HomeMy WebLinkAbout2009-03-10 - AGENDA REPORTS - STORMDRN TRSFR DEPOSIT (2)CONSENT CALENDAR C1I s SUBJECT: DEPARTMENT: Agenda Item: CITY OF SANTA CLARITA AGENDA REPORT City Manager Approval Item to be presented by: March 10, 2009 Damon Letz DISCONTINUE COLLECTING THE STORMDRAIN TRANSFER DEPOSIT, REMOVE THE STORMDRAIN TRANSFER DEPOSIT FROM CONDITIONS OF PENDING PROJECTS, AND RETURN STORMDRAIN TRANSFER FUNDS HELD ON DEPOSIT Public Works RECOMMENDED ACTION City Council receive this report outlining the City's response to developers' comments during the Development Process Advisory Committee and direct staff to: • Discontinue collecting the Stormdrain Transfer Deposit. • Remove the Stormdrain Transfer Deposit condition from pending projects. • Return Stormdrain Transfer Funds held on deposit by the City. 2. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval. BACKGROUND City staff invited comments regarding the City's development process from developers, engineers, and business owners through the Development Process Advisory Committee. During this process, the group identified the following development requirement as an issue that is difficult to meet. Stormdrain Transfer Deposit - This money is collected by the Development Services Division. Over the past several years, Development Services Division charged a fully refundable deposit up to $100,000. This made the developers responsible for transferring newly constructed APPROVED stormdrains for their project, as well as any untransferred drains to which they connect to the County for maintenance. In today's economic climate, developers are stating that this amount of money is difficult to set aside and not use for their project, as the timeframe for completion of the stormdrain transfer is often years after the money is collected. In order to assist developers, staff believes the elimination of this deposit is good business practice. Therefore, staff recommends eliminating this condition to future projects, remove this condition from current projects, and return funds currently held by the City. Staff does not anticipate the elimination of this deposit will significantly reduce the City's ability to transfer stormdrains to the County. ALTERNATIVE ACTIONS Other action as determined by the City Council. FISCAL IMPACT There is no direct fiscal impact on the General Fund. ATTACHMENTS None .2
