Water Pollution Prevention Plan compliance,
for a total contract amount not to exceed $3,303,701.

2. Award all supporting contracts totaling $935,000 for the following:
• Award the quality assurance for materials testing, soils testing, and inspection service
contract to R.T. Frankian Associates in the amount of $150,000.
• Award the construction surveying, staking services, and engineering design support
contract to Hunsaker and Associates in the amount of $350,006.
• Award the labor compliance consulting services contract to Labor Compliance Services
in the amount of $25,000.
• Authorize construction management and inspection costs in the amount of $130,000.
• Authorize a one-time increase of $120,000 for project management services to MNS
Engineers, Inc. existing professional services contract.
• Authorize the execution of facility relocation agreements with Southern California
Edison, Southern California Gas Company, AT&T, and any other necessary utility
agreements in the amount of $160,000.
3. Authorize the appropriation of $1,968,701 from Public Facilities Replacement fund balance
to Santa Clarita Sports Complex Phase IV Grading and Drainage Improvements Expenditure
Account P3012723-5161.001.

4. Authorize the City Manager or designee to execute all documents, subject to City Attorney
approval.
BACKGROUND
Phase IV of the Santa Clarita Sports Complex is divided into 3 different projects in the following
order: grading and drainage improvements, skate park construction, and gymnasium expansion.
This part of the project, grading and drainage improvements, includes mass grading and
construction of a new debris basin and storm drain system. The other 2 parts of this phase will
shortly follow this project.
On March 25, 2008, the City Council directed staff to advertise for construction bids. On April
28, 2008, the City's Purchasing Division received 11 bids for the project (Exhibit "A"). The
lowest responsive bid was submitted by Sukut Construction, Inc. in the amount of $2,742,349.
Staff recommends that the project be awarded to Sukut Construction, Inc., the lowest responsive
bidder. Sukut Construction, Inc. possesses a state contractor's license and is in good standing
with the State Contractor's Board. The bid from Sukut Construction, Inc. in the amount of
$2,742,349 was reviewed for accuracy and conformance to the contract documents and was
found to be complete.
While the City maintains a "Support of Local Businesses" policy that can be utilized by the City
Council when warranted, the City is governed by the State Public Contract Code with regard to
public works project procurement. In these types of procurement, the Public Contract Code does
not permit a City to utilize a "Support of Local Businesses" policy and instead requires the
contract be awarded to the "lowest responsible bidder." As confirmed by the City Attorney's
Office, this direction precludes the City from applying any superseding criteria for award except
in the case of a tie. Thus, in the awarding of Public Works contracts the City is not permitted to
award to the second low bidder just because they are local as the State Public Contract Code does
not allow the City to recognize them as the "lowest" responsible bidder.

FISCAL IMPACT
The project construction budget currently has $2,270,000 in available funding. The requested
appropriation of $1,968,701 from the Public Facilities Replacement fund balance into Santa
Clarita Sports Complex Phase IV Grading and Drainage Improvements Expenditure Account
P3012723-5161.001 should adequately provide for anticipated construction costs.
