FREMONT COURT) — APPROVAL OF PARCEL MAP

RECOMMENDED ACTION
1. City Council approve Parcel Map 69672 (Commercial condominiums — Fremont Court).
2. Make findings as follows: (a) that this project is consistent with the provisions of Sections
66424, 66427, 66474, and 66474.1 of the Subdivision Map Act and should be approved, and
(b) that this proposed subdivision, together with the provisions for this design and
improvement, is consistent with the General Plan required by Article 5 (commencing with
Section 65300) of Chapter 3 of Division 1 of the Government Code, or any specific plan
adopted pursuant to Article 8 (commencing with Section 65450) of Chapter 3 of Division 1
of the Government Code.
3. Instruct the Deputy City Manager and Director of Administrative Services to endorse the
Special Assessment Certificate on the face of Parcel Map 69672, which indicates that all
special assessments levied by the City have been paid.
4. Instruct the City Clerk to endorse the Certificate on the face of Parcel Map 69672, which
embodies the approval of said maps and the acceptance of the dedications shown thereon.
Instruct the City Engineer to endorse the Certificate on the' face, of Parcel Map 69672, which
provides for verification of substantial conformance with the Tentative Map and all
provisions of local ordinances and state laws applicable at the time of approval.
BACKGROUND
Tentative Parcel Map 69672 (Commercial condominiums — Fremont Court) was deemed to be in
substantial conformance with the principles and standards required by the Unified Development
APPROWEr,
Code and approved by the Planning Commission on December 18, 2007. The map consisting of
approximately 2.2 acres is located at the southeast end of Fremont Court, 350 feet southeasterly
of Avenue Stanford, and is owned by the Havana Management Group/Fremont I, LLC, a
California Limited Liability Company.
This map is a subdivision of Parcels 24 and 25 of Parcel Map 10622, and is creating one lot with
15 commercial condominium/air space units within three buildings. No new construction is
proposed for this subdivision. Water rights have been secured for the lot. The site is for
commercial purposes only and has no Quimby or Transit impact fee requirements. Bridge and
Thoroughfare fees have been previously satisfied.
The conditions set by the Planning Division staff have been met and the map has been checked to
the satisfaction of the City Engineer and is ready for City Council approval and acceptance of the
dedications.
ALTERNATIVE ACTIONS
Staff has not identified any alternative actions that would conform to requirements set, forth in the
Subdivision Map Act.
FISCAL IMPACT
No new public streets are being dedicated to the City by this map. No impact will be made to the
City's Street Maintenance Budget.
