HomeMy WebLinkAbout2009-09-08 - AGENDA REPORTS - MC 09 073 ANNEX LAFCO (3)Agenda Item: CITY OF SANTA CLARITA AGENDA REPORT PUBLIC HEARING I City Manager Approval: Item to be presented by: DATE: September 8, 2009 SUBJECT: MASTER CASE 09-073, CRYSTAL SPRINGS ANNEXATION — CONSIDERATION OF GENERAL PLAN AMENDMENT 09-004, PREZONE 09-003, AND REQUEST FOR AUTHORIZATION TO SUBMIT AN APPLICATION FOR ANNEXATION TO THE LOCAL AGENCY FORMATION COMMISSION (LAFCO) DEPARTMENT: Community Development RECOMMENDED ACTION City Council open the public hearing and continue it to a date uncertain, to allow City staff to host a meeting with the Crystal Springs community in order to provide information regarding annexation and to answer any questions the community may have. BACKGROUND Over the past few years, residents of the proposed annexation area have expressed their interest in annexing their community into the City of Santa Clarita. In February 2009, the Sand Canyon Homeowners' Association made a request to the City of Santa Clarita to proceed with the initial steps to pursue annexation of the Crystal Springs and Oak Spring Canyon neighborhoods. In April 2009, City staff conducted an annexation survey of the project area to determine the overall level of support for annexation. Survey cards were mailed to 127 property owners which included the Crystal Springs neighborhood as well as the Oak Spring Canyon neighborhood. Of those who were surveyed, 49 property owners responded. In the Crystal Springs neighborhood, 3 T out of 42 property owners (74%) who responded to the survey supported annexation, eight were not in support of annexation (19%) and three requested additional information (7%). In the Oak Spring Canyon neighborhood, all seven surveys that were submitted were not in support of annexation. APPROVED Following a meeting on July 16, 2009 between the City and the Oak Spring community, it was decided that the Oak Spring Canyon neighborhood not be included in the project description. The exclusion of the Oak Spring Canyon neighborhood from the proposed annexation eliminates the need for a Sphere of Influence Amendment. At the Planning Commission meeting of July 21, 2009, the Planning Commission conducted a public hearing on the proposed project, as revised, and in a 5-0 vote, recommended to the City Council that it approve- the General Plan Amendment and Prezone for the *Crystal Springs neighborhood for the purposes of annexation. Since notification of the September 8, 2009 City Council meeting and as of the writing of this report, 28 letters opposing the proposed annexation have been submitted by residents within the project area. These letters are included in the reading file. These letters cite concerns regarding process, taxes, and fees. As a result, staff is requesting this matter be continued to allow time for the City to hold a community meeting. ALTERNATIVE ACTIONS Other actions as detennined by the City Council. My husband and I purchased our home in 2002 and chose the property for its beauty, acreage and zoning; we were well informed that the property was unincorporated, zoned "Light Agricultural" within the County of Los Angeles —an attractive feature to us. We opposed to annexation. Because my husband was an USAF test pilot for 21+ years, we have bought and sold many homes as a result of numerous military -related transfers. As astute ci homebuyers, we researched the true costs assoated with living within and outside City boundaries and chose our Sand Canyon home accordingly. Aside from the general opposition we have to paying higher taxes and increasing fees and any future interference the City may impose: upon our land use rights when re -zoning our property after annexation, what honestly concerns me most in reviewing the annexation proposal is the nagging question of whether or not our rights as homeowners have been ignored in the initial phase of this issue and its proceedings. While I truly value the hard work put forth by the Sand Canyon Homeowners' Association, I'm ceftain the SCHOA is not a legal entity authorized to have requested City annexation on my behalf as a property owner. Furthermore, I was never polled by SCHOA about my opinion on annexation, there was no vote taken befiore a request was submitted and I can find nothing regarding this request in any email, annual meeting nates or newsletter disseminated by the SCHOA. In fact, it wasn't until I read this sentence in Mr. James Chow's staff report, "In February 2009, the Sand Canyon Homeowners' Association made a request to the City of Santa Ciar'ita to proceed with I he initial steps to pursue annexation..," that I realized such. a request had been made. Although I have attended SCHOA annual meetings in past years and was in. attendance at the February 2009 annual meeting, I was never under the impression nor informed that the SCHOA Board was taking it upon itself to forrnatly request annexation for my property. 1 read with great interest a recent "Signal" article regarding Page f of 3 Page 2 of 3 the proposed Fair Oaks annexation and the Fair Oaks HOA vote that was taken among all of its affected homeowners. Where was our vote prior to that letter written by the SCHOA in February? What, exactly, is the City's policy regarding annexation requests? Although the City mailed a survey card with an outdated annexation brochure last April, a majority of the 123 households did not respond; therefore, it cannot be said that the majority of homeowners was in favor of annexation as a result of that one survey. We currently enjoy municipal services provided by Los Angeles County at less cost, including the stupendous protection provided by the LA County Fire and Sheriffs Departments. I can also note that our expenditures in seeking County permits were far less when making six -figure $$ improvements to our property than had we been living within City boundaries. I find it interesting that the City Planning Commission report states that the annexation area "will experience an increase in police patrols and response time due to the City's increased police presence." How is this even possible? I appreciate living in close proximity to the family-oriented community that the City of Santa Clarita strives to create, but in purchasing our property in Sand Canyon, we chose to live in an unincorporated area. I can also appreciate the efforts and funds the City has put forth in fighting the CEMEX mine project, but that fight has also been fought by the official we elected, Congressman Buck McKeon, and many other residents of LA County. That argument, brought forth by a recent "pro -annexation" email distributed by the SCHOA Board in response to an anti -annexation mailing, has nothinto do with whether or not my property should be annexed. I have long admired the strong relationship forged by the SCHOA organization with the City, made evident through the continued efforts by the SCHOA to preserve the rural "charm" that all Sand Canyon residents treasure and to maintain the "Special Standards" District that was mentioned by the recent email distributed by the SCHOA Board. This hard-working relationship is necessary, however, due to the very fact that so .much of Sand Canyon resides within Gity boundaries. If annexed and living in a "Special Standards" District, I will have to pay for the streetlights, landscape maintenance districts and many other services that don't even apply to my property! If annexed, I have Rifle confidence my vote in City elections would ewer be of impact versus the vote of smaller property owners and renters who make up the majority of Santa Clarita voters and whose issues and perspective differ so dramatically from my own (as a resident in a "Special Standards" District). The storm water fee measure is a prime example; with 86 percent of homes (those sitting on less than an acre) to receive an initial decrease in storm water fees, the City anticipates the measure to pass. As an annexed homeowner whose property sits on more than one acre, I would have to actually begin paying storm water fees and I'd have to pay more than the Page 3of3 majority of City homeowners. With all due respect to the. City of Santa Ciarita, I prefer to live in the unincorporated area I deemed valuable- at the time of our home purchase and do not seek annexation by the City. I strongly encourage the City Council to consider the rights of the homeowners in the affected area and take additional steps to ensure a democratic majority is actually in favor of the proposed annexation before proceeding. My primary reasons for opposing annexation are listed below, however, I mike special note here that I strongly object to the process by which the City has Pursued this annexation, in that; (a) The City initiated this annexation based on a request by a non-resident entity (Sand. Canyon Homeowners Association), that does not legally represent any affected homeowner, never surveyed the affected homeowners as to their interest in annexation, and as far as I know, provided no showing to the City of substantial homeowner support for annexation at the time of the request. Yet the City honored that request and started the annexation process. I am shocked to find myself in a situation where a non-residentprivate party such as SCHQA with no legal standing with respect to the affected homeowners or their monerty, has the right to nominate our area for annexation, and instigate the annexation process by the City without any substantiation that it represented the desires of the affected homeowners. The proposed annexation and rezoning is a 'taking' of our property rights by the City and it should not have been initiated at the request of an outside entity that evidently desires the annexation for its own political purposes. (b) The City is pursuing this annexation based on less than majority support of the homeowners — only 30% in fact - based on a survey that the Planning Department conducted when the only information regarding annexation Provided by the City was 2 paae.brochure, which was outdated and incomulete at the time of the survey and therefore materially misleading to homeowners (see detail in Item 3 below). This makes the survey results suspect at best and they should not be relied on as an accurate reflection of homeowner support. Further, although the brochure was subsequently partially updated, taxes have recently changed again, and the brochure is .c, .- T. :> l f;AAF-Rte.-nnH City Council — Crystal Springs Annexation - Master Case 09-073 8/28/2009 Page 2 now significantly understates the taxes that are likely to be applicable to most of our homeowners, especially those with large lots. It is unfair for the City to provide incorrect and misleading to homeowners as to the costs and other effects of annexation, when most homeowners do not have the time or resources to research such effects and find the correct information. This approach by the City is an apt example of why many of us do not want to be in the City, exposed to this kind of aggressive and unfair governmental action that threatens to diminish our property rights and increase our tax burden. My primary reasons for, opposing annexation: 1. City Takes and Fees: My taxes will increase substantially if my property is annexed; l will be paying hundreds of dollars more per year, oven at current tax rates, for NO additional services that I need or that will benefit my property. My expected taxes as City vs, County resident: Annexation will cost me $204¢ more per year (at 2009 tax levels) over what I pay to the County, and this extra cost will not benefit my property value or my lifestyle. In addition, I expect my taxes as a City property owner will increase much faster than as a County owner, because it is much easier for the City to get voter approval for new taxes, especially using mail in ballots which circumvents the need to obtain 213 voter approval. Zoning Change. I object to the zoning change proposed by the City as I do not want my zoning changed from its current Light Agriculture designation which is in keeping with the rural nature of our neighborhood, and may include valuable property and use rights that will be lost under the City's proposed rezoning. If that occurs, I would consider that a 'taking' of my property by the City without due process because of the flawed and unfair annexation process used by the City as described above. 3. City Intrusionfinvoivement in our Neighborhood. I moved to the Crystal Springs area to be in a rural atmosphere OUTSIDE of the city. I do not want any City involvement in our neighborhood, and I do not want to be involved in City issues, politics or problems. There is no benefit to my property, our neighborhood or our lifestyle to be part of the City — in fact, it appears that it would only cost me more in taxes and subject me to more unwanted governmental intrusion and bureaucracy. Our neighborhood lifestyle and level of municipal services is perfectly fine under County governance and in keeping with our way of life. Annexation would also make us vulnerable to the City imposing changes to our neighborhood and rural surroundings. Arguments that we would be protected by the Sand Canyon Special District or City zoning doesn't recognize that all those laws can be changed or removed at any time by the City government, if it decides that it is "in the best interests" of the City or the majority of City residents. Our small group of homeowners will never win any disagreement with the City over such changes, and we are much better off being outside the reach of the City for that reason. 4. Misleading and Incomplete Information Provided to Homeowners at Time of Survty: At the time that the Planning Dept. surveyed homeowners on the proposed annexation, the City's annexation brochure (the only information provided to homeowners by the City regarding annexation) had stated that a "typical residence'' can save "about $130 annually" through annexation, per the following table: This was incomplete and misleading information because the brochure did not explain the following: a.ra • .i � ^ • Cfil Gfii�7—Q7—t'li'1H Ci V Fees County Fees Streetli htin $50 $5 Stormwater $24 $0 Utility User Tax $0 $200 Total $74 $205 This was incomplete and misleading information because the brochure did not explain the following: a.ra • .i � ^ • Cfil Gfii�7—Q7—t'li'1H City Council — Crystal Springs Annexation - Master Case 09-073 8128/2009 Page 4 Streetlighting -- The City fee was understated as being $50 when it is $56. My county tax bill does not include a Streetlighting tax so I question whether the $5 County fee is even validly included in this table. Stormwater --- At the time of the survey, the $24 amount for City stormwater fees was only applicable to lot of 14,000 sq.ft. or smaller, and larger lots were charged an additional $0.16 per 1,000 sq -ft. This isn't explained in the brochure, so the $24 amount substantially understates the tax for larger lots, and therefore is misleading, Utility User Tax - The brochure did not explain that the $200 County tee is calculated based on household utility expenses of $4,000 a year, taxed at a 5% rate, so that if the readers utility expenses are less, his/her County tax cost would be less than $200. Also, the 5% tax rate was incorrect: at the time of the survey the effective rate was 4.5%, thus the $200 is overstated for that reason as well. Open Space Tax - The brochure did not include this $26/year tax that was in effect at the time of the survey, tRMD - The brochure did not include the $57/year LIVID tax that was in effect at the time of the survey. If you compare the table above with my table in Item 1, you can see how misleading the brochure was as the actual tax effects of annexation. Even though the brochure was partially updated after the survey, the survey results were already tainted by the incorrect information, and should not be relied on as accurately reflecting support for annexation. The current brochure (as of the date hereof) that was updated by the City after the survey, still does not fully explain how each tax is calculated and therefore readers cannot determine even the approximate tax for their parcel, which can be significantly more for larger parcels. The recent Stormwater fee change, likely to be passed and would significantly affect our area homeowners, is not mentioned in the current brochure, which is also misleading to homeowners who would rely on it. 5. Non-resident Private Party as Instigator of the Annexation: According to the Planning Department, this annexation was initiated by the Sand Canyon HOA which is not a resident of the annexation area, and is not the legal representative of any resident of the annexation area. The City Council is aware that the Sand Canyon HOA is not the legal "Homeowners Association", as recognized under California law, for any of the homes in the annexation area. The Sand Canyon HOA is a voluntary -membership community organization with membership from City Council — Crystal Springs Annexation - Master Case 09-073. 8/28/2009 Page 5 throughout the entire Sand Canyon area — it has no special relation to the annexation area and does not represent me as a homeowner in any way. Further, SCHOA did not survey affected homeowners orr their support for annexation, or even inform them of its plan to request that the City annex our neighborhood, which [would have strongly protested. I do not understand how Sand Canyon HOA has standing to instigate this process that could have substantial deleterious effects on the affected homeowners' property rights and tax liability. Even now, SCHOA is promoting to homeowners via email that there will be no increase in taxes or other undesirable effects of annexation, when I do not see how they can be sure that that is the case for every homeowner, especially given the huge stormwater tax increase that will affect some properties. I question the legality this entire situation, from the SCHOA requesting annexation when i# is not a resident or legal representative of any residents of the annexation area, to the City relying on that request to pursue this annexation. 5. Less than Majority Support of Affected Homeowners: Of the 105 properties surveyed by the City for interest in annexation, only 31 returned cards expressing support (63 cards were not returned, 8 were against, and 3 requested additional information). Therefore, the City's pursuit of annexation at this point is based on only 30% support of the affected homeowners, and, as described above, the City still has not provided full and accurate information to any of the homeowners regarding the actual potential economic impact of annexation. I think it is unwise and unfair for the City to promote this process with minority support and such incomplete and misleading disclosure to homeowners. For the reasons stated above, I am very concerned that the City has not acted reasonably or fairly in conducting this annexation process, and I urge the City Council to terminate this annexation effort at this point, without forwarding the application to LAFCO.
