APPROVAL OF TRACT MAP

RECOMMENDED ACTION
City Council approve Tract No. 68563 (Mobile Home Park Condominium Conversion -
18035 Soledad Canyon Road).
Make findings as follows: (a) that this project is consistent with the provisions of Sections
66424, 66427, 66474, and 66474.1 of the Subdivision Map Act and should be approved, and
(b) that this proposed subdivision, together with the provisions for this design and
improvement, is consistent with the General Plan required by Article 5 (commencing with
Section 65300) of Chapter 3 of Division 1 of the Government Code, or any specific plan
adopted pursuant to Article 8 (commencing with Section 65450) of Chapter 3 of Division 1
of the Government Code.
Instruct the Deputy City Manager and Director of Administrative Services to endorse the
Special Assessment Statement on the face of Tract No 68563, which indicates that all special
assessments levied by the City have been paid.
4. Instruct the City Clerk to endorse the Statement on the face of "bract No 68563, which
embodies the approval of said maps and the acceptance ofthe dedications shown thereon.
5. Instruct the City Engineer to endorse the Statement on the face of "bract No 68563, which
provides for verification of substantial conformance with the "tentative Map and all
provisions of local ordinances and state laws applicable at the time of approval

BACKGROUND
Tentative Tract No. 68563 (Mobile Home Park Condominium Conversion - 18035 Soledad
Canyon Road) was deemed to be in substantial conformance with the principles and standards
required by the Unified Development Code and approved by the Planning Commission on
October 16, 2007. The map consisting of approximately 9.6 acres is located on the north side of
Soledad Canyon Road, 0.4 miles east of Sierra Highway, and is owned by Newport Pacific
Caravilla Limited, a California Limited Partnership.
This map is a subdivision of a portion of the Northwest Quarter of Section 22, Township 4
North, Range 15 West, San Bernardino Meridian, and is creating one lot with 84
airspace/condominium units, converting an existing mobile home park to individual ownership.
Water rights have been secured for the lot.
Per California Government Code (Subdivision Map Act) Section 66451.6, "No fee shall be
charged by a local agency (the City) as a condition to the approval of a tentative, final, or parcel
map for a subdivision, or a division of land which is not a subdivision, which consists of the
conversion of a mobilehome park to condominium or stock cooperative ownership interests,
except regulatory fees charged for the issuance of a permit and those fees authorized by Section
66451.2." The fees authorized by Section 66451.2 are "...reasonable fees for the processing of
tentative, final and parcel maps..." Therefore, the project was not conditioned to pay Quimby,
Transit Impact, or Bridge and Thoroughfare fees.
The conditions set by the Planning Division staff have been met. The fees and the map have been
checked to the satisfaction of the City Engineer and are ready for City Council approval and
acceptance of the dedications.
ALTERNATIVE ACTIONS
Staff has not identified any alternative actions that would conform to requirements set forth in the
Subdivision Map Act.
FISCAL IMPACT
No new public streets are being dedicated to the City by this map. No impact will be made to the
City's Street Maintenance Budget.
