SUBJECT: OLD TOWN NEWHALL LIBRARY, PROJECT F2007 -
REJECTION OF ALL BIDS AND AUTHORIZATION TO
RE -ADVERTISE FOR BIDS

RECOMMENDED ACTION
Redevelopment Agency:
1. Reject all bids and direct staff to re -advertise for bids for the Old Town Newhall
Library, Project F2007.
2. Authorize an increased expenditure in the amount of $50,000 to the existing contract
with R.C. Becker & Son, Inc., for rough grading.
City Council: No action required.
BACKGROUND
On November 22, 2005, the City Council approved the Downtown Newhall Specific Plan
(DNSP). During that meeting, the City Council also certified the Environmental Impact Report
that examined the many attributes of the DNSP's vision and determined the benefits of
implementing the plan would be substantial for the entire community. The DNSP was adopted to
transform Old Town Newhall into a thriving, mixed-use, pedestrian -oriented urban village with a
series of economic engines. The DNSP identifies a public library to visually anchor and define
the north end of Main Street.
After meeting with representatives from the City Council, Redevelopment Agency, and Newhall
community, and incorporating ideas from each, the City Council approved the architectural
design for the construction of a 30,000 -square -foot, two-story public library in Old Town

Newhall on May 11, 2010. The new library will be of steel moment frame construction, certified
as Leadership in Energy and Environmental Design (LEED) Silver, on a 2.45 -acre site including
site grading and at -grade landscaped parking lots.
An invitation to bid was published three times (August 15, August 18, and August 22, 2010), and
noticed to the City's Web site. Plans and specifications were also sent to area plan rooms.
Twenty-six responsive bids were submitted to the City and opened by Purchasing on
September 16, 2010. The results are shown below:

Staff recommends that all bids be rejected and authorize the re -advertisement of this project.
When bids were reviewed by staff, it was found that the low bidder and a number of the other
bidders did not submit with their bid certain documents required by the bid documents. As a
result, those bids may not be responsive to the bid documents. If the City were to proceed to
award the contract to the next lowest responsive bidder, who did provide all of the required bid
documents, the cost to the City on this project would be at least an additional $1 million.
Therefore, staff recommends that the Redevelopment Agency reject all bids and re -advertise for
bids on this project.

On May 11, 2011, in preparation for the construction of the library, the Redevelopment Agency
awarded a contract to R.C. Becker & Son, Inc., for rough grading. This work is in progress and
includes over -excavation and compaction of the soil supporting the building and parking lot
areas. To date, much of the grading has yet to be completed, but most of the contingency is being
used to pay for unforeseen conditions that have added to the scope of work. So far, the
contingency has paid for the unanticipated removal and slurry filling of ten septic systems
discovered during rough grading and a concrete slab had to be removed from under what was
thought to be only asphalt parking lots. The contingency has also covered the cost of modifying a
temporary traffic signal for coordination between the library grading project and the Old Town
Newhall Streetscape Phase II project, additional potholing for existing utilities on Lyons Avenue,
and extra protective measures for the Old Jail. These costs exceed the amount expected during
the planning of this project. Therefore, staff requests additional spending authority in the amount
of $50,000 to the existing contract with R.C. Becker & Son, Inc., to cover any other
unanticipated work that may arise as rough grading continues.
ALTERNATIVE ACTIONS
Other alternatives as directed by the Redevelopment Agency.
FISCAL IMPACT
The total estimated cost of the library grading project is $441,839, of which $391,834 has been
obligated to date. The requested increase of $50,000 will be funded with the remaining balance
available for this project.
