2009-10 ANNUAL OVERLAY AND SLURRY SEAL PROGRAM,
PROJECT M0071 - AWARD CONSTRUCTION CONTRACT

RECOMMENDED ACTION
1. City Council approve the plans and specifications for the 2009-10 Annual Overlay and Slurry
Seal Program, Project M0071.
2. Find the bid of Toro Enterprises, Inc., to be non-responsive and award the construction
contract to Sully -Miller Contracting Company in an amount not to exceed $1,018,577
including contingency.
3. Authorize an additional expenditure in the amount of $77,000 from Expenditure Account
M0071306-5161.001 to Pavement Engineering, Inc., for the annual citywide pavement
inspection and the updates for the Pavement Management System.
4. Authorize the continuance of funds in Account M0071230-5161.001 in the amount of
$408,838.96 from Fiscal Year 2009-10 to Fiscal Year 2010-11.
Authorize the following transfers: $111,972 from the 2010-11 Overlay and Slurry Seal
Program Account M0077230-5161.001 to the 2009-10 Overlay and Slurry Seal Program
Account M0071230-5161.001; and $709,766 from the 2010-11 Overlay and Slurry Seal
Program Account M0077306-5161.001 to the 2009-10 Overlay and Slurry Seal Program
Account M0071306-5161.001.
6. Authorize the City Manager or designee to execute all documents, subject to City Attorney
approval.

BACKGROUND
The Annual Overlay and Slurry Sea] project is an integral part of the City's pavement
management program. Each year, streets are evaluated and identified for the need for asphalt
overlay and slurry seal maintenance treatments. The 2009-10 project will overlay and resurface
streets in various areas of the City (see attached project streets list). This treatment will provide a
smoother ride for traffic, enhance the appearance of the roadway and surrounding area, and
extend the life of the roadway for a minimum of 15 years. This year's project is expected to begin
construction in August 2010 and be complete by the end of October 2010.
Funds requested for the construction of the City's 2009-10 Overlay Program are intended to
make better use of federal funding sources that have become available for the City's 2010-11
Overlay Program. To date, approximately $500,000 has been transferred from this project into
other capital improvement projects to cover eligible work for street paving. Staff is requesting the
transfer of funds from the 2010-11 Overlay Program to make this project budget whole again and
to maximize the amount of streets that can be overlaid within the bid amount. This will allow the
City to meet the needs of residential neighborhoods this summer, where repeated work requests
have been generated. If the requested transfer of funds is not approved, staff will need to
readvertise the project with a considerably reduced scope of work, or not perform the work this
summer, and carry the existing budget forward to add to next year's project budget.
An invitation to bid was prepared, published three times (April 30, May 6, and May 9, 2010), and
noticed to the City's Web site. Plans and specifications were also sent to area plan rooms. Seven
bids were submitted to the City and opened by Purchasing on May 20, 2010. The results of the
bids are shown below:

The basis for awarding this project is the base bid plus any alternates, with a total amount not to
exceed the available project budget. Upon review of the bids, City staff determined that the bid
from the first low bidder, Toro Enterprises, Inc., was incomplete and therefore, deemed
non-responsive. Toro Enterprises, Inc., failed to sign and submit an addendum and their bid
schedule was incomplete. Staff recommends finding the bid of Toro Enterprises, Inc.,
non-responsive and awarding the construction contract to the lowest responsive bidder,
Sully -Miller Contracting Company, who possesses a state contractor's license and is in good
standing with the State Contractor's Board. The bid from Sully -Miller Contracting Company was
reviewed for accuracy and conformance to the contract documents and found to be complete.

As part of the annual street maintenance project, the City also inspects and records the pavement
condition citywide. The City is seeking authorization for Pavement Engineering, Inc., to continue
its inspection and update the City's Pavement Management System. Ten new lane miles were
accepted by the City in 2010 and added to the system. The City is now responsible for the
maintenance of a total of 972 lane miles.
The remaining $135,000 of the project budget will be used for construction management,
materials testing, inspection, survey, labor compliance, staff oversight, and miscellaneous project
administration costs.
ALTERNATIVE ACTIONS
Other action as determined by the City Council.
FISCAL IMPACT
The 2009-10 Overlay Program budget balance is $408,838.96. The recommended actions will
make available a budget of $1,230,577 for the 2009-10 Overlay Program to adequately provide
for all anticipated construction costs. To date, expenditures of $94,500 have been encumbered for
design -related services in Fiscal Year 2009-10.
