PUBLIC HEARING DATE: SUBJECT: Agenda Item: CITY OF SANTA CLARITA AGENDA REPORT City Manager Approval Item to be presented by September 8, 2009 Robert Newman ADOPTION OF SEWER CONNECTION FEE FOR SIERRA HIGHWAY DEPARTMENT: Public Works RECOMMENDED ACTION City Council conduct a public hearing and adopt a resolution to establish the sewer connection fee and its associated administrative fee for certain properties near Sierra Highway and Newhall Avenue. BACKGROUND RC Enterprises (Developer) has requested reimbursement from surrounding property owners who will benefit from and connect to the sanitary sewer improvements installed by the developer. The improvements will serve the future demands for sewer utility service for properties within the vicinity of Sierra Highway approximately 1.5 miles to the south of Newhall Avenue and extending'/4 mile north of Dockweiler Drive, herein referred to as Connection Fee Area. Due to the capacity required, two sewer main lines will be installed, one main line south of Newhall Avenue and the other main line north of Newhall Avenue. All new development within the Connection Fee Area will connect to the sewer improvements. Currently, the existing development utilizing septic has the option to participate and connect to the Sierra Highway sewer system. Those properties that lie within 200 feet of the new Sierra Highway sewer line may be required to connect to the new sewer main line if one of the following is initiated by the property owner: • Construction of new building that includes plumbing fixtures. • Additions, remodels, or expansions to the existing building(s) that require a modification to the existing septic system. • Repair or modification of the existing septic system (Section 713.5 of the California Plumbing Code which states: "No permit shall be issued for the installation, alteration, or repair of a.private sewage disposal system, or any part thereof, on any lot for which a connection with a public sewer is available." • If a connection is required for any reason by the Los Angeles County Health Department. Cost estimates provided by the Developer and City staff determined the total project's costs to be $653,658. The Developer has the financial burden of the sewer improvements. In an effort to defray the financial burden, the parcels within the Connection Fee Area that choose to connect to the sewer improvements will pay a connection fee. The fee will be reimbursed to the Developer no later than 30 days from the City's collection of payment from the benefiting property owner(s). To inform property owners of the connection fee, staff mailed a letter and fact sheet to all affected property owners describing the sewer connection fee and information on frequently asked questions in connecting to a sewer line. To date, staff has not received any responses or inquiries from the affected property owners. Determination of Connection Fee Pursuant to Government Code Section 66000 et seq., also known as the Mitigation Fee Act, a connection fee shall not exceed the estimated reasonable costs of providing the service for which the connection fee is imposed. In order to determine each parcel's proportionate share of the sewer project costs, it is important to establish an equivalency connection that provides the relationship from one parcel's utility connection to another parcel in a manner that reasonably reflects each parcel's proportional use of the sewer system. Each parcel within the Connection Fee Area was assigned to a class based on actual or proposed land use, such as a single-family residence, church, subdivision, or other. Each parcel's land use was assigned utilizing Log Angeles County Secured Roll information and other available building and zoning data from City records. After each parcel was classified based on land use, they were then assigned an equivalency ratio. An equivalency ratio is the differential between the average demands of the basic connection class and those of other classes. Single-family residences are assigned to the basic class and the equivalency connection unit (ECU) for this basic class is assigned 1.00. Those parcels not assigned to the basic class were assigned ECUs based on their proportionate demands placed on the system. Industry standards and equivalency factors that have been used by the City in the past were used to assign ECUs to those parcels. Once the basis for the sewer connection fee is determined as well as the cost basis (cost of sewer line) and the demand basis (total number of ECUs), the connection fee per ECU can be calculated. Then the calculated sewer connection fee per ECU is multiplied by the number of ECUs assigned to the parcel. The cost per ECU for the south main line is $90.33 and for the north main line $700.86. ' Additionally, property owners will also be subject to pay an administrative fee of $83.30 per Q request to connect. The connection fee and administrative fee will be annually adjusted by the Consumer Price Index for all urban consumers in Los Angeles -Riverside -Orange County for the preceding fiscal year. The Connection Fee and Administrative Fee will become effective on November 9, 2009, (60 days after adoption). Termination of Fee The sewer connection fee will terminate in 20 years on November 9, 2029, or when payments to the developer total $589,529.31; whichever occurs first. This total reimbursement amount represents the difference between the total project costs less the developer's amount to connect. If 75 percent of the total project cost adjusted by the Consumer Price Index has not been collected by November 9, 2029, the developer has the option to make a written request to the City within 60 days of the original termination date to extend the connection fee for an additional 10 years. Under no circumstances shall the collection and reimbursement of the connection fee to the developer be extended past November 9, 2039. ALTERNATIVE ACTIONS Other direction as determined by the City Council. FISCAL IMPACT There is no fiscal impact to the City for the establishment of the Sierra Highway sewer connection fee. Proposed Sewer Connection Fee The Sierra Highway Sewer Area Connection Fee Report sets forth the total cost of the improvements. If the proposed connection fee and associated administrative fee is approved, beginning November 9, 2009, the City Council may impose the connection fee at any rate or amount that is less than or equal to the net connection fee amount. In subsequent fiscal years beginning with Fiscal Year 2010/2011, the connection fee and administrative fee will be increased each year based upon the greater of the latest Consumer Price Index for the Los Angeles -Orange -Riverside County Area. Sewer Area Connection Fee Report For a detailed description of the boundaries of the proposed connection fee area, the improvements, and the proposed connection fees; please refer to the Sierra Highway Sewer Area Connection Fee Report prepared in connection with the proposed project. Dawson, MMC City Clerk Publish Date: August 25, 2009 2A RESOLUTION 09- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, ESTABLISHING THE SIERRA HIGHWAY SEWER CONNECTION FEE WHEREAS, RC Enterprises (Developer) has oversized a sanitary sewer main line along Sierra Highway approximately 1.5 miles to the south of Newhall Avenue and extending '/4 mile north of Dockweiler Drive, as a condition of approval of development; and WHEREAS, the Developer has requested reimbursement from surrounding property owners who benefit from and choose to connect to the sanitary sewer improvements; and WHEREAS, these sewer improvements are necessary for the health and safety of local residents within the Sierra Highway Sewer Area; and WHEREAS, the Developer has hired a consultant to conduct a fair -share study (Study), which accompanies the staff report, to determine the benefiting property owners' proportionate share of costs for the sewer line based on Equivalency Connection Units (ECUs). The Study describes a Connection Fee and an Administrative Fee; and WHEREAS, the Connection Fee is to reimburse the Developer for costs not attributable to its development project, but for surrounding property owners and future development that benefit from and connect to the oversized sewer line; and WHEREAS, the total construction costs of the sewer line and associated administrative costs is $653,658; and WHEREAS, pursuant to the Mitigation Fee Act, Government Code Section 66016, the Connection Fee and Administrative Fee described in the Study do not exceed the reasonable costs of providing the service. NOW, THEREFORE, the City Council of the City of Santa Clarita does hereby resolve as follows: SECTION 1. Recitals. The above recitals are true and correct. SECTION 2. Connection Fee. Benefiting property owners, within the Sierra Highway Sewer Area, as such area is .defined in the Study, that connect to the sewer line, with the exception of the Developer, shall be required to pay a fee to connect to the sewer main line and an Administrative fee. The amount of the Connection Fee shall be calculated using the appropriate number of ECUs at the time of connection for the proposed project and is payable upon obtaining a lateral sewer permit from Building and Safety. The Connection Fee for the south main line per ECU is $90.33 and for the north main line is $700.86. The Administrative Fee is $83.30 per request to connect. to the sewer line. The Connection Fee and Administrative Fee for the connection to the Sierra Highway sewer line is $76.65 per application and will be subject to annual escalation each fiscal year based on the 0 Consumer Price Index (CPI) for all urban consumers in the Los Angeles -Riverside -Orange County for the December of the preceding fiscal year. The Sierra Highway Sewer Connection. Fee Roll, detailing each parcel's proposed Connection Fee, within the Sierra Highway Sewer Area, is on file with the City Clerk and open for public inspection. Should the assigned ECUs per parcel change as a result of development, a new ECU calculation for that parcel will be performed and the corresponding Connection Fee and its associated Administrative Fee will be calculated and collected. Additionally, if future development results in a number of units that is different from the amount assigned in the report, the sewer connection fee per ECU will be recalculated and proportionally adjusted for each of the new units so that there is no loss in revenue that will be reimbursed to the Developer. SECTION 3. Use of Fee. The proceeds of the Connection Fee shall be used to reimburse the Developer for the costs of sewer improvement. The Developer will be reimbursed no later than thirty days of the City's collection of payment from the benefiting property owners. The proceeds of the administrative fee shall be used to defray the City's administrative costs. SECTION 4. Termination of Fee. The sewer connection fee will terminate in 20 years on November 9, 2029, or when payments to the developer total $589,529.31; whichever occurs first. This total reimbursement amount represents the difference between the total project costs less the developer's amount to connect. Sewer connection fees represent the means by which a new user within an area gains equal footing with the existing users in that area. By paying the sewer connection fee, the newcomer to the sewer system pays for their portion of the capital improvements that have been made in anticipation of their demands on the system. A sewer connection fee attempts to ensure that growth pays their way and is not subsidized by existing sewer utility users within the area. A sewer connection fee is: • A one-time fee imposed on a new connection to the sewer system. • Intended to recover the cost of the capital improvements required to serve the demand in that area. • A mitigation of the impact of the new connection to the sewer system and the existing users. RC Enterprises (the "Developer") is funding the construction of sewer improvements within Sierra Highway ("Connection Fee Ares"), located to the north and south of Newhall Avenue, as described in Section 1.2. The Developer is installing the necessary sewer improvements in order to service the future demands for sewer utility service for properties located in the surrounding area. Since the proposed sewer lines will benefit certain properties along Sierra Highway, the City of Santa Clarita (the "City")is establishing a sewer connection fee to ensure that the future sewer connections to the Sierra Highway sewer system pay their proportionate share of the capital investments made by the Developer. 1.1 Description of Sierra Highway Sewer Connection Fee Area Boundaries The Connection Fee Area includes properties within the vicinity of Sierra Highway, approximately 1.5 miles to the south of Newhall Avenue, and extending '/, mile north of Dockweiler Drive. The boundary limits have been based on the locations of topographic ridge lines surrounding Sierra Highway. 1.2 Establishment of a Connection Fee The following report is structured pursuant to the provisions of Government Code 66000 et seq., also known as the Mitigation Fee Act, and is referred to commonly as "AB 1600" The Mitigation Fee Act requires that a public agency imposing a connection fee to issue findings that demonstrate the following: • The purpose of the fee. • The use of the fee. • The relationship between the use of the connection fee and the types of development on which it is imposed. • The relationship between the public facilities and the type of development on which the connection fee is imposed. • The relationship between the connection fee amount and the cost of the public facilities. These findings are provided in more detail throughout this report. City of Santa Clarita-Sierra Highway Sewer Connection Fee -August 2009 1.3 Purpose of Connection Fee The purpose of the sewer connection fee is to ensure that anticipated development within the Connection Fee Area pays its proportionate share of the project costs. The project costs for the utility improvements are necessary in order to provide sewer service to the properties within the boundaries of the Connection Fee Area. The connection fees will ensure that the users that benefit from the sewer utility improvements pay their proportional share of the total project costs of the sewer improvements provided by the Developer. 1.4 Use of Connection Fee The proceeds from the sewer connection fees will be used to reimburse the Developer for the costs incurred in constructing the needed sewer lines. As properties develop within the Connection Fee Area, a sewer connection fee will be paid in order to defray the financial burden placed upon the Developer as a result of the utility improvements within the Connection Fee Area. 1.5 Relationship between Connection Fee and Project Development Parcels located within the boundaries of the Connection Fee Area will be subject to the sewer connection fee. The sizing of the sewer line improvements has been designed to allow for all benefiting parcels to connect to the proposed system. Parcels that are located outside the boundaries of the Connection Fee Area will not be serviced by the Sierra Highway sewer improvements, and will not be subject to the connection fees established in this report. A list of parcels subject to the sewer connection fee can be found in the section entitled "Sewer Connection Fee Rolf' of this report. 1.6 Relationship between Project Facilities and Type of Development The sewer line improvements have been sized to appropriately meet the demands that parcels within the Connection Fee Area will place on the system. Existing and proposed development throughout the Connection Fee Area has been accounted for in determining the overall size and capacity needs. If anticipated development changes, parcels will be evaluated and handled in accordance with the "Future Subdivisions" section of this report. 1.7 Relationship between the Connection Fee Amount and Project Costs The project costs for the sewer improvements have been spread to each benefiting parcel within the Connection Fee Area based upon their proportionate share of the utility improvements. The basis in assigning the sewer connection fees is more fully described in the "Connection Fee Methodology" section of this report. The calculated sewer connection fees do not exceed the reasonable project costs associated with the Sierra Highway sewer improvements. City of Santa Clarita-Sierra Highway Sewer Connection Fee -August 2009 2 1.8 Description of Improvements and Services The Connection Fee Area sewer improvements are located within Sierra Highway and extend 1800 L.F. to the north, and 1460 L.F. to the south, of Newhall Avenue. The improvements connect properties located in close proximity to Sierra Highway to the existing sewer system within Newhall Avenue. All new development within the Connection Fee Area will connect to the sewer improvements. Currently, there are existing developments utilizing septic and it will be a voluntarily option as to whether or not to participate in, and connect to, the Sierra Highway sewer system. Those properties that lie within 200 feet of the new Sierra Highway sewer line may be required to connect to the new sewer main line. Some of those triggers that would require a sewer connection are listed below: • Construction of a new building on your property that includes plumbing fixtures such as; Guest House, Pool Houses, or Rental Units; • Additions, remodels and/or expansions to the existing buildings that would require a modification to the existing septic system such as adding bedrooms and; • Repair to, or modification of, the existing septic system (Sec 713.5 of the California Plumbing Code which states: "No permit shall be issued for the installation, alteration, or repair of a private sewage disposal system, or any part thereof, on any lot for which a connection with a public sewer is available" • If a connection is required for any reason by the Los Angeles County Health Department 1.9 Connection Fee Trigger As development occurs within the Connection Fee Area, properties will ultimately need to connect to the sewer improvements in order to establish sewer service for the property. Prior to properties within the Connection Fee Area connecting to the sewer system, the sewer connection fee will first need to be paid to the City. The connection fee established in this report must be remitted to the City prior to the issuance of a building permit for the property. With respect to the Sewer Connection Fee assessed to the Developer, the Developer will not be required to remit payment to the City for the connection fee relating to the Developer's properties. While the Developer will not pay a connection fee, the Developer's proportionate share of the connection fee is included in the calculation to ensure that no unfair burden is shifted to future property owners that may connect to the system 2• ESTIMATE OF COSTS 2.1 Project Costs The Developer and the City of Santa Clarita have calculated the project cost of the Sierra Highway sewer improvements and City Fees will total $653,658. A summary of all costs are provided in the following table: Construction Costs -South $335,975 Construction Costs -North $3157270 City Fees $ 21413 TOTAL $653,658 City of Santa Clarita-Sierra Highway Sewer Connection Fee -August 2009 The financial burden of the Sierra Highway sewer improvements is upon the Developer. In order to defray some of the financial burden on the Developer, those users within the Sierra Highway sewer area that connect to the sewer system will pay a sewer connection fee. The sewer connection fee will be used to reimburse the Developer as users connect to the sewer system. This sewer connection fee will ensure that those users that benefit from the sewer improvements are paying their reasonable share of the associated costs of the sewer improvements provided by the Developer. 2.2 Administrative Fee In addition to the sewer connection fee assigned to each user within the area, the City of Santa Clarita will impose a $83.30 administrative fee. This administrative fee will be required at the time connection to the Sierra Highway sewer line is requested. For those parcels within the area that subdivide in the future, the administrative fee will be charged for each request. The $83.30 administrative fee is established for the 2009/10 Fiscal Year. Beginning Fiscal Year 2010/11 and thereafter the administrative fee will be increased annually by the Consumer Price Index for all urban consumers in the Los Angeles -Riverside -Orange County. 3. CONNECTION FEE METHODOLOGY Pursuant to the provisions of the Mitigation Fee Act, Title 7, Division 1, Chapter 7 of the Government Code, a connection fee shall not exceed the estimated reasonable costs of providing the service for which the fee is imposed. Arriving at the amount of the sewer connection fee per parcel within the Connection Fee Area includes the assumption that new connections to the sewer utility system pay their proportionate share of the capital improvement costs required to serve all of the Connection Fee Area's wastewater demands. In order to determine each user's proportionate share of the project costs it is important to establish an equivalency connection unit as it relates from one connection to another in a manner that reasonably reflects each user's proportional use of the Sierra Highway sewer system. 3.1 Assigning Equivalency Connection Units Utilizing Los Angeles County secured roll information, and available zoning data provided by the City of Santa Clarita, each parcel within the Connection Fee Area was identified and assigned to a land use class based on that parcel's current zoning. A parcel's land use refers to the type of development assigned to that parcel, regardless of the nature of the type of existing development that may currently exist on the property. Once the land use for each parcel within the area was assigned, the parcels were then assigned an equivalency ratio. The equivalency ratio is the differential between the average demands of the basic connection class and those of other classes. Single family residences of one Dwelling Unit per acre established the basic class and an equivalency connection unit ("ECU") for the basic class was assigned 1.00 ECU per acre. Those parcels not assigned to the basic class were assigned ECUs based on their proportionate demands placed on the Sierra Highway sewer system. This particular parcel is largely effected by an existing Caltrans slope easement, which significantly decreases the amount of developable area for the property. Once the basis for the sewer connection fee was determined, and ECUs assigned to all parcels within the area, the connection fee per ECU was calculated. The cost basis serves as the numerator of the sewer connection fee computation: It represents the total project cost that is or will be available to serve the Connection Fee Area demands. The demand basis is the denominator of the computation: It represents the total number of ECUs that can be served by the Developer installed sewer improvements. The result is the sewer connection fee per ECU as provided in the tables below: Sierra Highway Sewer Connection Fee Area -South: Total Sierra Highway Sewer Area Project Cost -South $3355975.20 Total City Fees -South $2,153.95 South Sewer Connection Fee per ECU $90.33 Sierra Highway Sewer Area District -North: Total Sierra Highway Sewer Connection Fee Area Cost -North $315,270.00 Total City Fees -North $259.05 Total ECUs 450.20 North Sewer Connection Fee per ECU $700.86 In order to determine each parcel's total sewer connection fee, the sewer connection fee per ECU was multiplied by the total number of ECUs assigned to that parcel. A schedule of the sewer connection fee for each parcel is shown in Section 5 of this report. City of Santa Clarita-Sierra Highway Sewer Connection Fee -August 2009 3.2 Sewer Connection Fee Yearly Escalation The Sierra Highway South sewer connection fee is set at $90.33 per ECU, and $700.86 for the North sewer connection fee, for the 2009/10 Fiscal Year. Beginning Fiscal Year 2010/11 and thereafter, the connection fee will be increased annually by the Consumer Price Index for all urban consumers in the Los Angeles - Riverside -Orange County. The sewer connection fee will be applicable to the parcels identified in this report for a timeframe of twenty (20) years. If 75 percent of the total project cost adjusted by the Consumer Price Index has not been collected by November 9, 2029, the developer has the option to make a written request to the City within 60 days of the original termination date to extend the connection fee for an additional 10 years. Under no circumstances shall the collection and reimbursement of the connection fee to the developer be extended past November 9, 2039. 3.3 Future Subdivisions When a parcel within the Connection Fee Area subdivides, the ECUs assigned to the original parcel will be spread to the newly created parcels based on each parcel's land use. If a parcel within the Sierra Highway sewer area subdivides in a manner that is different from the original land use assigned at the time of establishing the sewer connection fee then that parcel's total ECU assignment will be recalculated. The ECU recalculation will be based upon the new land use classification for each parcel. The total sewer connection fee for each parcel will then be recalculated by multiplying the number of newly assigned ECUs by the sewer connection fee per ECU. Future Unit Reductions Expected land development was based upon maps and information provided and was considered in the connection fee calculations. However, it is possible for future development to result in a number of units that is different from the amount assigned in this report. If future development results in a number of units that is less than what is proposed in this report, the sewer connection fee per ECU will be recalculated and proportionally adjusted for each of the new units so that there is no loss in revenue that will be remitted to the City and reimbursed to the Developer. 3.4 Multiple ECU Assignments In the event a parcel within Connection Fee Area is assigned multiple ECUs and subdivides but does not develop all of the newly created parcels, the parcel owner shall be responsible for paying the sewer connection fee and associated administrative fees for only those parcels that will be connecting to the sewer system. ECUs will be recalculated on all of the newly created parcels in order to determine the total sewer connection fee for each developing parcel and the proposed sewer connection fee for each parcel that remains undeveloped.
