HomeMy WebLinkAbout2010-07-13 - AGENDA REPORTS - RESO FOR USED OIL (2)CONSENT CALENDAR DATE: SUBJECT: DEPARTMENT: Agenda Item: /0 CITY OF SANTA CLARITA AGENDA REPORT City Manager Approval: Item to be presented by: July 13, 2010 Travis Lange RESOLUTION AUTHORIZING A.FUNDING REQUEST FOR THE CALRECYCLE USED OIL PAYMENT PROGRAM Public Works RECOMMENDED ACTION City Council adopt a resolution authorizing a funding request for the CalRecycle Used Oil Payment Program. BACKGROUND For the past several years, the.California Integrated Waste Management Board (CIWMB) has awarded annual block grant funding to local jurisdictions to assist municipalities with promoting Used Oil and Used Oil Filter Recycling Programs. In 2010, the CIWMB was abolished by the State Legislature and a new department, CalRecycle, was formed. The new department is within the California Natural Resources Agency and administers programs formerly managed by the CIWMB. CalRecycle has established a Used Oil Payment Program (OPP) in lieu of the former Used Motor Oil Block Grant. The goals and characteristics of the new program are the same and the reporting requirements have been streamlined. Staff will continue to apply for funding through the new OPP to pay for the continuation of our existing programs and outreach. These programs benefit the environment by educating Do -It -Yourself (DIY) oil changers of the dangers of improper disposal (dumping oil down the stormdrain or in the trash) of their oil and filters. The funds also assist cities with the costs associated with the promotion of State Certified Collection Center locations and help pay for door-to-door collections made by operators that are permitted to accept oil and filters from residents. During 2009, Used Oil Grant funds helped cover the costs of over 124 door-to-door collections that were responsible for recycling over 1,484 gallons of motor oil and 219 oil filters by providing DlYers with a safe and convenient means to recycle their oil. Ad*W'g`m.ltrss Beginning in 2006, in an effort to work collaboratively with the City's business community, staff partnered with Curbside, Inc., to begin collection of used oil and filters from small businesses categorized by the State Department of Toxic Substances Control (DTSC) as Conditionally Exempt Small Quantity Generators (CESQGs - pronounced "squeegies"). As in the past, the costs associated with oil filter collection from CESQGs will continue to be covered by the new OPP. Based on information presented by CalRecycle, City staff is recommending the City Council to adopt the resolution that will remain in effect until rescinded by the City Council. The resolution will expedite the payment process of the Used Oil Payment Program (OPP) for this fiscal year and for future years. ALTERNATIVE ACTIONS Other action as determined by the City Council. FISCAL IMPACT Staff anticipates receiving approximately $20,000 per year from the OPP. ATTACHMENTS Resolution 11 RESOLUTION 10- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, AUTHORIZING A FUNDING REQUEST FOR THE CALRECYCLE USED OIL PAYMENT PROGRAM WHEREAS, the people of the State of California have enacted the California Oil Recycling Enhancement Act that provides funds to cities and counties for establishing and maintaining local used oil collection programs that encourage recycling or appropriate disposal of used oil; and WHEREAS, pursuant to Public Resources Code §48690 the Department of Resources Recycling and Recovery (CalRecycle), formerly known as the California Integrated Waste Management Board, has established the Used Oil Payment Program (OPP) to make payments to qualifying jurisdictions for implementation of their used oil programs; and WHEREAS, in furtherance of this authority, CalRecycle is required to establish procedures governing the administration of the OPP; and WHEREAS, CalRecycle's procedures for administering the OPP require, among other things, an applicant's governing body to declare by resolution certain authorizations related to the administration of the program. NOW, THEREFORE, the City Council of the City of Santa Clarita does hereby resolve as follows: SECTION 1. The City Council authorizes the submittal of a OPP application to CalRecycle. SECTION 2. The City Manager, or designee, is hereby authorized and empowered to execute in the name of the City of Santa Clarita all documents, including but not limited to, applications, agreements, annual reports including expenditure reports, and amendments necessary to secure said payments to support the City's Used Oil Collection Program. SECTION 3. This resolution is effective until rescinded by the City Council. SECTION 4. The City Clerk shall certify to the adoption of this Resolution.
