RECOMMENDED ACTION
City Council:
1. Conduct the public hearing.
2. Adopt a resolution establishing a schedule of fees and charges for City services.
3. Adopt a resolution revising fees and charges for parking penalties and other related violations
within the City.
4. Adopt a resolution establishing fees and charges for the storm drainage utility services for
Fiscal Year 2009-10.
BACKGROUND
In 1990, the City Council directed staff to prepare a study identifying the full cost of providing
services. The result of this effort was the adoption of City Council policy establishing
cost -recovery standards, the adoption of the City's first full -cost based fee schedule, and an
ongoing mechanism to assess the cost of City services and to adjust fees accordingly.
Propositions 4 and 13 establish the "costs reasonably borne" philosophy. The philosophy
necessitates the determination of the full business cost of each City -provided service, the
identification of the beneficiary of each service, and the evaluation of services to determine an
appropriate level of cost recovery for each. "Costs reasonably borne" implies a direct
relationship between payment of fees and charges and receipts of services. The direct fee/service
and tax equity relationship does not exist when tax monies are used to subsidize services
received by only a small portion of the taxpaying public, or by non-residents.

Every five years, the City examines the costs associated with providing services to the public.
Fiscal Year 2003-04 was the last time the comprehensive study was conducted. During the
current fiscal year, staff worked in conjunction with an independent third party, Revenue and
Cost Specialists, LLC, to conduct a time -motion study and create a cost allocation plan to
determine the most accurate cost of providing services to the public. All City departments
participated in the study to determine the amount of time the employee is involved in each City
service. Fiscal Year 2009-10 proposed fees are based on the costs determined by this study.
Proposed Fees and Charges for Fiscal Year 2009-2010
For Fiscal Year 2009-10, staff recommends Citywide fees and charges, including fees for
Development, Public Safety, Parks, Recreation, and Community Services, and Facility Rentals be
modified to reflect costs to the City for providing these services as determined by the
comprehensive fee study.
Parks, Recreation, and Community Services Fees
It is recommended that certain fees for the following programs in Parks, Recreation, and
Community Services remain unchanged, based on current market conditions: City youth sports,
various aquatic programs, camp programs, child development programs, sport facility rental;
activity center rental, and individual basketball/racquetball membership at the sports complex. It
is also recommended that the Parade Permit/Special Event Application fee remain unchanged.
Additionally, it is recommended that the implementation of certain aquatics fees in Parks and
Recreation be deferred to January 1, 2010, as noted in Attachment A. Those programs include
competitive stroke instruction, private swim lessons, kayaking, water sports camp, swim team,
dive team, water polo team, and synchronized swim team.
Development Fees
Due to the current economic environment, staff recommends the proposed development -related
fees go into effect January 1, 2010. The California Government Code section 66017(a) requires
a development -related fee to be effective no sooner than 60 days following adoption of the fee,
charge, or increase. The City historically has allowed for a 90 -day waiting period between fee
adoption and implementation; however, staff recommends a further deferral to January 1, 2010.
Development activity levels and economic conditions will be re-evaluated at midyear, and any
appropriate adjustments will be recommended at that time. All fees for projects submitted prior
to January 1, 2010, that are denied and asked to resubmit, will be charged using the old fee
structure.
The Building Industry Association (BIA), the Valley Industrial Association (VIA), the Chamber
of Commerce, and industrial waste permit holders were directly contacted regarding the proposed
development related fees and industrial waste fees. Moreover, a public meeting was held on
April 30, 2009, and no member from the public attended.
Parking Violations
Beginning with Fiscal Year 2004-05, fees related to parking citations were reviewed and revised
in an effort to provide consistency and mirror the Los Angeles County bail fee schedule. For
Fiscal Year 2009-10, staff recommends the fees be adjusted by $5 to accommodate the increase
in the State Courthouse Construction Fee surcharge placed on paid parking citations, and
authorize staff to adjust citation rates to pass through future Federal, State, and County fees and
charges levied against parking citations.
During calendar year 2008, the State Legislature passed Senate Bill 1407 (Perata). This bill
increased the courthouse construction fund fee and re-established a prior fee for a similar
courthouse purpose. This surcharge, if not recovered, would directly result in reduced revenue to
the General Fund.
Stormwater Utility Services
For Fiscal Year 2009-10, staff recommends the fee remain unchanged at $24 per Drainage
Residential Unit (DRU). The fee is based on the cost of providing the services required under
the National Pollution Discharge Elimination System (NPDES) permit, which is estimated at
$2,467,002 per year.
The Federal Clean Water Act sets forth specific requirements which the City must comply with
on an annual basis. These requirements are provided in the NPDES permit issued by the
California Regional Water Quality Control Board. In order to fund the services needed and
comply with the federally mandated program, the City adopted Ordinance No. 94-7, enacting
Chapter 15.50 of the Santa Clarita Municipal Code (SCMC), Storm Drainage Utility Enterprise
Fund, including the Storm Drainage Pollution Abatement Charge. The charge was originally
enacted in 1994; however, in compliance with the Government Code, it is reaffirmed each year.
All existing development -related fees will go into effect January 1, 2010, and all other fees will
go into effect July 1, 2009.

FISCAL IMPACT
It is estimated that if adopted and implemented, the proposed schedule of fees and charges for
services will result in additional annual revenue of approximately $783,400. The revenues have
not been factored into the Fiscal Year 2009/10 budget. Revenues will be reviewed at midyear,
and any appropriate adjustments will be recommended at that time.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA CLARITA, CALIFORNIA
ESTABLISHING A SCHEDULE OF FEES AND
CHARGES FOR CITY SERVICES
WHEREAS, the City of Santa Clarita has conducted an extensive and exhaustive
analysis of its services, the costs reasonably borne of providing those services, the beneficiaries
of those services, and the revenues produced by those paying fees and charges for special
services; and
WHEREAS, the City wishes to comply with both the letter and the spirit of Article
XIIIB of the California Constitution and limit the growth of taxes; and
WHEREAS, the City desires to establish a policy of recovering the full costs
reasonably borne of providing special services of a voluntary and limited nature, such that
general taxes are not diverted from general services of a broad nature and thereby utilized to
subsidize unfairly and inequitable such special services; and
WHEREAS, heretofore the City Council adopted Ordinance 90-17 on the 10th day of
July 1990, establishing its policy as to the recovery of costs and more particularly the percentage
of costs reasonably borne to be recovered from users of City services and directing staff as to the
methodology for implementing said Ordinance as codified in Chapter 3.32 of the Santa Clarita
Municipal Code; and
WHEREAS, pursuant to Government Code Section 66016, the specific fees to be
charged for services must be adopted by the City Council by Ordinance or Resolution, after
providing notice and holding a public hearing; and
WHEREAS, notice of public hearing has been provided per Government Code Section
6062a, oral and written presentations made and received, and the required public hearing held;
and
WHEREAS, a schedule of City service fees and charges to be paid by those requesting
such special services need to be adopted so that the City might carry into effect its policies; and
WHEREAS, it is the intention of the City Council to develop a revised schedule of fees
and charges based on the City budgeted and projected costs reasonably borne for the fiscal year
beginning, July 1, 2009; and
WHEREAS, pursuant to the California Government, Code Section 6062a, a general
explanation of the hereinafter contained schedule of fees and charges has been published as
required; and

WHEREAS, all requirements of California Government Code Sections 66016-66018
are hereby found to have been complied with; and
WHEREAS, the State of California Legislature has imposed certain State surcharges
on parking violations, including an additional four dollars and fifty cents ($4.50) for courthouse
construction through the passage of SB 1407, effective January 1, 2009; and
WHEREAS, it is equitable that this new surcharge, and any future federal, state, or
county surcharges on parking citations be added to the total fee, as reflected in attached Exhibit
C, so that the City remains revenue neutral.
NOW, THEREFORE, the City Council of the City of Santa Clarita does hereby resolve
as follows:
SECTION 1: Fee Schedule Adoption. The following schedule of fees and charges, as
outlined in Exhibit A, B, and C, are hereby directed to be computed by and applied by the
various City departments and collected by the City's Administrative Services Department for the
herein listed special services when provided by the City or its designated contractors.
SECTION 2: Separate Fee for Each Process. All fees set by this Resolution are for
each identified process; additional fees shall be required for each additional process or service
that is requested or required. Where fees are indicated on a per-unit of measurement basis, the
fee is for each identified unit or portion thereof within the indicated ranges of such units.
A. Added Fees and Refunds: Where additional fees need to be charged and collected
for completed staff work, or where a refund of excess deposited monies is due,
and where such charge or refund is ten dollars ($10) or less, a charge or refund
need not be made, pursuant to California Government Code Sections 29373.1 and
29375.1 and amendments thereto.
B. Defining and Timing of Fee Schedule: Definitions regarding and the timing of the
implementation of the hereinafter enumerated fee schedules shall be as stipulated
in Chapter 3.32 of the Santa Clarita Municipal Code.
SECTION 3: New Fees. Any fees for new services established throughout the year
shall be incorporated into the City's fee structure and collected with recovery percent consistent
with similar services.
SECTION 4: Interpretations. This Resolution may be interpreted by the several City
Department Heads in consultation with the City Manager. Should there be a conflict between
two fees, the lower in dollar amount of the two shall be applied.
C. Intent. It is the intention of the City Council to review the fees and charges as
determined and set out herein, based on the City's next Annual Budget and all of

the City's costs reasonably borne as established at that time and, if warranted, to
revise such fees and charges based thereon.
SECTION 5: Constitutionality. If any portion of this Resolution is declared invalid or
unconstitutional, then it is the intention of the City Council to have passed the entire Resolution
and all its component parts, and all other sections of this Resolution shall remain in full force and
effect.
SECTION 6: Repealer. All resolutions and other actions of the City Council in
conflict with the contents of this Resolution are hereby repealed.
SECTION 7. Effective Date. This Resolution shall go into full force and effect
immediately but shall be subject to the terms and conditions of Chapter 3.32 of the Santa Clarita
Municipal Code. Development related fees will go into effect January 1, 2010, while all other
fees will go into effect on July 1, 2009.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA CLARITA, CALIFORNIA,
ESTABLISHING FEES AND CHARGES FOR
STORM DRAINAGE UTILITY SERVICES
WHEREAS, the City of Santa Clarita has had a study conducted by an outside consultant
of the options available for funding the City's storm drainage program in light of the National
Pollutant Discharge Elimination System (NPDES) permit issued to the City by the California
Regional Water Quality Control Board;
WHEREAS, the Consultant's report identifies a need for average annual expenditures to
meet the NPDES permit requirements of $2,467,002;
WHEREAS, funds in this amount are not available to the City without drastically
curtailing City services for parks, public safety, and other vital public services;
WHEREAS, the Consultant's report indicated the feasibility and equity of funding the
City's storm drainage program by the formation of a storm drainage utility supported by user
charges against all property in the City;
WHEREAS, the City Council, after careful study of the Consultant's report, did hold
hearings as required by Government Code Section 66018 and did, after due process, adopt
Ordinance No. 94-7, establishing the storm drainage activity of the City as a utility enterprise as
Chapter 15.50 of the SCMC;
WHEREAS, Section 15.50.040 of the SCMC directs that the user charges for storm
drainage service be enacted by City Council resolution;
WHEREAS, the City Council intends that storm drainage user charges be in effect for
fiscal year 2009-2010;
WHEREAS, the City Council desires to have the storm drainage user charge included on
the 2009-2010 Los Angeles County property tax statement;
WHEREAS, pursuant to Government Code Section 54354.5, the specific fees to be
charged for services must be adopted by the City Council by resolution;
WHEREAS, all applicable requirements of California Government Code Section 54354.5
are hereby found to have been complied with;
WHEREAS, the City intends by the enactment of the fees and charges set forth herein to
fund compliance with the stormwater NPDES requirements of the Federal Clean Water Act
therefore, the storm drainage user charge shall herein and henceforth be known as the "Storm
Wi
Drainage Pollution Abatement Charge;"
WHEREAS, the charges proposed herein are not discriminatory or excessive and comply
with the provisions of the State Revenue Bond Law of 1941 (Government Code Section 54300 et
seq.) and the laws of the State of California.
NOW THEREFORE, the City Council of the City of Santa Clarita does hereby resolve as
follows:
SECTION 1: Storm Drainage Pollution Abatement Charge Adopted. A storm drainage
pollution abatement charge shall be billed to all parcels of property in the City in accordance with
the computation formulas set forth in this resolution.
SECTION 2: Definitions. In addition to the definitions set forth in SCMC, Section
15.50.020, incorporated herein by reference, the following definitions of terms shall apply:
A. "Base Charge." The annual storm drainage pollution abatement charge to be paid by
the average single-family residential parcel, hereinafter known as the Equivalent Drainage
Residential Unit (1 DRU).
B. "Basic Assessment Unit." The Equivalent Drainage Residential Unit is the Basic
Assessment Unit for purposes of computing the Storm Drainage Pollution Abatement Charge for
each parcel in the City. The Equivalent Drainage Residential Unit is defined as an impervious
area per parcel of 2,777 square feet.
SECTION 3: Computation of User Charges. All properties in the City are assumed to be
responsible for paying their fair and equitable share of the cost of storm drainage pollution
abatement based on the following formulas and computations:
A. _DRU Computation. The DRU on a parcel shall be computed using the following
formula:
DRU Count = [(Parcel Area in Square Feet) x (Parcel Runoff Factor)] / 2777
B. Parcel Area. The gross area of each parcel shall be determined from the data contained
in the records of the Los Angeles County Assessor, by direct measurement, or by such other
means as the City Engineer may select.
C. Parcel Runoff Factor. To the extent practicable the runoff factor for each parcel shall
be the same factor as determined by the Los Angeles County Flood Control District for the type
of land use code listed, for each parcel in the records of the Los Angeles County Assessor,
provided that, the City Engineer shall determine the appropriate runoff factor for all tax exempt
properties or other properties riot listed by the Flood Control District. The City Engineer may
adjust any parcel's runoff factor annually if said runoff factor is determined to not accurately
represent the contribution of a specific parcel to stormwater runoff.
D. User Charges. After annual review of user charges, as specified in Section 10, the

City Council has determined the annual charge per DRU shall remain $24.
E. Computation of User Charge. The annual storm drainage pollution abatement charge
to be billed to each parcel shall be based on the following formula:
1. Annual charge per DRU shall be $24.
2. Annual user charge per parcel shall be:
Annual Charge = $24 x Number of DRU for Parcel.
SECTION 4: Billing of User Charge. The Storm Drainage Pollution Abatement Charge
shall be billed on the property tax statement billed annually by the Los Angeles County Assessor.
The Charge shall appear as a separate listing on the tax statement.
SECTION 5 :.Collection and Enforcement.
A. The Stormwater Pollution Abatement Charge for each parcel shall be collected by and
be payable to the Los Angeles County Treasurer -Tax Collector for the 2008-2009 tax year along
with the general taxes levied for City and County purposes and shall be subject to the same
penalties and enforcement provision relating to general taxes.
B. If any portion of the levy, collection, or expenditure of the Stormwater Pollution
Abatement Charge provided for herein is declared invalid or unconstitutional, the remaining
levy, collection, or expenditure of the Stormwater Pollution Abatement Charge shall not be
affected, but remain in full force and effect.
SECTION 6: User Charge Limitation. The Storm Drainage Pollution Abatement Charge
shall not exceed the reasonable cost of providing the services, facilities, or regulatory activity for
which the fee is charged.
SECTION 7: User and Occupant Responsibility. In order to reduce the burden on the
public regarding stormwater pollution and disposal, each user and occupant is required to assume
responsibility for preventing the discharge of toxic or hazardous substances and other
unnecessary debris from their property to the stormwater drainage system. Violation of this
policy will result in warnings being issued to the applicable property owner or occupant.
Repeated violations will result in a surcharge being made against the offending property owner or
occupant, as determined by the City Engineer, consistent with the reasonable cost to the City of
necessary clean up of such materials.
SECTION 8: Postponement for Senior Citizens and Disabled Citizens. The Storm
Drainage Pollution Abatement Charge shall be postponed for residential Users who possess a
certificate of eligibility issued pursuant to the Senior Citizens and Disabled Citizens Property
Tax Postponement Law (commencing at Revenue and Taxation Code Section 20581) contained
in Part 10.5 of Division 2 of the Revenue and Taxation Code and shall become a lien against the
User's property following the procedure contained in Government Code Section 16182, except
that the lien shall be issued in favor of the City of Santa Clarita instead of the State of California
and shall be executed and administered by the Deputy City Manager, instead of the Controller.

To obtain the postponement provided for in this section, the User must file the certificate of
eligibility with the Deputy City Manager, and the Deputy City Manager shall arrange to have the
User Charge not appear on the tax bill and instead be made a lien against the User's Property.
SECTION 9: Adjustments and Appeals. If the owner of any parcel shall have reason to
feel that the computation of the DRU count for his/her parcel is not correct, that person may file
an appeal with the City Engineer in the manner prescribed by the City Engineer. The City
Engineer will consider all data provided by the appellant and shall render a decision in writing.
The decision of the City Engineer will be final with respect to City action on the appeal.
SECTION 10: Annual Review of User Charges. It is the intention of the City Council to
review the fees and charges as determined and set out herein based on the City's next Annual
Budget and all storm drainage costs and if warranted to revise such fees and charges based
thereon.
SECTION 11: Constitutionality. If any portion of this Resolution is declared invalid or
unconstitutional, then it is the intention of the City Council to have passed the entire resolution
and all of its component parts, and all other sections of this resolution shall remain in full force
and effect.
SECTION 12: Repealer. All resolutions and other actions of the City Council in conflict
with the contents of this resolution are hereby repealed.
SECTION 13: This resolution shall go into full force and effect upon its adoption, and
shall be subject to the terms and conditions of Chapter 15.50 of the SCMC.
