A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA CLARITA, CALIFORNIA, ACCEPTING THE OFFER FOR
PUBLIC USE THE PRIVATE AND FUTURE STREET
DESIGNATED AS CARL COURT
WHEREAS, Carl Court was previously offered to the City of Santa Clanta-for public use
as a private and future street on Tract 53114 as per the map filed in Book 1.2-75, pages ,82 through
98, inclusive of maps, Los Angeles County records, and was rejected by'the City Council of the
City of Santa Clarita at a regular meeting thereof, held on December 10,20'02;^and
WHEREAS, under the State of California Government Code, Subdivision,,Map Act,
Section 66477.2 (a), which states, "If at the time the final map is approved„any\streets, paths,
alleys, public utility easements, rights-of-way for local transit facilities such 'as bus turnouts,
benches, shelters, landing pads, and similar items, which directly benefit the residents of a
subdivision, or storm drainage easements are rejected, subject to Section 771.010 of the Code of
Civil Procedure, the offer of dedication shall remain open and the legislative body may by
resolution at any later date, and without further action by the subdivider, rescind its action and
accept and open the streets, paths, alleys, rights-of-way for local transit facilities such as bus
turnouts, benches, shelters, landing pads, and similar items, which directly benefit the residents
of a subdivision, or storm drainage easements for public use, which acceptance shall be recorded
in the office of the county recorder.”
NOW, THEREFORE, pursuant to the State of California Government Code, Subdivision
Map Act, Section 66477.2 (a), the City Council of the City of Santa Clarita does hereby resolve
as follows:
SECTION 1. It is hereby found and determined that the action to reject Carl Court,
previously offered to the City of Santa Clarita for public use as a private and future street on
Tract 53114 as per the map filed in Book 1275, pages 82 through 98, inclusive of maps, Los
Angeles County records, as shown on Exhibit "A" attached hereto and incorporated herein by
this reference, and rejected by thei City Council of the City of Santa Clarita at a regular meeting
thereof, held on December 10, 2002, which real property is located in the City of Santa Clanta,
County of Los Angeles, State of California, is rescinded and said Carl Court is accepted and open
for public use and road purposes in compliance with the State of California Government Code,
Subdivision Map Act, Section 66477.2 (a).
SECTION 2. The City Clerk of the City of Santa Clarita shall certify to the adoption of
this Resolution.
SECTION 3. The City Clerk of the City of Santa Clarita is instructed to record the
certified original Resolution in the Office of the Registrar -Recorder of the County of Los
Angeles, at which time Carl Court is accepted and open for public use and road purposes.
