HomeMy WebLinkAbout2010-10-12 - ORDINANCES - MC 08-112 ANNEXATION (2)ORDINANCE NO. 10-13 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, APPROVING PREZONE NO. 08-001 (MASTER CASE 08-112) FOR ANNEXATION AREA "B" OF THE NORTHEAST ANNEXATION AREA THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. FINDINGS OF FACT. The City Council does hereby make the following findings of fact: a. On June 25, 2008, staff initiated Master Case 08-112 consisting of Prezone 08-001, General Plan Amendment 08-001, Annexation 08-001, and Sphere of Influence Amendment 08-001 for 1,515 acres of land known as the Northeast Annexation. The Northeast Annexation is broken into four areas (Area "A" for Tick Canyon and Spring Canyon, Area "B" for Soledad Commons, Area "C" for Robinson Ranch 2, and Area "D" for the Doug Road Subdivision) contiguous to the corporate limits of the City of Santa Clarita. b. The project generally consists of Area "B" of the Northeast Annexation and is generally located south of Soledad Canyon Road at Mammoth Lane and north of State Route 14 as shown in the attached Exhibit "A". c. The project site associated with this annexation consists of approximately 8.3 (Annexation Area "B") of the Northeast Annexation, contiguous to the corporate limits of the City of Santa Clarita. The remaining approximately 1,507 acres may be considered in the future by separate action. d. Commercial development within Area "B" was approved by the Los Angeles County Department of Regional Planning on February 4, 2008 and consists of a 62,708 square foot neighborhood shopping center on 8.3 acres. It is currently zoned Commercial 2 and Manufacturing 1 by the County of Los Angeles. e. Surrounding land use within the unincorporated territory of Los Angeles County consists primarily of vacant land. Surrounding land uses in the City consist primarily of developed single-family residences. f. Prezone 08-001, pertaining to Area "B" of the Northeast Annexation, proposes to prezone 8.3 acres as Community Commercial (CC). g. On August 3, 2010, an environmental Initial Study was prepared for GPA 08-001, PRZ 08-001, Annexation 08-001, and Sphere of Influence Amendment 08-001 for the proposed Northeast Annexation. Pursuant to the California Environmental Quality Act (CEQA) the Initial Study concluded that adverse environmental impacts associated with the project were less than significant and a Negative Declaration was prepared. h. The environmental document has been circulated for review and comment by affected governmental agencies and the public from August 3, 2010, to August 24, 2010. i. The Planning Commission of the City of Santa Clarita held a duly noticed public hearing on this issue on February 17, 2009. This public hearing was held at 7:00 p.m. at City Hall, 23920 Valencia Boulevard, Santa Clarita, CA 91355. At the hearing the Planning Commission considered the staff presentation, staff report, the Negative Declaration prepared for the project, and public testimony on the proposal. At the public hearing noted above, the Planning Commission of the City of Santa Clarita unanimously adopted Resolution P08-25 recommending that the City Council adopt General Plan Amendment No. 08-001, an amendment to the General Plan Land Use Map, and Prezone 08-001, for the purpose of prezoning approximately 1,515 acres and adopting the Negative Declaration prepared for the project. k. The City Council of the City of Santa Clarita held a duly noticed public hearing on this issue on August 24, 2010. This public hearing was held at 6:00 p.m. at City Hall, 23920 Valencia Boulevard, Santa Clarita, CA 91355. At the hearing the City Council opened the public hearing and continued the item to the September 14, 2010 City Council meeting. 1. At the September 14, 2010 meeting, the City Council considered the staff report, took public testimony, and continued the item to the September 28, 2010 City Council meeting. in. Finding that property notice had been given with regard to Area "B" of the Northeast Annexation, at the September 28, 2010 meeting, the City Council continued the public hearing for the project, received public testimony, considered both written and oral staff reports, and closed the public hearing. n. All notification requirements pursuant to Sections 65090 and 65091 of the Government Code of the State of California were duly followed. o. Two letters of opposition were received regarding the annexation prior to the September 28, 2010 City Council meeting. SECTION 2. Based upon the testimony and other evidence received at the hearing, and upon the study and investigation made by the Planning Commission and on its behalf, the City Council further finds as follows: a. The purpose of the proposal is to prezone the subject site from Los Angeles County zoning designations to Community Commercial (CC) upon adoption of proposed 2 i General Plan Amendment No. 08-001, pertaining to Area "B" of the Northeast Annexation, approved under separate resolution, prior to annexation. b. That the prezone has been reviewed for consistency with the City's proposed General Plan Amendment No.08-001. c. Public participation and notification requirements pursuant to Sections 65090 and 65091 of the Government Code of the State of California were duly followed. SECTION 3. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS. Based upon the testimony and other evidenced received, the City Council finds as follows: a. The City Council, hereby finds that the proposed Negative Declaration prepared in connection with GPA 08-001, PRZ 08-001, Annexation 08-001, SOI Amendment 08-001 pertaining to Area "B" of the Northeast Annexation has been prepared in compliance with the California Environmental Quality Act, has been reviewed and considered by the City Council, and reflects the independent judgment of the City Council and that based on the Initial Study and the entire record of proceedings, there is no substantial evidence that the project will have a significant effect on the environment. Therefore, the City Council approved the Negative Declaration for the project as included in the agenda packet for the September 28, 2010, City Council Meeting. The Director of Community Development is hereby designated as the custodian of the documents and other materials which constitute the record of' proceedings in this matter. The documents and materials are on file in the Department of Community Development, City Hall, 23920 Valencia Boulevard, Suite 302, Santa Clarita, CA, 91355. SECTION 4. FINDINGS FOR PREZONE. Based upon the foregoing facts and findings, the City.Council hereby finds as follows: a. Prezone 08-001 pertaining to Area "B" of the Northeast Annexation, as shown in the attached Exhibit "A", is consistent with the objectives of the Unified Development Code, the General Plan and development policies of the City in that the proposed prezoning designations are consistent with existing land uses in the area and would not result in a substantive change to the existing zoning of the project site, as the area and the adjacent developed area is developed in compliance with the proposed zones' development standards. SECTION 5. The City Council hereby introduces and passes to second reading, this Ordinance approving Prezone 08-001 pertaining to Area "B" of the Northeast Annexation as described herein and shown on attached Exhibit "A". SECTION 6. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law. 3 PASSED, APPROVED AND ADOPTED this 12th day of October, 2010.
