HomeMy WebLinkAbout2010-08-24 - RESOLUTIONS - VACATE SAN FERNANDO RD @ LYONS (2)RESOLUTION NO. 10-73 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, VACATION OF A PORTION OF SAN FERNANDO ROAD BETWEEN LYONS AVENUE AND 11TH STREET IN THE CITY OF SANTA CLARITA WHEREAS, San Fernando Road between Lyons Avenue and 11 th Street., is, no longer needed;and WHEREAS, the land within this portion of San Fernando Roadis required for the construction of the Old Town Newhall Library; and WHEREAS, sewer, gas, water, telephone, electric, and stormdrain;facilities dill retain and/or be granted new easements over the portion to be vacated; and WHEREAS, the proposed street vacation is determined to be a project and was reviewed pursuant to the provisions of the California Environmental Quality Act. NOW, THEREFORE, pursuant to the provisions of the "Street Vacation Act of 1941," being Part 3 of Division 9 of the Streets and Highways Code of the State of California, the City Council of the City of Santa Clarita does hereby resolve as follows: SECTION 1. That it is hereby found and determined that the portion of San Fernando Road as described in Exhibit "A" and as shown on Exhibit "B" attached hereto and incorporated herein by this reference, which real property located in the City of Santa Clarita, County of Los Angeles, State of California, is no longer needed for present or prospective use based on the following facts: That this street vacation does not cut off the sole access to the properties of any person and does not terminate a public service easement; that the subject right-of-way is excess right-of-way not required. SECTION 2. That the land within this portion of San Fernando Road is required for the construction of the Old Town Newhall Library. SECTION 3. That the City Clerk of the City of Santa Clarita, California, be instructed to record the certified original resolution, in the office of the Registrar of the County of Los Angeles, at which time the area will no longer be a public road. 1 PASSED, APPROVED AND ADOPTED this. 24th day of August, 2010 ATTEST: CITY CLERK STATE OF CAUVORNIA ) COUNTY OF LOS ANGELES ) ss. City Clerk By Deputy City Clerk 1 EXHIBIT "A" LEGAL DESCRIPTION VACATION OF EASEMENT FOR PUBLIC USE AND ROAD PURPOSES SAN FERNANDO ROAD Vacation of easement for public use and road purposes over that portion of San Fernando Road lying within Block 9 of the Town of Newhall, City of Santa Clarita, County of Los Angeles, State of California, as shown on the map filed in Book 53 Pages 21 and 22 of Miscellaneous Records, in the Office of the County Recorder of said County, more particularly described as follows: BEGINNING at the most easterly corner of Lot 3 of said Block 9, said corner also being the point of beginning of the easement for right-of-way and public highway purposes granted, conveyed, and dedicated to the State of California by deed recorded as Document No. 426, on May 20, 1935, in Book 13364 Page 350 of Official Records, in the Office of the County Recorder of said County (State Highway Easement); thence S. 57°29'00" W., along the southeasterly line of said Lot 3 and the southeasterly line of said State Highway Easement, 10.35 feet to the easterly line of said State Highway Easement; thence S. 08°45'45" W., along said easterly line, 187.05 feet, more or less, to the most northerly corner of the land described in Grand Deed to the County of Los Angeles, recorded October 28, 1970, as Instrument No. 2938, in the Office of the County Recorder of said County, said corner also being the beginning of a curve concave to the northeast, having a radius of 27.00 feet, being tangent to said easterly line, and being tangent to a line parallel with and 40.00 feet northwesterly of, measured at right angles to, the southeasterly line of said Block 9; thence Southerly and Southeasterly, along said curve and the northeasterly boundary of said County land, through a central angle of 80'16'22", more or less, and an arc length of 37.83 feet, more or less, to a point on the northeasterly prolongation of the southeasterly line of Lot 15 of said Block 9, from which a radial line to the center of curve bears N. 18°29'23" E.; thence S. 57°30'45" W., along said northeasterly prolongation and the southeasterly line of said Lot 15, a distance of 65.87 feet, more or less, to a point on the southeasterly boundary of the land described in Grand Deed to the County of Los Angeles, recorded June 23, 1913, in Book 5754 Page 91 of Deeds, in the Office of the County Recorder of said County; thence S. 32'29'15" E., at right angles to the southeasterly line of said Block 9, a distance of 10.00 feet, more or less, to a point in a line parallel with and 40.00 feet northwesterly of, measured at right angles to, the southeasterly lines of said Blocks 9 and 10; thence S. 57°30'45" W., along said parallel line, 71.45 feet, more or less, to the southwesterly line of said Block 9; thence N. 32°25'45" W, along said southwesterly line, 16.81 feet, more or less, to the most westerly corner of that certain strip of land vacated by Resolution adopted November 5, 1935, by the California Highway Commission, State of California, a certified copy of said Resolution was recorded in Book 13839 Page 69 of Official Records, in the Office of the County Recorder of said County; 1 thence S. 81°43'20" E., along the southwesterly line of said strip of land, 10.43 feet, more or less, to a point on a curve in the westerly right-of-way line of San Fernando Road, said curve being concave to the east and having a radius of 440.00 feet, from said point a radial line to the center of curve bears N. 89°46'43" E.; thence Northerly, along said curve and said westerly right-of-way line, through a central angle of 08°59'02" and an are length of 68.99 feet to the end of curve; thence on a tangent bearing N. 08°45'45" E., along said westerly right-of-way line, 174.84 feet to the beginning of a tangent curve concave to the west and having a radius of 311.45 feet; thence Northerly, along said curve and said westerly right-of-way line, through a central angle of 08°40'54" and an arc length of 47.19 feet to a point of compound curvature, said curve being concave to the southwest and having a radius of 17.00 feet, from said point a radial line to the center of curve bears S. 89°55'09" W.; thence Northwesterly, Westerly, and Southwesterly, along said curve and said westerly right-of-way line, through a central angle of 122°35'51" and an arc length of 3 6.3 8 feet to a point of tangency on the northwesterly line of said Block 9; thence N. 57°29'00" E., along said northwesterly line, 66.27 feet, more or less, to a point lying S. 57029'00" W. 27.00 feet from the most northerly corner of said Block 9; thence S. 77°29'38" E. 38.17 feet to a point on the northeasterly line of said Block 9, said point lying S. 32"28'15" E. 27.00 feet from the most northerly corner of said Block 9; thence S. 32'28'15" E., along said northeasterly line, 48.13 feet, more or less, to the Point of Beginning. The above-described vacation of easement encompasses an area of 26,139 square feet, more or less, and has no affect on the underlying fee ownership rights.
