RECOMMENDED ACTION
City Council:
1. Approve the plans and specifications for the Alta Madera Pedestrian Over Crossing (POC)
Replacement, Project M0081.
2. Award the construction contract to Encorre Services, Inc., in the amount of $287;178 and
authorize a contingency in the amount of $57,435, for a total contract amount not to exceed
$344,613.
3. Authorize the appropriation of $20,000 from Landscape Maintenance District Fund balance
357 into Account M0081357-5161.001.
4. Authorize an increased expenditure in the amount of $35,000 to the existing professional
services contract with Tetra Tech, Inc., for surveying, construction materials testing, and
engineering support services during construction.
5. Authorize the City Manager or designee to execute all documents, subject to City Attorney
approval.
BACKGROUND
The City's Landscape Maintenance District (LMD) is responsible for the maintenance of all
pedestrian bridges connecting the paseo system. This project will replace the existing pedestrian
bridge crossing Alta Madera Drive in the South Valley Valencia neighborhood. The existing
timber bridge will be replaced with a new prefabricated steel truss bridge due to its deteriorated

condition. The substructure and superstructure require replacement as recommended in Los
Angeles County's bridge inspection report. The project scope will include removal and
replacement of the existing foundation, abutments, and a reconstruction of a portion of each of
the approaches.
An invitation to bid was published three times, July 31, August 17, and August 27, 2011, and
was noticed on the City's website. Plans and specifications were also sent to area plan rooms.
Eleven bids were submitted to the City and opened by Purchasing on August 31, 2011. The
results of the bids are shown below:

The lowest responsive bid was submitted by Encorre Services, Inc., in the amount of
$287,177.50. Staff recommends that the project be awarded to Encorre Services, Inc., for the bid
amount and a contingency of $57,435. The contractor possesses a valid state contractor's license
and is in good standing with the Contractors State License Board. The contractor's bid has been
reviewed for accuracy and conformance to the contract documents and was found to be complete.
The construction contingency amount requested will cover costs for unforeseen site conditions
such as the removal of unsuitable soil and costs associated with the removal of the existing
bridge foundation and abutment.
While the City maintains a Support of Local Business policy that can be utilized by the City
Council when warranted, the City is governed by the California Public Contract Code with
regard to Public Works project procurement. In these types of procurement, the Public Contract
Code does not permit a city to utilize a Support of Local Business policy and instead requires the
contract be awarded to the lowest responsible bidder. As confirmed by the City Attorney's
Office, this direction precludes the City from applying any superseding criteria for award except
in the case of a tie. Thus, in the awarding of Public Works contracts, the City is not permitted to
award to another bidder just because they are local, as the Public Contract Code does not allow
the City to recognize them as the "lowest" responsible bidder.
The additional spending authority of $35,000 for Tetra Tech, Inc., will provide for technical
support services during construction including surveying, construction materials testing, and
engineering support services. .

The current budget and requested appropriation is anticipated to fully fund the project, and
includes $71,992, of which $46,268 has been used to complete the design. The residual amount
will be used for labor compliance, project management oversight, construction engineering,
survey, and inspection.
City staff will notify local schools and homeowners associations of the proposed construction
work and schedule.
ALTERNATIVE ACTIONS
Other action as determined by the City Council.
FISCAL IMPACT
The requested appropriations will fully fund this project.
