HomeMy WebLinkAbout2010-07-13 - AGENDA REPORTS - VACATE SAN FERNANDO & LYONS (2)CONSENT CALENDAR DATE: SUBJECT: DEPARTMENT Agenda Item: I t CITY OF SANTA CLARITA AGENDA REPORT City Manager Approval Item to be presented by July 13, 2010 Chris Price INTENTION TO VACATE SAN FERNANDO ROAD BETWEEN LYONS AVENUE AND 11 TH STREET REQUIRED FOR THE CONSTRUCTION OF THE OLD TOWN NEWHALL LIBRARY Public Works RECOMMENDED ACTION City Council adopt a resolution declaring its intention to order the vacation of San Fernando Road between Lyons Avenue and 11 th Street/Railroad Avenue required for the construction of the Old Town Newhall Library. 2. Set August 24, 2010, as the date of the public hearing. 3. Direct the City Clerk to publish a notice as required by Part 3 of Division 9 of the State of California Streets and Highways Code. BACKGROUND In accordance with the Downtown Newhall Specific Plan adopted December 22, 2005, by the City Council and Redevelopment Agency, the following actions have occurred: On June 24, 2008, the City Council awarded a design contract to LPA, Inc. (LPA), for the conceptual design of the proposed Old Town Newhall Library in accordance with the Downtown Newhall Specific Plan. The scope of services for the first phase included the City working with the Los Angeles County library consultant to verify the building program and determine an overall conceptual plan for the library and the library site. • On April 28, 2009, the City Council authorized an increase in spending authority to the contract with LPA to include design development, on-site and off-site public improvements, and construction plans and specifications. The City Council also granted City staff a spending Adapt. ks� / authority to pay the Newhall County Water District for the design costs of a new 24 -inch water line to downtown Newhall in order to provide adequate fire flow to the proposed library site. Finally, the City Council approved staff management and oversight of the services associated with the design phase. The City has acquired ownership of all properties within the project site necessary to accommodate the library building, parking, and utility requirements. Staff is requesting the City Council to set the public hearing for August 24, 2010, to adopt a resolution ordering the vacation of San Fernando Road, which is required by state codes and local ordinances to be completed prior to issuance of a building permit for the new library. ALTERNATIVE ACTIONS Other action as determined by the City Council. FISCAL IMPACT Minimal costs to publish a notice as required by Part 3 of Division 9 of the State of California Streets and Highways Code. ATTACHMENTS Resolution Exhibit "A" - Legal Description Exhibit "B" - Vacation of Easement Map RESOLUTION 10- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, DECLARING ITS INTENTION TO VACATE A PORTION OF SAN FERNANDO ROAD BETWEEN LYONS AVENUE AND 11 TH STREET IN THE CITY OF SANTA CLARITA WHEREAS, San Fernando Road between Lyons Avenue and 1 lth Street is no longer needed; and WHEREAS, the land within this portion of San Fernando Road is required for the construction of the Old Town Newhall Library; and WHEREAS, sewer, gas, water, telephone, electric, and stormdrain facilities will retain and/or be granted new easements over the portion to be vacated; and WHEREAS, the proposed street vacation is determined to be a project and was reviewed pursuant to the provisions of the California Environmental Quality Act. NOW, THEREFORE, pursuant to the provisions of the "Street Vacation Act of 1941," being Part 3 of Division 9 of the Streets and Highways Code of the State of California, the City Council of the City of Santa Clarita does hereby resolve as follows: SECTION 1. That it is the intention of the City Council of the City of Santa Clarita, California, to order the vacation of San Fernando Road between Lyons Avenue and 1 lth Street as described in Exhibit "A" and shown on Exhibit "B," located within the City of Santa Clarita, proposed to be vacated under Section 8320 of Chapter 3 of the Streets and Highways Code. SECTION 2. That at the hour of 6:00 p.m., or as soon thereafter as possible, on August 24, 2010, at City Hall, 23920 Valencia Boulevard, within the City of Santa Clarita, is the time and place when and where any and all persons interested in or objecting to the proposed vacation of this public street may appear before the City Council to be heard, offer testimony, and submit evidence in relation thereto. SECTION 3. That the City Clerk of the City of Santa Clarita, California, is hereby directed to cause Notice of Street Vacation of San Fernando Road between Lyons Avenue and 1 1 th Street within the City of Santa Clarita, California, and Public Hearing thereon to be published as required by the "Street Vacation Act of 1941," being Part 3 of Division 9 of the Streets and Highways Code of the State of California; and the City Council of the City of Santa Clarita, California, hereby elects to proceed under the provisions of this act.
