Approve the architectural design for the Old Town Newhall Library. 2. Adopt a resolution consenting to payment being made by the Redevelopment Agency of the City of Santa Clarita (Agency) for the demolition of concrete slabs and rough grading, historic preservation services, geotechnical and soil testing services, and construction staking pertaining to the Newhall library site, and making the findings required by Section 33445 of the California Redevelopment Law to permit use of Agency funds to provide for the construction of a public library. Redevelopment Agency: 1. Approve the architectural design for the Old Town Newhall Library. 2. Adopt a resolution of the Agency requesting consent from the City Council to use Agency funds for the demolition of concrete slabs and rough grading, historic preservation services, geotechnical and soil testing services, and construction staking pertaining to the Newhall library site, and making the findings required by Section 33445 of the California Redevelopment Law to permit use of Agency funds to provide for the construction of a public library. � 10-0 Ado tedoLA 10-3 Find the bids of Cobalt Construction Company and Fran -Bar General Engineering Contractors to be non-responsive and award the construction contract to R.C. Becker and Son, Inc., in the amount of $257,834 and authorize a contingency of $39,000 for a total amount of $296,834. 4. Approve the plans and specifications for the demolition of concrete slabs and rough grading for the Old Town Newhall Library project. Authorize an increased expenditure of $25,000 to Allan E. Seward Engineering Geology, Inc., for geotechnical and soil testing service during construction. Authorize an increased expenditure of $20,000 to Pinnacle Land Surveying, Inc., for construction staking. Authorize an expenditure of $50,000 for staff management, inspection, labor compliance, and oversight. Appropriate funds in the amount of $391,834 from the Redevelopment Agency Non -Housing fund balance to Expenditure Account F2007390-5161.001. 9. Authorize the Executive Director or designee to execute all documents, subject to the Agency Attorney approval. BACKGROUND On June 24, 2008, the City Council awarded a design contract to LPA, Inc., for the conceptual design of the proposed Old Town Newhall Library, and on April 28, 2009, the City Council and Redevelopment Agency increased the contract to include the architectural design and civil engineering site design for plans and specifications for the construction of the library. During the public comment period at the City Council meeting on March 23, 2010, members of the Newhall Redevelopment Committee and Old Town Newhall Association expressed concern about the architecture of the library facade facing Lyons Avenue. City Council asked staff to review the architecture and work with the community in addressing their concerns. The architectural design presented tonight represents the design changes as a result of the meeting with the Library Ad Hoc Committee, the Newhall Redevelopment Committee, and the Old Town Newhall Association. The revised design represents the more Victorian details as demonstrated in the design for the Southern Hotel. This was achieved by altering the roofline, the look of the tower, various detailing, and by enhancing the entry. The additional cost of $117,000 to make these architectural changes is covered by the contingency approved by the City Council in April 2009 for the architectural design contract. The design changes also have an impact on the schedule, moving the award of the construction contract to September 2010, thus changing the scheduled opening for the library. Z Staff is requesting the award of the rough grading of the site to provide a graded pad for the library in advance of its construction and is presenting the Old Town Newhall Library architectural design for City Council and Redevelopment Agency approval. The proposed design changes do not have an impact on the award of the grading contract. The City issued a Notice Inviting Bids on February 28, 2010. On March 30, 2010, the City's Purchasing Division received -12 bids as outlined in the attached bid results. After review of the bids, City staff determined that the bids from the two lowest bidders, Cobalt Construction Company and Fran -Bar General Engineering Contractors, were deemed non-responsive due to failure to list references from "public agencies" as specified in the contract requirement. Also, Cobalt Construction Company was not performing at least 50 percent of the work as required by the contract documents. Staff recommends awarding the construction contract to R.C. Becker and Son, Inc., the third lowest, responsive bidder. R.C. Becker and Son, Inc., possesses a state contractor's license and is in good standing with the State Contractor's License Board. Demolition and rough grading are scheduled to begin in June 2010 and is anticipated to be completed within 32 working days after the effective date of the Notice to Proceed. Specific construction requirements were provided and included in the contract specifications to protect the Old Jail, located at 24522 Spruce Street. There will be on-site inspections during construction of the new library to ensure the protection of the Old Jail. Staff is requesting an increase in spending authority of a total of $45,000 ,to the existing contracts for professional services with Allan Seward Engineering Geology, Inc., and Pinnacle Land Surveying for soil testing and construction staking for this phase of construction. Both consultants were originally contracted for design -related soils and surveying services. Finally, an additional $50,000 is being requested for staff management, inspection, labor compliance, and oversight of the project during the rough grading phase of the library construction. ALTERNATIVE ACTIONS Other action as determined by the City Council and/or Redevelopment Agency. FISCAL IMPACT Redevelopment Agency appropriate funds in the amount of $391,834 from the Redevelopment Agency Non -Housing fund balance to Expenditure Account F2007390-5161.001. Burbank, CA $359,000.00 Berry General Engineering Ventura, CA $376,926.00 Southern California Grading Irvine, CA $429,393.00 NA RESOLUTION 10- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, MAKING THE FINDINGS REQUIRED BY SECTION 33445 OF THE CALIFORNIA REDEVELOPMENT LAW AND DETERMINING THAT THE DEMOLITION OF CONCRETE SLABS AND ROUGH GRADING, HISTORIC PRESERVATION SERVICES, GEOTECHNICAL AND SOIL TESTING SERVICES, AND CONSTRUCTION STAKING TO ALLOW FOR THE CONSTRUCTION OF A PUBLIC LIBRARY IS OF BENEFIT TO THE NEWHALL REDEVELOPMENT PROJECT AREA WHEREAS, the Redevelopment Agency of the City of Santa Clarita (the "Agency") is a public body, corporate and politic, duly established and authorized to transact business and exercise powers under and pursuant to the provisions of the Community Redevelopment Law of the State of California, constituting Part 1 of Division 24 of the Health and Safety Code of the State of California (the "Law"), including the power to expend funds for public improvements for the benefit of the Newhall Redevelopment Project Area ("Project Area"); and WHEREAS, the City of Santa Clarita ("City") is the legislative body for the community in which the Project Area is located and pursuant to Health and Safety Code Section 33445 is required to consent to payments made by its Agency for the demolition of concrete slabs and rough grading, historic preservation services, geotechnical and soil testing services, and construction staking to allow for the construction of a public library; and WHEREAS, the Downtown Newhall Specific Plan adopted on December 22, 2005, provides for the funding of public improvements within the Project Area; and WHEREAS, the provision of public improvements is consistent with the Redevelopment Agency's Five -Year Implementation Plan in that the demolition of concrete slabs and rough grading, historic preservation services, geotechnical and soil testing services, and construction staking for the construction of a public library ("Project") is identified within the Downtown Newhall Specific Planus a goal and objective; and WHEREAS, the Agency desires to demolish concrete slabs, rough grade, secure historic preservation services, geotechnical and soil testing services, and construction staking with $391,834 of Agency funds as presently the City does not have funds available for this project; and WHEREAS, there are appropriate facts supporting the findings required by Health and Safety Code Section 33445 for the City Council to consent to the Agency's expenditure of funds for the demolition of concrete slabs and rough grading, historic preservation services, geotechnical and soil testing services, and construction staking to allow for public improvements provided by the Project. 5 NOW, THEREFORE, the City Council of the City of Santa Clarita does hereby resolve as follows: SECTION 1. Recitals. The City Council hereby finds that the above recitals are true and correct and incorporates them herein. SECTION 2. Findings Required by Health and Safety Code Section 33445. The City Council hereby determines that: a. The Project is of benefit to the Project Area as there are inadequate public facilities within the Project Area and the demolition of concrete slabs and rough grading, historic preservation services, geotechnical and soil testing services, and construction staking to allow for construction of a public library will provide those needed public facilities; and b. No other reasonable means of financing the demolition of concrete slabs and rough grading, historic preservation services, geotechnical and soil testing services, and construction staking are available to the community as the City is using its funds to undertake other public improvements throughout the City; and That the payment of funds for the Project will assist in the elimination of blighting conditions inside the Project Area by providing for a prepared site for the construction of a public library. The Project once complete will assist in attracting new businesses and residential developments to the area as the Project will be a positive public amenity within the Project Area; and d. The use of Agency funds for the site preparation is consistent with the Agency's adopted implementation plan per Health and Safety Code Section 33490. SECTION 3. Cily Consent. The City Council consents to the Agency's request to pay $391,834 for site preparation to permit the construction of a public library. SECTION 4. Effective Date. This Resolution shall take effect from and after its date of passage, approval, and adoption. SECTION 5. Certification.
