ESTABLISHMENT OF AN ARTS COMMISSION FOR THE CITY
OF SANTA CLARITA

RECOMMENDED ACTION
City Council adopt ordinance titled, AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA CLARITA, CALIFORNIA, ADDING CHAPTER,2.29 TO TITLE 2
(ADMINISTRATION AND PERSONNEL) OF THE SANTA CLARITA MUNICIPAL CODE
CONCERNING THE ESTABLISHMENT OF AN ARTS COMMISSION FOR THE CITY OF
SANTA CLARITA.
BACKGROUND
At the July 14, 2009, City Council meeting, the City Council held a first reading and passed to a
second reading an ordinance that was developed following a report from the Arts Advisory
Committee regarding the mission, goals, and structure for an Arts Commission for the City of
Santa Clarita. The Ordinance was developed by staff, based on the direction of the City Council,
with the following as its organizing principles:
• The Arts Commission's mission and goals shall be based on those developed by the Arts
Advisory Committee, but shall be reviewed and formalized by the Arts Commission once it
has been established.
The Commission shall be equal to the Parks, Recreation, and Community Services
Commission in terms of number of members (5), amount of stipend (currently $133.67 per
Commissioner, per meeting), and selection process.

• All Commission members will be residents of the City of Santa Clarita.
• The backgrounds and qualifications of the Commission members shall be unrestricted and at
the discretion of the City Council.
• The Commission shall meet once a month, on the third Thursday of the month, and shall,
when needed, hold an additional meeting, with a maximum of two meetings per month.
• The public will be encouraged to utilize the Arts Commission as another opportunity to
participate in their local government.
• The Arts Advisory Committee will disband once the Arts Commission has been established.
The proposed new ordinance language to be included under Title 2 (ADMINISTRATION AND
PERSONNEL) is underlined and as follows:

2.29.010 Arts Commission Established.
There shall be and there is hereby established a commission to be known and designated as the
Arts Commission. This Commission shall formulate, subject to City Council direction and
approval, an arts program for the City of Santa Clarita.
2.29.015 Definitions.
For the purposes of this chapter, the following terms shall have the following meanings, unless
the language of the provision clearly indicates some other meaning_
"City" means the City of Santa Clarita.
"Cit ger" means the City Manager or Interim City Manager of the City of Santa Clarita.
"Commission" means the Arts Commission of the City of Santa Clarita.
"Council" or "City Council" means the City Council of the City of Santa Clarita.
"Department" means the Parks, Recreation, and Community Services Department of the City
of Santa Clarita.
"Shall" signifies a mandator_

Regular meetings of the Arts Commission shall be held on the third Thursday of each calendar
month at an hour set by the Commission. Regular meetings may be adjourned by public
announcement to a specific date, and any such adjourned meeting shall be deemed a reg lar
meeting. Meeting dates may be changed by resolution adopted by the Commission and approved
by the City Council. The Commission shall further determine and provide in its rules and
regulations for any special meetings which shall be noticed and an agenda provided as required
by State law and local ordinance.
2.29.040 Absence from Meetings.
Notwithstanding an other of this code, any Commissioner who absents himself
from any three (3) consecutive regular meetings of the Commission, unless excused from
attendance by consent of such Commission expressed by action recorded in its minutes, or who is
absent without such absence being excused of record, from a total of five (5) regular meetings of
the Commission in any six (6) month period, shall thereby automatically forfeit his or her
position as a member of the Commission. In such case, the name of such Commissioner shall be
automatically removed from the membership of said Commission immediately after the
adjournment of any such third consecutive meeting or of any such fifth meeting in a six (6)
month period, as the case may be, at which the Commissioner has not appeared. The Chair of the
Commission shall promptly notify both the City Council and the person so ceasing to be a
Commissioner, of the action and of the fact of the vacancy. Upon such notification, the City
Council shall, within a reasonable time, appoint a successor for the remainder of the term of such
member.
2.29.050 Removal of Members.
Notwithstanding any provision of this chapter to the contrary, any member of the Commission
may be removed from office at any time, with or without cause, by the affirmative vote of at least
three (3) members of the City Council.
2.29.060 Duties.
The Commission shall have the power and duty, except as otherwise provided by law to:
A. Advise the City Council and the Director of Parks, Recreation, and Community Services,
or City Manager, in all matters pertaining to arts programming and public art, and to cooperate
with other governmental agencies and civic juoul2s in the advancement of sound arts
development and arts planning and programming_
B. Formulate general policies on the arts for approval by the City Council.
C. Advise the City Council, with the Director of Parks, Recreation, and Community
Services, or City Manager, on development of arts events, facilities, programs, and improvement
of arts services.
D. Make periodic inventories of arts services that exist or may be needed; interpret and
convey the needs of the public to the City Council, and to the Director of Parks, Recreation, and
Community Services, or City Manager.
E. Aid in coordinating arts services with programs and revenue enhancement of other
governmental agencies and voluntary organizations.
F. Interpret the policies and functions of the Parks, Recreation, and Community Services
Department for the public.

G. Advise the Director of Parks, Recreation, and Community Services, or the City Manager,
in the preparation of the annual budget of the Department and the preparation of a long-range arts
program plan.
2.29.070 Records.
The Commission shall cause proper records to be kept of all its official acts and proceedings
and shall make reports to the City Council.
2.29.080 Organization.
The Commission shall elect a Chair and a Vice -Chair from among its members, each for a
term of one year, at its first regular meeting after July 31 of each year. The Commission may
appoint such other officers as may be necessary for the administration of its business, at the same
time and for one-year terms. The additional officers shall enter in the duties of their office at
their first regular meetingafter fter appointment. The Commission shall adopt rules and regulations
for the transaction of its business and shall keep a record of all its minutes, resolutions, actions,
findings and determinations.
2.29.090 Compensation and Expenses.
Each member of the Arts Commission shall receive compensation, at a rate established from
time -to -time by resolution of the City Council. Each meeting of the Arts Commission attended
by such member is not to exceed a total compensation amount, established from time -to -time by
resolution of the City Council, in any one month. Such compensation shall be paid on the first
payroll payment date following the end of each calendar month. The Chair, Vice -Chair, or other
appointed officer of the Arts Commission shall submit to the City Clerk at the end of each
calendar month a statement showing the number of meetings of the Arts Commission attended by
each member during such month. No additional compensation shall be paid for expenses
incurred by the members of the Arts Commission in the performance of their duties, except that
City Council may from time -to -time authorize, in advance, expenditures for attendance at
seminars, institutes, or other meetings which the City Council finds to be beneficial to the
Commissioners in the performance of their duties, and in the best interest of the City. Claims for
such expenses shall be filed with the City anager and shall be subject to audit and approval by
the City Council.

FISCAL IMPACT
City Council approved funding for Arts Commission stipends at the July 14, 2009, Council
meeting.

2.29.020 Members.

the City of Santa Clarita and shall be appointed by, and serve at the pleasure of, the City Council,
pursuant to the procedure and terms set forth by resolution of the City Council.
2.29.030 Regular Meetings.
Regular meetings of the Arts Commission shall be held on the third Thursday of each calendar
month at an hour set by the Commission. Regular meetings may be adjourned by public
announcement to a specific date, and any such adjourned meeting shall be deemed a regular
meeting. Meeting dates may be changed by resolution adopted by the Commission and approved
by the City Council. The Commission shall further determine and provide in its rules and
regulations for any special meetings which shall be noticed and an agenda provided as required
by State law and local ordinance.
2.29.040 Absence from Meetings.
Notwithstanding any other provision of this code, any Commissioner who absents himself
from any three (3) consecutive regular meetings of the Commission, unless excused from
attendance by consent of such Commission expressed by action recorded in its minutes, or who is
absent without such absence being excused of record, from a total of five (5) regular meetings of
the Commission in any six (6) month period, shall thereby automatically forfeit his or her
position as a member of the Commission. In such case, the name of such Commissioner shall be
automatically removed from the membership of said Commission immediately after the
adjournment of any such third consecutive meeting or of any such fifth meeting in a six (6)
month period, as the case may be, at which the Commissioner has not appeared. The Chair of the
Commission shall promptly notify both the City Council and the person so ceasing to be a
Commissioner, of the action and of the fact of the vacancy. Upon such notification, the City
Council shall, within a reasonable time, appoint a successor for the remainder of the term of such
member.
2.29.050 Removal of Members.
Notwithstanding any provision of this chapter to the contrary, any member of the Commission

cause the same to be published as required by law.
