SUBJECT: VACATION OF SAN FERNANDO ROAD BETWEEN LYONS
AVENUE AND 11 TH STREET — REQUIRED FOR THE
CONSTRUCTION OF THE OLD TOWN NEWHALL LIBRARY

RECOMMENDED ACTION
City Council conduct a public hearing and adopt a resolution vacating a portion of San
Fernando Road between Lyons Avenue and 11 th Street/Railroad Avenue, as described in
Exhibit "A" and as shown on Exhibit "B," required for the construction of the Old Town
Newhall Library.
2. Direct the City Clerk to record the certified original resolution along with Exhibit "A" and
Exhibit "B" in the Office of the Registrar -Recorder of the County of Los Angeles.
BACKGROUND
On July 13, 2010, the City Council adopted Resolution 10-56, declaring its intention to vacate a
portion of San Fernando Road between Lyons Avenue and 1 Ith Street/Railroad Avenue and
established August 24, 2010, as the date for the public hearing. Notices of the Public Hearing
were published and posted as required by Part 3 of Division 9 of the State of California Streets
and Highways Code.
No utility easements will be retained within the portion being vacated. The proposed street
vacation was reviewed under California Environmental Quality Act guidelines and a Notice of
Exemption was filed with the County Clerk of the County of Los Angeles.
The City has acquired ownership of all properties within the project site necessary to
accommodate the library building with associated parking and utility requirements.

RESOLUTION 10-
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA CLARITA, CALIFORNIA, VACATION OF
A PORTION OF SAN FERNANDO ROAD BETWEEN LYONS AVENUE
AND 11 TH STREET IN THE CITY OF SANTA CLARITA
WHEREAS, San Fernando Road between Lyons Avenue and 11th Street is no longer
needed; and
WHEREAS, the land within this portion of San Fernando Road is required for the
construction of the Old Town Newhall Library; and
WHEREAS, sewer, gas, water, telephone, electric, and stormdrain facilities will retain
and/or be granted new easements over the portion to be vacated; and
WHEREAS, the proposed street vacation is determined to be a project and was reviewed
pursuant to the provisions of the California Environmental Quality Act.
NOW, THEREFORE, pursuant to the provisions of the "Street Vacation Act of 1941,"
being Part 3 of Division 9 of the Streets and Highways Code of the State of California, the City
Council of the City of Santa Clarita does hereby resolve as follows:
SECTION 1. That it is hereby found and determined that the portion of San Fernando
Road as described in Exhibit "A" and as shown on Exhibit "B" attached hereto and incorporated
herein by this reference, which real property located in the City of Santa Clarita, County of Los
Angeles, State of California, is no longer needed for present or prospective use based on the
following facts: That this street vacation does not cut off the sole access to the properties of any
person and does not terminate a public service easement; that the subject right-of-way is excess
right-of-way not required.
SECTION 2. That the land within this portion of San Fernando Road is required for the
construction of the Old Town Newhall Library.
SECTION 3. That the City Clerk of the City of Santa Clarita, California, be instructed to
record the certified original resolution, in the office of the Registrar of the County of Los
Angeles, at which time the area will no longer be a public road.

LEGAL DESCRIPTION
VACATION OF EASEMENT FOR PUBLIC USE AND ROAD PURPOSES
SAN FERNANDO ROAD
Vacation of easement for public use and road purposes over that portion of San Fernando Road lying
within Block 9 of the Town of Newhall, City of Santa Clarita, County of Los Angeles, State of
California, as shown on the map filed in Book 53 Pages 21 and 22 of Miscellaneous Records, in the
Office of the County Recorder of said County, more particularly described as follows:
BEGINNING at the most easterly corner of Lot 3 of said Block 9, said corner also being the point of
beginning of the easement for right-of-way and public highway purposes granted, conveyed, and
dedicated to the State of California by deed recorded as Document No. 426, on May 20, 1935, in Book
13364 Page 350 of Official Records, in the Office of the County Recorder of said County (State
Highway Easement);
thence S. 57°29'00" W., along the southeasterly line of said Lot 3 and the southeasterly line of said
State Highway Easement, 10.35 feet to the easterly line of said State Highway Easement;
thence S. 08°45'45" W., along said easterly line, 187.05 feet, more or less, to the most northerly corner
of the land described in Grand Deed to the County of Los Angeles, recorded October 28, 1970, as
Instrument No. 2938, in the Office of the County Recorder of said County, said corner also being the
beginning of a curve concave to the northeast, having a radius of 27.00 feet, being tangent to said
easterly line, and being tangent to a line parallel with and 40.00 feet northwesterly of, measured at
right angles to, the southeasterly line of said Block 9;

The above-described vacation of easement encompasses an area of 26,139 square feet, more or less,
and has no affect on the underlying fee ownership rights.
The State of California, Department of Transportation R/W Map No. P24068-1-7, 07 — LA — 126 —
10.61, dated 11/8/95, and revised 9/26/96, is the basis of bearings for this legal description.

NOTICE OF PUBLIC HEARING
PUBLIC NOTICE IS HEREBY GIVEN:
A public hearing will be held before the City Council of the City of Santa Clarita to
consider vacating San Fernando Road between Lyons Avenue and 11 th Street required
for the construction of the Old Town Newhall Library.
The public hearing will be held by the City Council in the City Hall Council Chambers,
23920 Valencia Blvd., first floor, the 24th day of August 2010, at or after 6:00 p.m.
Proponents, opponents, and any interested persons may be heard on this matter at this
time. Further information may be obtained by contacting Jim Jordan, Senior Engineer,
(661) 255-4968, Santa Clarita City Hall, 23920 Valencia Blvd., Suite 302, Santa Clarita,
California.
If you wish to challenge the action taken on this matter in court, you may be limited to
raising only those issues you or someone else raised at the public hearing described in

public hearing.
