City Council accept the completion of the Cross Valley Connector Golden Valley Road Bridge Over the Santa Clara River, Project S4013. 2. Direct the City Clerk to file the attached Notice of Completion. 3. Direct staff to release the retention 35 days after the Notice of Completion is recorded, provided no stop notices have been filed, as provided by law. 4. Authorize payment in the amount of $300,000 from Expenditure Account S4013229-5161.001 to Newhall Land as reimbursement for work completed to expedite the proj ect. 5. Adopt a resolution consenting to a loan of $2,000,000 from Bouquet Canyon Second Access Bridge and Thoroughfare (B&T) Fund to the Bouquet Canyon Bridge and Thoroughfare (B&T) District. 6. Authorize the appropriation of $29,304 from Landscape Maintenance District (LMD) Fund Balance 354 to Expenditure Account S4013354-5161.001. 7. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval. BACKGROUND On December 9, 2008, the City Council awarded the construction contract to C.C. Myers, Inc., to construct the Golden Valley Road Bridge Over the Santa Clara River (GVR Bridge). This project is a vital link of the Cross Valley Connector (CVC), which provides a direct connection between Interstate 5 (I-5) and State Route 14 (SR -14). The GVR Bridge consists of two 1,100 feet long northbound and southbound bridges. Both bridges have three lanes with a Class I trail on the southbound bridge. One of the City's main goals of the GVR Bridge was to complete the remaining gap in the CVC to provide a roadway connection between I-5 and SR -14. The incomplete section of the CVC was made up of the City's GVR Bridge project and the section of Newhall Ranch Road from Santa Clarita Parkway to the bridge being completed by Newhall Land. The close proximity of the two projects required close coordination between the City and Newhall Land. In order to expedite the completion of both projects, paving work was removed from the City's contract and performed by the developer. A payment in the amount of $300,000 reimburses Newhall Land for the cost of this work. On December 9, 2008, the City Council appropriated $2,000,000 in Bouquet Canyon Second Access B&T Funds to the project. As the GVR Bridge is located in the Bouquet Canyon B&T District, staff recommends approving a loan from the Bouquet Canyon Second Access B&T Fund to the Bouquet Canyon B&T District in this amount. The loan will be repaid at a future date when funds in the amount of $2,000,000 are available in the Bouquet Canyon B&T District. Additionally, an appropriation of $29,304 from the LMD Fund Balance 354 is being requested to cover the cost of the landscape median improvements added to the project scope. Final determination of expenditures eligible for federal reimbursement is pending the results of a Caltrans review of the closeout package. The closeout package cannot be submitted to Caltrans for review until the project has been accepted by the City Council. Staff anticipates full reimbursement of all federal funds available; however, should the City not receive the full federal reimbursement amount, Bouquet Canyon B &T District funding is available. The Golden Valley Road Bridge Over the Santa Clara River, Project 54013, was completed to the satisfaction of the City Engineer on July 9, 2010. ALTERNATIVE ACTIONS Other action as determined by the City Council. FISCAL IMPACT The resolution to correct the funding source does not increase the previously approved construction budget. Adequate funding is currently appropriated in the project expenditure accounts. The appropriation of LMD Funds provides for the change order work to construct a landscaped median. M ATTACHMENTS Resolution Notice of Completion Location Map I RESOLUTION 10- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, APPROVING A LOAN FROM THE BOUQUET CANYON SECOND ACCESS BRIDGE AND THOROUGHFARE FUND TO THE BOUQUET CANYON BRIDGE AND THOROUGHFARE DISTRICT IN THE AMOUNT OF $2,000,000 WHEREAS, the Golden Valley Road Bridge Over the Santa Clara River, Project S4013, is the final segment of new roadway construction to complete the construction of the Cross Valley Connector east -west corridor; and WHEREAS, the City successfully secured significant federal funds to construct the roadway reducing the City's need to utilize local funds; and WHEREAS, the federal earmark from the Transportation, Treasury, Independent Agencies, and General Government Appropriations Act 2005, National Corridor Planning and Border Development Program, allocated $4,725,000 towards the project; and WHEREAS, the requirement to secure these funds was to obtain a Notice of Authorization to Proceed by September 30, 2008, created a need to accelerate funding the proj ect; and WHEREAS, Bouquet Canyon Second Access Bridge and Thoroughfare (B&T) Funds in the amount of $2,000,000 were identified as eligible and available to use for the roadway construction; and WHEREAS, the Bouquet Canyon Second Access B&T Funds have since been deemed ineligible for construction of the roadway; and WHEREAS, the funds have been used for construction of the Golden Valley Road Bridge over the Santa Clara River; and WHEREAS, adequate funding in the Bouquet Canyon B&T District to fund the expenditures is not currently available; the Bouquet Canyon Second Access B&T Funds will loan the sum of $2,000,000 to the Bouquet Canyon B&T District. NOW, THEREFORE, the City Council of the City of Santa Clarita does hereby resolve as follows: SECTION 1. It is agreed that $2,000,000 from the Bouquet Canyon Second Access B&T Funds will be loaned to the Bouquet Canyon B&T District. SECTION 2. The loan will be repaid at a future date when funds in the amount of $2,000,000 are available in the Bouquet Canyon B&T District. SECTION 3. The loan will be paid back at an interest rate equivalent to the yield of the average monthly investment portfolio. SECTION 4. The City Clerk shall certify to the adoption of this Resolution.
