RECOMMENDED ACTION
City Council approve the plans and specifications for the DBAA 6 and 18 Sewer Connection,
Project R3003, and award the construction contract to South Pac Industries in the amount of
$91,635, and authorize a 20 percent contingency in the amount of $18,327, for a total
contract amount not to exceed $109,962.
2. Authorize $9,163 for construction management support for labor compliance, materials
testing, and inspection services.
Authorize the City Manager or designee to execute all documents, subject to City Attorney
approval.
BACKGROUND
This project will construct a drain line from the output of two groundwater pumping stations
located in the Shangri-La tract in Canyon Country, which comprises DBAA 6 and 18. The
groundwater is currently being discharged into a Los Angeles County stormdrain and will be
redirected to the sanitary sewer system.
The discharge of this water is administered and operated under DBAA (Districts) 6 and 18. This
service confers special drainage benefits to the 446 Shangri-La properties within these two
Districts. The creation of these Districts was a requirement of the development agreement to
build in the Shangri-La area, as approved by the County of Los Angeles prior to City
incorporation. The purpose of these Districts is to prevent groundwater from reaching shear -keys
created during the development's grading phases and ensure slope stability. The entitlement and

initial development of the Shangri-La community began in the late 1980s under the County of
Los Angeles and was completed under the City of Santa Clarita.
Awarding the construction contract will result in redirecting the daily discharge of approximately
61,000 gallons of groundwater from being pumped into the Los Angeles County Stormdrain
System and pumped into the Los Angeles County Sanitation District. Pumping groundwater into
the stormdrain channel requires a National Pollution Discharge Elimination System (NPDES)
permit. This permit is issued and enforced by the Los Angeles Regional Water Quality Control
Board (RWCQB). This groundwater has naturally occurring constituents consisting of chloride,
which exceed the limits of the permit (100 mg/1). A limit established under the Los Angeles
Region Basin Plan.
Connection of the DBAAs to the sanitary sewer represents a first step in the City's long-term plan
to permanently eliminate discharge into the Santa Clara River and limit additional financial
exposure resulting from fines imposed by the RWQCB due to the presence of these naturally
occurring constituents. As part of this interim solution, the Los Angeles County Sanitation
District has permitted the discharge of this water for a period of five years, and City staff is
currently working on a permanent location to which the water may be discharged. A component
of staffs long-term plan to address this issue involves a negotiated settlement with the RWQCB,
which may include crediting costs associated with redirecting groundwater from Shangri-La
towards satisfying a portion of the fines relating to the City's existing NPDES permit.
The vast majority of the project work will take place in the flood control channel and will have
no impact to the adjacent community. Constraints and controls have been established in the
construction documents to reduce potential impacts on local traffic and to homeowners during
the construction phase. Construction is scheduled to begin February 2010 and is anticipated to be
complete within 30 working days following the Notice to Proceed. Staff will appoint inspectors
to ensure proper work performance by the contract and to handle daily field issues.
On December 9, 2009, the Director of Public Works authorized the advertisement for
construction bids. On January 19, 2010, the City's Purchasing Division received 21 bids for the
project (bid results attached). The lowest responsive bid was submitted by South Pac Industries
in the amount of $91,635. Budgeted funds for this project are $180,000. The remaining funds
will be utilized for project administration and support items such as inspection and labor
compliance.
Staff recommends that the project be awarded to South Pac Industries, the lowest responsible
bidder. This contractor possesses a state contractor's license and is in good standing with the
State Contractor's License Board. The contractor's bid has been reviewed for accuracy and
conformance to the contract documents and was found to be complete.
While the City maintains a "Support of Local Businesses" policy that can be utilized by the City
Council when warranted, the City is governed by the State Public Contract Code with regard to
public works project procurement. In these types of procurement, the Public Contract Code does
not permit a City to utilize a "Support of Local Businesses policy and instead requires the
contract to be awarded to the "lowest responsive bidder." As confirmed by the City Attorney's
Office, this direction precludes the City from applying any superceding criteria for award except

in the case of a tie. In other words, in awarding of Public Works contracts, the City is not
permitted to award to a bidder just because they are local, as the State Public Contract Code does
not allow the City to recognize them as the "lowest responsive bidder."
