RECOMMENDED ACTION
City Council approve the plans and specifications and award the construction contract for the
Whites Canyon Road at Soledad Canyon Road Right -Turn Pocket Circulation and Safety
Improvements, Project C3010, to R.C. Becker & Son, Inc., in the amount of $343,222, and
authorize a contingency in the amount $68,644, for a total contract amount not to exceed
$411,866.
2. Award a professional services contract to R.T. Frankian & Associates in an amount not to
exceed $30,000 for material testing, soil testing, and inspection services.
Increase the professional services contract to Willdan Engineering in an amount not to exceed
$20,000 for construction survey, staking services, and engineering support during
construction.
4. Authorize the execution of a utility relocation agreement with Southern California Edison
and any other necessary utility agreements, in an amount not to exceed $15,000.
Authorize the City Manager or designee to execute all documents, subject to City Attorney
approval.
On February 17, 2009, President Barack Obama signed into law the American Recovery and
Reinvestment Act (ARRA) of 2009. The $787 billion federal economic stimulus contains a

combination of spending programs and tax credits consisting of nearly $355 billion for
transportation infrastructure, health care programs, education, housing assistance, and energy
efficiency projects; $144 billion in state and local fiscal relief, and $288 billion in personal and
business tax credits. California's anticipated share will reach $85 billion; a total of $50 billion in
new spending and $35 billion in tax credits.
As specified by the ARRA program, the one-time project funds will be provided to the City via
existing formula allocations. There are very specific eligibility requirements associated with the
project funding for individual projects, and funds may not be used for any other purpose. The
City's share of $5,175,000 of the highway program, a component of the transportation
infrastructure, is based on an existing population per -capita formula and has been allocated in
full by California's Department of Transportation (Caltrans) for five projects within the City.
On April 13, 2009, the City submitted five "Request to Proceed with Construction
Authorization" applications to the California Department of Transportation (Caltrans). These
requests were for the Asphalt Roadway Phase I (M0072), Asphalt Roadway Phase Il (M0073),
Traffic Circulation and Safety Improvements at Newhall Avenue and Sierra Highway (C0034),
Whites Canyon Road at Soledad Canyon Road Right -Turn Pocket Circulation and Safety
Improvements (C3010), and Bridge Rehabilitation (M0074) projects. Caltrans Local Assistance
has reviewed the City's authorization requests and forwarded them to Caltrans headquarters for
final approval and issuance of the authorization to bid the project. Staff has received
authorization on all five projects including the Whites Canyon Road at Soledad Canyon Road
Right -Turn Pocket Circulation and Safety Improvement project.
The Whites Canyon Road at Soledad Canyon Road Right -Turn Pocket Circulation and Safety
Improvements, Project C3010, will enhance the traffic flow through the intersection allowing
through lanes to flow without having to slow for turning traffic, which reduces fuel consumption
and aids driver comfort. This project is a result of requests received from the Canyon Country
area residents and activists.
An invitation to bid was prepared and published three times, July 23, July 26, and July 29, 2009,
and was noticed to the area plan rooms and the City's website. Plans and specifications were also
sent to area plan rooms.
On August 25, 2009, the City's Purchasing Division received the following eight bids for the
project:

The lowest responsive bid was submitted by R.C. Becker & Son, Inc., in the amount of $343,222.

Staff recommends that the project be awarded to R.C. Becker & Son, Inc., the lowest responsive
bidder. R.C. Becker & Son, Inc., possesses the required state contractor's license and is in good
standing with the State Contractor's Board. The Contractor's bid has been reviewed for accuracy
and conformance to the contract documents and was found to be complete.
A Request for Proposal for material testing, soil testing, and inspection services for quality
assurance program was sent to the following companies:

The selection criteria for award of this contract included laboratory certification by Caltrans,
ability to meet project timelines, and proper understanding of the required scope of work. Based
on this selection criteria, staff selected R.T. Frankian & Associates as the most qualified
consultant for this project.
It is recommended that the professional services contract for design services to Willdan
Engineering be increased by $20,000 to cover construction -related services such as construction
survey, staking services, and engineering design support during construction. Willdan
Engineering was selected as a design consultant and awarded the design contract at the
January 22, 2008, City Council meeting.
Adequate funds have been budgeted to provide for independent quality assurance services, labor
compliance services, and miscellaneous project administration costs to complete the project.
ALTERNATIVE ACTIONS
Other action as determined by the City Council.
FISCAL IMPACT
The funds appropriated into Account C3010229-5161.001 during the Fiscal Year 2009-10 budget
process will adequately provide for the anticipated construction costs.
