HomeMy WebLinkAbout2009-02-10 - ORDINANCES - ZC 04 006 MC 04 496 (2)ORDINANCE NO. 09-2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, APPROVING ZONE CHANGE 04-006 MASTER CASE 04-496) TO AMEND THE CITY'S ZONING MAP AND CHANGE THE ZONING DESIGNATION OF TWO AREAS FROM RESIDENTIAL LOW (RL) TO PRIVATE EDUCATION (PE) AND FROM PRIVATE EDUCATION (PE) TO RESIDENTIAL MODERATE (RM) ON THE PROJECT SITE, IN THE CITY OF SANTA CLARITA THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. FINDINGS OF FACT. The City Council does hereby make the following findings of fact: a. On December 10, 2004, an entitlement application was filed by The Master's College (the "applicant") with the Community Development Department for Master Case 04-496 on the subject property for The Master's College Master Plan project. The entitlement requests (collectively "Entitlements") included General Plan Amendment 04-009, Zone Change 04-006, Master Plan 07-001, Tentative Tract Map 66503, Conditional Use Permit 04-031, Ridgeline Alteration Permit 07-001, Hillside Review Permit 04-010, Oak Tree Permit 04-050 to develop The Master's College Master Plan project, in the City of Santa Clarita. b. Zone Change 04-004 will change the zoning designation of two areas of the project site from Residential Low (RL) to Private Education (PE) and from PE to Residential Moderate (RM). The zoning will be consistent with the proposed General Plan classification (see Exhibit A, Zoning Boundary Map). c. An Environmental Impact Report (EIR) for The Master's College Master Plan project, State Clearinghouse No. 2006101171, has been prepared, circulated in compliance with the California Environmental Quality Act (CEQA), and certified as required by CEQA. d. On July 1, 2008, July 29, 2008, September 2, 2008, and November 4, 2008, the Planning Commission held duly noticed public hearings on The Master's College Master Plan project. The Planning Commission closed the public hearing on November 4, 2008 and voted 5-0 recommending that the City Council certify the EIR as adequate under CEQA, per Resolution No. P08-21, and that the City Council approve the Entitlements, per Resolution No. P08-22. e. The City Council held a duly noticed public hearing on The Master's College Master Plan project, as revised, on January 13, 2009. At this meeting the City Council received a presentation on The Master's College Master Plan project and Final EIR from staff, received a presentation from the applicant, and received public testimony regarding the project and Final EIR. The City Council received public testimony regarding The Master's College Master Plan Final EIR and adopted all of the necessary approval documents (resolutions, findings of fact, responses to comments, mitigation monitoring and reporting program, conditions of approval, etc.) for certification of The Master's College Master Plan Final EIR and approval of The Master's College Master Plan project. f. On January 13, 2009, the City Council conducted the first reading of an Ordinance for Zone Change 04-006 for The Master's College Master Plan project and passed to second reading on February 10, 2009. g. All public hearings and meetings on The Master's College Master Plan project held by the Planning Commission were at 7:00 p.m. in the City Council Chambers, located at 23920 Valencia Boulevard, City of Santa Clarita. All public hearings and meetings held by the City Council were at 6:00 p.m. in the City Council Chambers, located at 23920 Valencia Boulevard, City of Santa Clarita. All public hearings were advertised in The Signal newspaper and by direct first-class mail to property owners within 1,000 feet of the subject property. In addition, the date and time of the public hearings were posted on the subject property. h. The documents and other materials, which constitute the record of proceedings upon which the decision of the City Council is based, are on file within the Community Development Department and are in the custody of the Director of Community Development. SECTION 2. FINDINGS FOR A ZONE CHANGE. Based on the above findings of fact and recitals and the entire record, including, without limitation, the entire Master's College Master Plan EIR, oral and written testimony and other evidence received at the public hearings held on The Master's College Master Plan project and EIR, reports and other transmittals from City staff to the City Council, and upon studies and investigations made by the Planning Commission and on its behalf, the City Council finds, as follows: a. The proposed change is consistent with the objectives of the City's Unified Development Code, the City's General Plan, and the development policies of the City of Santa Clarita. Following approval of Zone Change 04-006 to the City's Zoning Map, The Master's College Master Plan project is consistent with the zoning designations of Private Education (PE) and Residential Moderate (RM). Furthermore, Section 5.6 (Land Use and Planning) of The Master's College Master Plan EIR contains a detailed analysis documenting the project's consistency with the City's Unified Development Code (UDC), the goals and policies of the City's General Plan and the development policies of the City of Santa Clarita. 4 SECTION 3. The City Council approves the request to re -designate two areas of the project site from Residential Low (RL) to Private Education (PE) and from PE to Residential Moderate (RM). The zoning will be consistent with the proposed General Plan classification (see Exhibit A, Zoning Boundary Map). SECTION 4. This Ordinance shall be in full force and effect thirty (30) days from its passage and adoption. SECTION 5. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law.
